Becton Dickinson Sole Source Letter PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA) on behalf of the Division of Intramural Research (DIR) intends to negotiate and award a purchase order without providing for full and open competition (Including brand-name) to Becton, Dickinson and COmpany, 2350 Qume Drive, San Jose, CA 9513 for a maintenance agreement to maintain the BD LSRFortessa flow cytometry system. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 334516 with a Size Standard of 500 employees. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-72. This acquisition is conducted under the procedures as prescribed in FAR subpart 13 - Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($150,000). STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. DESCRIPTION OF REQUIREMENT Background The mission of the Flow Cytometry Laboratory at the Hematology Branch within the DIR is to provide state of the art analysis and sorting of cells using flow cytometry. It is necessary for the ongoing research in the field of hematology. It is especially important to provide the flow cytometry analysis services in a timely manner in order to prevent any delays of important projects for the numerous clinical sections of the branch. The Fortessa flow cytometer analyzer is equipped with lasers, electronics, fluidics components, software, and computer components. Purpose and Objectives This is a new maintenance contract to cover the BD Fortessa analyzer. A maintenance contract must provide phone service and prompt service calls by the highly qualified BD engineers, to maximize the uptime and productivity for uninterrupted service to the Institute. During the preventive inspection, the trained service engineer will replace fluidics components, such as filters and valves, replace and inspect optical components if defective, replace tubing, and lubricate all mechanical parts per protocol. During the service contract agreement period the contractor must provide all necessary repairs for the instrument at no additional cost. The repairs may involve making corrections to the existing components or replace defective instrument components. For example, such components as lasers, flow cell bodies, and electronic boards and switches may become defective and will be replaced during the contract period. Period of Performance Maintenance agreement will be for a total of 12 months. Project Description The Contractor Must: Perform up to 2 preventive inspection of all the above components of the flow cytometer and validate it's integrity to meet manufacturers operational standards. The repairs and preventive inspections are necessary to maintain the instruments operational integrity to ensure achieving of reliable results for the clinical patient samples. The flow cytometry facility where the instrument to be serviced is located in 10CRC-3E5217 and 5209. The facility will be accessible to the contractor to perform necessary task to accomplish the objective of the service contract. Reporting Requirements and Deliverables There are no required reporting requirements. The contractor must provide the completion service report once the service is completed. Such report is due within 5 business days of the service and it is emailed to the laboratory. The service report is done at each service date. Validation, Inspection and Acceptance Requirements Upon completion of the service and or instrument maintenance, the laboratory personal will utilize the specific alignment particles to validate the instrument performance according to the set laboratory criteria. This validation will be performed within 48 hours of the service date. If the instrument performance does not meet the laboratory set criteria, the contractor's service engineer will be notified. The acceptance criteria of the instrument performance must be met upon completion of the service. The laboratory personal at Hematology Branch will perform the inspection of the service provided. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the Sole/Single Source Justification that is attached to this Notice of Intent. The Fortessa flow cytometer analyzer is clinical research equipment located in the hematology branch flow cytometry laboratory. The BD Bioscience manufactures this complex equipment and the manufacturer's trained technician performs the repairs. Only the manufacturer trained technician have access to the necessary parts for service. Furthermore, no other company is authorized to work on such equipment, as they do not have necessary, and specialized training nor access to the necessary parts CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by 3:30 PM EASTERN TIME February 12, 2014 and must reference number NHLBI-CSB-HL-2014-69-KBM.
