- Attachment 3 - Instructions to Offerors Commercila Items Attachment 2 - Contract Terms and Conditions Attachment 1 - Invoice Instructions THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION AND A SEPARATE SOLICITATION WILL NOT BE ISSUED. This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The Solicitation Number for this acquisition is NIH-CC-P-14-000085 and is being issued as a Request for Proposal (RFP). The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-7 effective January 30, 2014. This acquisition will be processed under FAR Part 12, Simplified Acquisition Procedures (SAP), Acquisition of Commercial Items, and is a total Small Business Set-Aside. The North American Industry Classification System (NAICS) Code for this procurement is 322211 and the Small Business Size Standard is 500 employees. BACKGROUND The National Institutes of Health (NIH) is the nation's foremost federally funded biomedical research institution. The Mark O. Hatfield Clinical Research Center (CRC) is the onsite hospital for the NIH campus. The Materials Management and Environment Services Department (MMESD) is responsible for the acquisition of supplies, inventory management, storage and distribution of materials for the hospital. In addition, the department ensures efficient housekeeping operations and compliance with appropriate infection prevention, safety, OSHA, Joint Commission and regulatory standards. This includes cleaning of the NIH Clinical Center patient rooms, offices, ancillary departments, outpatient areas, public areas (including cafeterias), laboratories in the CRC, and the Family Lodge, and the provision of laundry services STATEMENT OF OBJECTIVES To procure Medical Pathological Waste (MPW) boxes. STATEMENT OF WORK: 240 MPW boxes are to be delivered every week on Monday for 52 weeks for a total not to exceed 12,480 boxes a year. Each box is to contain two black plastic liners and twelve ties. MPW specifications are but not limited to the following specifications: BOX SPECIFICATION: A. Box markings, letters, numbers and symbols, shall be red/orange B. Ink shall be Sun Chemical Corp number GCMI 81 C. Boxes shall be specifically marked to the requirements of the federal specifications: 1. Shall provide arrows indicating "Burn Box Up" 2. The biohazard symbol and "Biohazard Incinerate Only" identification on all four sides of box. 3. All markings shall be red/orange, placed directly on the exterior surface of box 4. Markings will not be camouflaged manufacturer's name, address, product info., etc. D. Markings of packaging for transportation shall be in accordance with code of federal regulations (CFR) title 49, Transportation, Part 178.503 E. Size (inside dimensions) 18-1/2 x 18-1/2 x 14-1/4 F. Oyster White G. Bursting test of 250 lbs per square inch H. Minimum Edge Crush Test (ECT) value of 40 I. Minimum combined weight of facings, 111 pounds per thousand square feet J. Size limit of 85 inches K. Gross weight limit of 80 lbs (Box and contents) L. Shall be made flute corrugated cardboard M. Joint shall be tapped and glued inside only. N. Box shall have a modified "T" top with locking tabs on the flaps with folding instructions. O. Shall have a "crash" bottom P. Boxes shall be manufactured of a minimum of 30% recycled material Q. Shall be folded flat in package BOX PLASTIC LINERS: A. Box liner shall be polyethylene, low density, not less than.003 inches (.00762cm) thickness. Tolerance on thickness shall be minus 0 and + (plus) the standard of the industry. B. Shall be 19-1/2 inches (49.53cm) wide x 17-1/2 (44.45cm) deep x 44-1/2 inches (113.03cm) long, dimension shall be inside measurement + ½ inch (1.27cm) Type - flat, shall be one piece construction Style - sides shall be gusseted and the bottom shall be heat sealed. Material - Shall be Grade A Polyethylene, untreated C. Shall be one piece construction, and shall have a tuck on sides between face and back of bag. Tucks shall approximately p inches wide from crease to edge and crease shall be parallel to the sides. D. Bags shall be marked showing certification.(tear and impact resistence) E. Shall be plastic "electrical" cable ties, approximately 12 inches (30-48cm) long F. Shall be white G. Shall automatically lock at any diameter H. Shall be a minimum of 70 lb fasteners I. Shall be 12 cable ties per package The box and inner bags shall be tested and certified to meet CFR specifications. MPW boxes will be inspected upon arrival to NIH facility. Deliveries shall be coordinated through both parties to exercise convenience and building compliance. Please refer to the following attachments in preparing your proposal responding to this solicitation. Attachment No. 1: Invoice Instructions Attachment No. 2: FAR 52.212-5 Contract Terms and Conditions (Sept 2013) Attachment No. 3: FAR 52.212-1 Instructions to Offerors Commercial Items (Feb 2012) The Contractor shall comply with the following Federal Acquisition Regulation (FAR) clauses, which are incorporated in this contract in full text, to implement provisions of law or Executive orders applicable to acquisitions of commercial items. Contracting Officer's Representative The following Contracting Officer Representative (COR) will represent the Government for the purpose of this contract: To be determined at the time of award. The COR is responsible for: (1) monitoring the Contractor's technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements; (2) interpreting the statement of work and any other technical performance requirements; (3) performing technical evaluation as required; (4) performing technical inspections and acceptances required by this contract; and (5) assisting in the resolution of technical problems encountered during performance. The Contracting Officer is the only person with authority to act as agent of the Government under this contract. Only the Contracting Officer has authority to: (1) direct or negotiate any changes in the statement of work; (2) modify or extend the period of performance; (3) change the delivery schedule; (4) authorize reimbursement to the Contractor for any costs incurred during the performance of this contract; or (5) otherwise change any terms and conditions of this contract. The Government may unilaterally change its COR designation. Attachment No. 1: Invoice Instructions Technical Evaluation Criteria The technical evaluation committee when reviewing and scoring the technical proposals uses the following evaluation factors. Technical The Offeror shall demonstrate that they have the capability to deliver the required MPW boxes as stated in the Clinical Center's requirements (240 boxes weekly, required skid packaging, item specifications, and on an emergency basis). 35 points Cost The Offeror shall be rated by competitive pricing (competitive pricing to include lowest cost for items as well as no additional shipping charges, set up fees for lettering). 35 points Past Performance The Offeror shall provide a list of at least 3 references currently being serviced, including contact information. Scoring in this category will be dependent on the quality of services provided to other accounts of equal or greater size/complexity as the Clinical Center. 30 points TOTAL POINTS 100 Period of Performance Base Year 4/1/14 - 3/31/15 Option Year 1 4/1/15 - 3/31/16 Option Year 2 4/1/16 - 3/31/17 Option Year 3 4/1/17 - 3/31/18 Option Year 4 4/1/18 - 3/31/19   The following Provisions and Clauses apply to this RFP: 52.217-5 Evaluation of Options, (July 1990) Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s). 52.217-6 Option for Increased Quantity. (MAR 1989) Option for Increased Quantity The Government may increase the quantity of supplies called for in the Schedule at the unit price specified. The Contracting Officer may exercise the option by written notice to the Contractor within 60 days. Delivery of the added items shall continue at the same rate as the like items called for under the contract, unless the parties otherwise agree. FAR 52.217-8 Option to Extend Services (Nov 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days from the expiration of the current contract period of performance. 52.217 - 9 - Option to Extend the Term of the Contract, (mar 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within the current period of performance[; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
