- FBO ANNOUNCEMENT: PRESOLICITATION NOTICE SUBJECT: Service maintenance agreement for a JEOL JBX-6300 electron beam lithography system SOLICITATION NUMBER: NB620010-14-01416 RESPONSE DATE: March 13, 2014 CONTACT POINTS: Chris Ganey, Contract Specialist, 301-975-6205 Don Graham-, Contracting Officer, 301-975-8567 DESCRIPTION: The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with Jeol USA of Peabody, MA for the purchase of a JEOL JBX-6300 electron beam lithography system under other than full and open competition by the authority of FAR 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements: A sole source determination is based on the following: Only Jeol USA can meet our technical requirements. Specifically no other vendor can meet the NIST requirements for: Service maintenance agreement for a JEOL JBX-6300 electron beam lithography system JEOL USA has been the only service provider so they have a complete history of the equipment and a thorough understanding of our specific needs and requirements. This experience and expertise is important since the instrument is a very complex device with many components that must all work together seamlessly. In addition to the electronic components, JEOL is the manufacturer of all hardware and software and is the only source of proprietary components needed for any repair. Additionally, JEOL USA employs, trains, and certifies all field service technicians/engineers qualified to provide the required services. JEOL USA does not train, certify, or license other vendors to perform services on JEOL JBX systems. NIST is the current owner and Jeol is the original manufacturer of the equipment. There are no other re-sellers. The North American Industry Classification System (NAICS) code for this acquisition is 811219, and the size standard is $19.mil. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 12:00 p.m. (EST) on March 13, 2013. Inquiries will only be accepted via email to Christopher.ganey@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
