Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. Solicitation No. A14PS00357 herein cited will be procured under FAR Part 12, Acquisition of Commercial Items. Solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-72. This acquisition is for a Native American Owned Business and Small Business Set-Aside under the Buy Indian Act (25 U.S.C). The NAICS Code is 541620, Size standards $14.0. DESCRIPTION: Contractor shall provide all labor, materials, supervision, incidentals necessary to provide Hazard Communication Plan development of new plans to meet the recent changes in OSHA 29 CFR 1910.120. Period of Performance from date of award to 90 days. Scope of Work: Bureau of Indian Affairs and Bureau of Indian Education HAZARD COMMUNICATIONS PLAN DEVELOPMENT OF NEW PLANS TO MEET THE RECENT CHANGES IN OSHA 200CFR 1910.120 BACKGROUND: The Bureau of Indian Affairs and the Bureau of Indian Education operate or oversee operations at five (5) agency offices, 37 satellite work centers, six (6) BIE Education Administrative Offices and sixty-six schools located though out the Navajo Indian Reservation and adjacent communities. Daily operations and maintenance activities, resource management field work and maintenance of road, dams and farm development require the use of both regulated an over the counter chemicals by employees in the conduct of their work. The recent changes in the Occupational Health and Safety Act (OSHA) of the Hazard Communication Program (HazCom) (29 CFR 1910.1200) require changes be documented in a plan to address the new amendments to the regulations to be implemented on December 1, 2013. BIA implemented the BIA HazCom Program (Plan) in 2005. Since that year no updates to the BIA Hazcom Plan have been made. Organizational changes have also occurred as the BIA education program activities were separated and functions assigned to the newly created Bureau of Indian Education (BIE). SCOPE: The BIA and BIE require the services of an environmental contractor to review any existing HazCom Plans for updates to the plans to meet the new revisions to Hazard Communication Regulations. Individual plans were developed to meet the needs of each of the approximately 111 BIA and BIE locations. The plans shall address and include program requirements necessary to meet the major changes to the regulatory requirements of 1) Hazard classification, 2) labels and 3) Safety Data Sheets. The plan shall be designed to provide information to employees at the agencies, work centers, towers and schools. WORK: The contractor shall develop individual plans to meet specific operations for the listed BIA and BIE programs located throughout the Navajo Indian Reservation. The Navajo Area encompasses and area approximately 25,000 square miles and has five (5) off-reservation dormitories and two satellite reservations, Alamo and Tohajiilee, New Mexico. The Hazard Communication Plans shall be designed in a manner as to inform each location where chemicals are used how to safely use the chemicals in a manner in compliance with the 29 CFR 1910.1200 regulations. The Bureau of Indian Affairs (BIA) Navajo Region has both administrative offices, program offices and five (5) Agency Offices with yards. Each of these programs have chemical inventories of all chemicals use for program operations. Regional Administrative offices are Property Management, Finance, Budget, Acquisitions, Facility Management, Human Resources, Information Technology, Self Determination, Real Estate Services, Division of Environmental, Cultural and Safety Management, and Law Enforcement. These programs generally do not have chemical inventories at the Regional Office except for office chemicals such as toners, correction fluids and other related office machine chemicals. Chemcial Usage: The Divisions of Water Resources/Safety of Dams, Forestry/Fire Management, Transportation and Natural Resources may have chemicals associated with field operations but are stored off site or at the agency field offices. -BIA Division of Transportation (DOT) has offices at the Region, five (5) Agencies located at Chinle, Fort Defiance, Tuba City, Arizona and Shiprock, and Crownpoint, New Mexico. DOT also has eleven (11) maintenance yards, located in Chinle, Fort Defiance, Ganado, Dilcon, New Lands, Tuba City, Kaibeto, Pinon, Arizona, and; Crownpoint, Shiprock, Farmington-CHEU, New Mexico. -BIA Division of Forestry; Program Office for Fire Management and Forestry Yard, Fort Defiance, Arizona and 7 fire towers Roof Butte, Washington Pass, Tohatchi, Black Pinnacle, Piney Hill, Oak Ridge, -BIA Navajo Indian Irrigation Project Program Office and Field Operations (Farmington, New Mexico). -Division of Facility Management Yard and Radio Shop, Gallup, New Mexico The Bureau of Indian Education (BIE) has six (6) agencies and 61 schools and five (6) dormitories which use chemicals for operation and maintenance at school/dormitories, kitchen and office cleaning and school classroom chemical education use. Task 1 Pre Submittals 1. Health and Safety Plan to address field investigations as required by 29 CFR 1910.120. 2. Professional credentials for signature and certifications (Must be a Professional Engineer or Professional Environmental Scientist licensed in the states of Arizona, New Mexico or Utah). 3. Work Plan with Schedule. Task 2 Work 1. The contractor shall contact Program managers to schedule interviews with program to collect data for inclusion into the Hazard Communication Plan. 2. The contractor shall conduct site inspections as necessary for interviews and data collection for the inclusion into the Revised Hazard Communication Plan. This includes collection of chemical inventories and MSDS. 3. The contractor shall prepare the outline for addressing the requirements of the amendments to the Hazard Communication Program (Plan) for submittal to BIA for review and approval. A. One plan each shall be prepared for DOT, Natural Resources, NIIP, and Forestry programs along with the associated yards shall be prepared. B. One plan shall be prepared for the Administrative Offices to address the requirements for HazCom. C. One plan shall be prepared for the BIE program offices and schools. 4. The contractor shall prepare a PowerPoint presentation for the Division of Environmental, Cultural and Safety Management to present to the field program to educate the users on how the plan should be implemented. This PowerPoint presentation and Hazard Communication Program (Plan) shall be the property of the BIA and no copyrights shall be applied by the successful contractor. All data collected by the contractor used to prepare the HazCom Plan shall be returned to the BIA upon completion of the contract. 3. The contractor shall prepare final HazCom Plan as approved. Plan shall be submitted in draft format on or before at 90 days from notice to proceed to the BIA/BIE shall review the final plans by within 15 days of receipt and provide comments to the contractor for finalization. 4. The contractor shall finalize Hazard Communication Plan by 120 days from notice to proceed and distribute to BIA/BIE via certified or tracked mail (FedEX, USPS, etc.). Return all information collected from BIA/BIE to DECSM following final invoice. Task 3 Reports 1. The contractor shall prepare 10 sets of the final reports, five read only CDs in Microsoft Word of the plan and one set writable CDs in Microsoft Word. All copies shall be mailed to BIA DECSM, Post Office Box 1060, Gallup, NM 87305 2. The contractor shall provide one set PowerPoint presentation and mail it to BIA DECSM, Post Office Box 1060, Gallup, NM 87305. 3. Upon receipt of the information plus final reports, final payment shall be made.
