Description
This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-66 effective April 1, 2013. This acquisition will be processed under FAR Part 12, Simplified Acquisition Procedures (SAP), Acquisition of Commercial Items, and is a total Small Business Set-Aside. The Solicitation Number for this acquisition is HHSNCcOPC-CS-14007521 and is being issued as a Request for Proposal (RFQ). The NAICS Code for this solicitation is 811219 and the Small Business Size Standard is $19.0 mil. BACKGROUND: The Department of Radiology and Imaging Sciences provides imaging services to the National Institutes of Health Clinical Center's patients who participate in research protocols conducted by the various NIH Institutes. Imaging services essential to patient care include the Carestream DRX Digital X-ray System. PURPOSE/JUSTIFICATION A Service Agreement is required to ensure continuous operation and minimal down-time for repairs/ preventative maintenance of the 5 Carestream DRX Digital X-Ray Systems listed below. Failure to obtain this service agreement risks costly repairs to the equipment and unacceptable delays in providing critical patient imaging services. CONTRACT REQUIREMENTS The following 5 Carestream Digital X-Ray Systems: • DRX Dual Siemens Room Retrofit (S/N 46120663) including 2 Digital Detectors • DRX Mobile Retrofit (S/N 46119565) including 1 Digital Detector • DRX Mobile Retrofit (S/N 46124957) including 1 Digital Detector • DRX Dual Siemens Room Retrofit (S/N 46124788) including 2 Digital Detectors • DRX Mobile Retrofit (S/N 46125862) including 1 Digital Detector are to be covered including the following requirements. 1) The following services shall be provided as needed: a. Provide onsite emergency repair services including labor and replacement of malfunctioning parts between the hours of 8:00 a.m. and 5:00 p.m. Monday through Friday (except for holidays); b. Perform one Preventative Maintenance (PM) service per contract period during the coverage times noted above; d. Provide telephone technical support with an average response time of one hour during the covered hours; e. Provide a guaranteed response time of within four hours for on-site emergency repairs; 2) All labor (time) and all materials are to be included with the exception of supplies and consumables. 3) Covered components must include, but not limited to: 9 wireless digital DRX detectors, battery chargers, DRX-1 system capture console, software, exposure hand switches, wireless access ports, DICOM worklists, barcode readers, flat panel touch screen monitors, management systems, interface box, and system consoles. 4) Include drop rider protection against accidental dropping of detectors with a detector replacement deductible cost of $5,000 per incident. 5) Include liquid damage protections against accidental liquid damage of detectors with a detector replacement cost of $10,000 per incident. GOVERNMENT RESPONSIBILITIES Provide a safe work environment and access for the service/preventative maintenance on the equipment. REPORTING REQUIREMENTS AND DELIVERABLES Contractor shall provide a field service report describing diagnosed problems and solutions upon completion of the work. PROGRAM MANAGEMENT AND CONTROL REQUIREMENTS N/A INSPECTION AND ACCEPTANCE REQUIREMENTS Verification of the repair will be performed on the equipment by the Senior Medical Physicist (or his designee) upon completion of the repair. Technical Approach (25) The Government will evaluate the offeror's technical approach to satisfy the following solicitation requirements. A. Remedial Maintenance duties. B. Past Performance (25) The offeror must provide three references from previous customers where the offeror provided maintenance support with similar specifications and complexity to the Carestream DRX Evolution Digital X-Ray System. 4. PRICE(25) The price quoted will be evaluated for price reasonableness. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law. FAR 52.217-8 Option to Extend Services (Nov 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days from the expiration of the current contract period of performance. (End of clause) FAR 52.217-9 Option to Extend the Term of the Contract (MAR 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within the current period of the contract; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 60 months. (End of clause) Contracting Officer's Representative The following Contracting Officer Representative (COR) will represent the Government for the purpose of this contract: To be determined at the time of award. The COR is responsible for: (1) monitoring the Contractor's technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements; (2) interpreting the statement of work and any other technical performance requirements; (3) performing technical evaluation as required; (4) performing technical inspections and acceptances required by this contract; and (5) assisting in the resolution of technical problems encountered during performance. The Contracting Officer is the only person with authority to act as agent of the Government under this contract. Only the Contracting Officer has authority to: (1) direct or negotiate any changes in the statement of work; (2) modify or extend the period of performance; (3) change the delivery schedule; (4) authorize reimbursement to the Contractor for any costs incurred during the performance of this contract; or (5) otherwise change any terms and conditions of this contract. The Government may unilaterally change it's COR designation. Post Award evaluation of Contractor Performance a) Contractor Performance Evaluations Interim and final evaluations of Contractor performance will be prepared on this contract in accordance with FAR 42.15. The final performance evaluation will be prepared at the time of completion of work. In addition to the final evaluation, interim evaluation(s) shall be submitted at the time of the annual evaluation. Interim and final evaluations will be provided to the Contractor as soon as practicable after completion of the evaluation. The Contractor will be permitted thirty days to review the document and to submit additional information or a rebutting statement. If agreement cannot be reached between the parties, the matter will be referred to an individual one level above the Contracting Officer, whose decision will be final. Copies of the evaluations Contractor responses and review comments, if any, will be retained as part of the contract file, and may be used to support future award decisions. b) Electronic Access to Contractor Performance evaluations Contractors that have internet capability may access evaluations through a secure Web site for review and comment by completing the registration form that can be obtained at the following address: hhtp://oamp.od.nih./OD/CPS/cps.asp. The registration process requires the Contractor to identify an individual that will serve as a primary point of contact and who will be authorized access to the evaluations for review and comment. In addition, the Contractor will be required to identify an alternate contact that will be responsible for notifying the cognizant contracting official in the event the primary contact is unavailable to process the evaluation within the required 30-day time frame.
