- The Department of Veterans Affairs has established a sole source Basic Ordering Agreement (BOA) with Eldercare of Damascus for Adult Day Health Care services. The BOA was issued to ensure continuity of care to our Veterans and to avoid the possibility of a service stoppage which could have proved injurious to Veterans. In accordance with FAR 6.302-2 and 41 USC 253(c)(2), a BOA was issued for one year from date of award. This notice is not a request for proposals or information. Please direct any questions to Krista Shreet at krista.shreet@va.gov. 1.Contracting Activity: Department of Veterans Affairs, NCO 5, 849 International Dr., Ste. 450, Linthicum, MD 21090 2.Nature and/or Description of the Action Being Processed: In accordance with the VHA Standard Operating Procedure (SOP) for Other Than Full and Open Competition Procurements, the Washington DC VA Medical Center (DC VAMC) requests approval to extend incumbent contract to Eldercare of Damascus to provide Adult Day Health Care (ADHC) services to eligible Veterans, in the absence of which would require nursing home placement. ADHC services will be furnished to Veterans in the community for whom such care is specifically authorized by the DC VAMC. The government intends to negotiate a logical follow-on Basic Ordering Agreement (BOA) for the existing medical services currently being provided under Contract VA245-P-0147. 3.Description of Supplies/Services Required to Meet the Agency's Needs: This action is for a basic ordering agreement for a period of one year from date of award, estimated as 02/01/2014, in accordance with FAR 6.302-2, Unusual and Compelling Urgency and 41 U.S.C. 253(c)(2). Eldercare of Damascus, hereafter referred to as "Adult Day Health Care" will provide care to include: physician services, nursing, social work services, assistance with activities of daily living, activity therapy, case management, nutrition services including meals, and transportation. Striving to meet healthcare needs and promote maximum wellbeing, a break in continuity of care to our Veterans would prove detrimental and negatively impact the quality of life for this aged Veteran population who require critical assisted services and supportive environment. The follow-on Ordering Agreement will mirror the Adult Day Health Care Services Eldercare of Damascus is currently providing. The total estimated value of the acquisition is $7,560. 4.Statutory Authority Permitting Other than Full and Open Competition: FAR 6.302-2 and 41 U.S.C. 253(c)(2): Unusual and Compelling Urgency 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): As noted in paragraph 3, ADHC services are essential to the provision of planned programming designed to promote social and health related services to aging veterans in the service area who are no longer able to manage independently or who are isolated without an essential support network to facilitate needed care services. A break in the continuity of care to our veterans would prove detrimental and negatively impact the wellbeing of the aged veteran population who require assisted services and the benefit of a supportive environment that would serve both veterans and their caregivers. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Synopsis of this procurement action was not submitted to FedBizOpps due to the urgent need for these services, in accordance with FAR 5. 202(a)(2). The contracting office will provide the availability of the justification, in accordance with FAR 6.305(b). 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: DC VAMC has used data from the Maryland Department of Health and Mental Hygiene, Maryland Medical Assistance Program, Medical Day Care Transmittal No. 83, Dared June 6, 2013 to provide the Fiscal Year 2014 Medical Day Care per diem rates. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: This contractor is successfully providing services to Veterans, is knowledge of VA procedures and requirements, and has established a system for tracking and providing staff that works well at the requiring MTF. Long term veterans are acclimated to the adult day care staff and have adjusted to the facility's environment. At this critical phase, changing current staff and environment would be emotionally and mentally disruptive to their well-being as well as, to their families and caregivers. Furthermore, a change in contractors would affect associated costs, in terms of new acquisition package submissions, reviews, and inspections. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: All pertinent facts have been noted above. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Due to the urgency of the requirement, the intent of the requirement serves as a stop-gap measure to obviate the possibility of a service stoppage which will prove injurious to veterans. VISN 5 Contracting Office has been working collaboratively with VHA to prepare consolidated procedures to address overcoming future barriers to the procurement process of medical care provisions. In addition, achieving a more streamlines approach that shortens extended lead times on all Medical Sharing acquisitions- required for Medical Sharing Office (MSO) reviews- would ameliorate a procurement process currently causing long term contract awards longer PALT to create, negotiate, and award.
