- This publication serves as notice of intent to procure services for the Department of Commerce (DOC), National Oceanic & Atmospheric Administration (NOAA), National Weather Service (NWS) Pacific Region, Facilities Engineering Group, located in Honolulu, HI, on a sole source basis with Proton OnSite. The Government intends to acquire supplies indicated below using FAR Parts 13.5, Test Program for Certain Commercial Items. The National Weather Service Pacific Region in Honolulu, HI wishes to negotiate a sole source contract with Proton OnSite of Wallingford, CT for the items listed below: •Four (4) Proton Energy HOGEN S40 hydrogen generators •Four (4) Liquid Drain Traps •Four (4) DI Water System, RO & DI •Four (4) Calibration Kit, S Series 2 •Four (4) S-series Surge and Under/Over Voltage Module Kit •Four (4) Days Onsite Factory Training for Four (4) People, Wallingford, CT-USA The NWS requires a replacement hydrogen generation system to produce hydrogen from only water and electricity. The hydrogen generators must operate without any chemical additives for safety and operational reasons. Proton OnSite is the only manufacturer of hydrogen generators with Proton OnSites' patented PEM electrolysis process. Also, the fuel cell to accomplish this is proprietary to Proton OnSite. Utilizing the same type of equipment will provide consistency in support of agency-wide operations. Additionally, installing the same hydrogen generators at this location will simplify maintenance and service calls and reduce the learning curve for regional personnel operating this type of equipment. NWS will use procedures that provide for issuance of the order on the basis of other than full and open competition authorized by Federal Acquisition Regulations (FAR) in Subpart 6.302-1(a)(2)(ii)(B)( Unacceptable delays in fulfilling the agency's requirements) and Subpart 6.302-1(b)(2) (patent rights). The Government intends to negotiate a firm fixed price contract with the period of performance commencing no earlier than April 21, 2014. The NAICS code for this procurement is 325120 with a corresponding size standard of 1,000 employees. This notice represents the only official notice of this solicitation. This notice of intent is not a request for competitive proposals; however, all submittals received by the due date set forth in this notice will be considered by the Government. A determination by the Government not to compete this requirement based upon responses to this notice is solely within the discretion of the Government. It is the Government's belief that only Proton OnSite can supply this product. However, other potential sources with the expertise and required capabilities to provide these supplies can submit such data discussing the same in duplicate within 15 days from the date of this announcement. This data must include sufficient information to allow NOAA to evaluate the proposal relative to the above requirements. No cost or pricing data is required. This is not considered a Request for Quotation (RFQ) nor is it a Request for Proposal (RFP). No solicitation document is available and telephone requests will not be honored. No purchase order will be awarded on the basis of quotations or offers received in response to this notice. Any response to this notice must show clear, compelling, and convincing evidence that competition will be advantageous to the Government. If no affirmative written response is received, the contract will be awarded without further notice.
