Reference Number: HC1028-12-D-0024-0160 Title of Effort: EBMS IOP Support JUSTIFICATION & APPROVALS FOR FAR SUBPART 16.5 ACQUISITIONS EXECEPTION TO FAIR OPPORTUNITY Multiple Award Schedule (MAS)/ Multiple Award Contract (MAC) Orders under MAC/ Fair Opportunity - FAR 16.505, DFARS 216.505-70, PGI 216.505-70 Purchase Request Number: Contract Number: Task/Delivery Order Number: Procurement Title: Contracting Office: Estimated Value: Authority: JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this exception to fair opportunity pursuant to the authority of FAR 16.505(b)(2)(i)(C). 1. REQUIRING AGENCY AND CONTRACTING OFFICE: a. Requiring Agency: DISA/JITC 2001 Brainard Road, Building 57305 Fort Huachuca, Arizona, 85670 b. Contracting Office: DISA/DITCO/PL8315 2300 East Drive, Building 3600 Scott Air Force Base, Illinois, 62225 2. NATURE/DESCRIPTION OF ACTION(S): a. The nature of this action is to modify the current cost-plus-fixed-fee (CPFF) task order (TO) against the Testing and Evaluation (T&E) Multiple Support Services (MSS) indefinite-delivery/indefinite-quantity (ID/IQ) contract, held by TASC, Inc, a large business. This modification will add 362 labor hours to the functional area analyst (Prin) and eight hours to the intelligence systems analyst, to support additional interoperability testing. b. The funded amount will increase by $6,649.66 from $56,796.64 to $63,446.30. The lifecycle cost will increase by $35,273.01 from $105,318.69 to $140,591.70, which is a 61% increase of the current lifecycle cost. Page 1 of 5 Pages Reference Number: HC1028-12-D-0024-0160 Title of Effort: EBMS IOP Support 3. DESCRIPTION OF SUPPLIES/SERVICES: a. The Defense Health Information Management System (DHIMS) provides information management and IT solutions that capture, manage and share healthcare data for the military's Electronic Health Record (EHR). The EHR is used by the military's medical community and supports the management of more than 9.6 million Military Health System (MHS) beneficiary records. DHIMS provides one of the largest and most comprehensive EHRs in the world and is committed to delivering clinical information technology (IT) solutions that enable continuity of care and timely administration of benefits to Service members and their families (http://dhims.health.mil). b. The contractor is required to data from the EHR and provide a Statement of Joint Interoperability Readiness. In doing so, the contractor will provide a formal Quick-Look Report as well as a formal Operational Evaluation Report input after conclusion of data analysis, to Army Medical Department. Additionally, the contractor shall provide summaries of test progress, document test results, and provide recommendations for enhancing the task operations during the test event. c. The period of performance end date remains unchanged at March 22, 2014 through March 21, 2015. 4. SUPPORTING RATIONALE, INCLUDING A DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF AN EXCEPTION TO FAIR OPPORTUNITY: (a) Exception to Fair Opportunity. IAW FAR 16.505(b)(2)(i)(C): The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical modification to an order already issued under the contract, and all awardees were given a fair opportunity to be considered for the original order. (b) Description of the Justification. EBMS IOP Support task order was awarded as a cost plus fixed fee task order to TASC on March 22, 2013 following a fair opportunity competition using the JITC T&E MSS IDIQ contracts. The awarded contract was modified on 22 August 2013, Modification 02 to include additional testing and travel requirements. Because the additional task falls in scope with the current EBMS IOP Support task, the logical modification is to an order already issued under the current contract. (c) Justification: (1) Minimum Government requirements. The Government requires highly specialized, multi-disciplinary knowledge and the need for staff to be available immediately to continue support operations. These support operations require the contractor's staff to have knowledge/understanding of EBMS IOP requirements. (2) Proposed sole source contractor. The incumbent contractor TASC, Inc. is the only contractor with that can perform the work given the least amount of cost to the government and meet the testing schedule timeframes. Page 2 of 5 Pages Reference Number: HC1028-12-D-0024-0160 Title of Effort: EBMS IOP Support (3) Discussion regarding cause of the sole source situation. This increase is required because program management office testing delay and re-test interfaces previously tested were completed with issues noted with Operational Test & Evaluation (OT&E), when fixes are delivered or implemented for operational use, and requirements documentation/reports, which are all required to be updated due to the issues that arose during testing. (4) Demonstration of unique source. TASC is the most qualified prime contractor capable of providing these services and has been providing with exceptional expertise. TASC is in place now supporting this task and is capable of continuing without interruption. No phase-in or ramp-up will be required to expand this support. Therefore, it is not in the best interest of the government to compete this task at the present time, contractor TASC is the only contractor that can perform the work with the funding and time constraints. (5) Procurement discussion. The original task order was competed among all seven T&E MSS contractors. Three offerors participated in this competition, of which TASC, Inc. was evaluated as the lowest-priced, technically acceptable offer. (6) Impact. If JITC were to compete this task, based on historical experience, it could delay the start of the task up to three months based on the timelines to issue a competitive task. Selecting another prime contractor would increase costs by approximately $10,000 - $30,000 due to the need to familiarize themselves with these services and in turn solicit quotes based on historical data. 5. COST/PRICE FAIR AND REASONABLE DETERMINATION: 6. MARKET RESEARCH: a. In accordance with FAR Part 10, market research has been conducted for this acquisition. JITC performed a formal analysis of the market through GSA Advantage, and historical contract costs. The action officer has determined through market research and market analysis that in the future, competition can be obtained for the above requirement using competition amongst T&E MSS contractors. However, the only way to avoid the loss of invested resources and additional costs to the government is to modify the existing task order to accomplish the requirement. b. This effort requires highly specialized, multi-disciplinary knowledge and the need for staff to be available immediately to continue support operations. These support operations require the contractor's staff to have DISN provisioning, Circuit Management Office, Mobile Satellite Systems, Teleport, Network System Administration, and Software development experience. The use of any other vendor other than the incumbent, BAE Systems Technology Page 3 of 5 Pages Reference Number: HC1028-12-D-0024-0160 Title of Effort: EBMS IOP Support Solutions and Services, would result in significant delays in filling positions and threaten the ability to provide an acceptable level of support. The current vendor has been performing the contracted duties at an acceptable level for 5 years. Staffing is already in place to continue this effort for the duration of the extension contract without any delay in service. This method represents the best value to the Government, in order to allow sufficient time for a competitive follow-on. 7. ANY OTHER SUPPORTING FACTS: 8. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS THAT LED TO THE EXCEPTION TO FAIR OPPORTUNITY: (a) Procurement History. Contract Number: HC1028-12-D-0024-0160 Contractor: TASC, Inc Contract Period: March 22, 2013 through March 21, 2014, with two 1-year option periods Total Contract Value: $87,355.36 Contract Type: CPFF Objective: IOP Support 9. REFERENCE TO THE APPROVED ACQUISITION PLAN (AP): Page 4 This requirement does not require a written acquisition plan, as one was completed at the base contract level. NA Rates have been established with the basic contract. All rates set forth in the contract, and used on individual task orders, were based on full and open competition and a price analysis was accomplished. Proposed task order rates and loadings will be compared with the basic contract rates and loadings and verified as fair and reasonable.
