Attachment 2: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 11, Indianapolis Medical Center New detector head and coefficient regeneration calibration required for Siemens Nuclear Gamma Camera. Order 583-14-2-179-0449. 2.Nature and/or Description of the Action Being Processed: P.O. being requested for repair, calibration and installation of new detector heads on Gamma Camera.. 3.Description of Supplies/Services Required to Meet the Agency's Needs: 1 new detector head to be purchased installed, the other to be recalibrated. Total cost is estimated to be $29,024.00 with a delivery date ten days after receipt of order. Provided by Siemens Healthcare Diagnostics, 115 Norwood Park South, Norwood, MA 02062-4633. 4.Statutory Authority Permitting Other than Full and Open Competition: (x ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Siemens is the only company able to provide a new detector head from the factory, for their system. Using any other third party will void any quality control, diagnostic quality. Siemens makes the crystals and photo multiplier tubes specifically for their systems, and no one else is able to make direct new replacements. In addition, Siemens is the only company that can install and calibrate new detectors with a coefficient regeneration calibration due to licensing to their service software. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Other sources were not solicited in that they are inadequate in the scope of work that needs to be done. Only the manufacturer can provide new, guaranteed parts, install, and calibration of device. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The price proposed by Siemens was determined to be fair and reasonable as the labor per hour ($374.00/hour) is identical to the labor per hour for other recent POs to Siemens (for example, PO 583C32614). A commercial price list has been included to show the parts comparison, and the government is charged significantly less than commercial customers for all parts. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: No market research done due to fact no one else can provide the proper services required. Siemens is the manufacturer of the detector heads and crystal. Siemens will not provide proper service key licensing to a third party to sell for this action. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: Siemens is only company in world that can legally provide a service key for installation and calibration of their Symbia Gamma Cameras. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: No way around obtaining products or service keys from a third party vendor. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
