- Description(s) THIS IS A NOTICE OF INTENT, NOT A REQUEST FOR A PROPOSAL. A SOLICITATION DOCUMENT WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. The National Institutes of Health (NIH), National Heart, Lung, and Blood Institute (NHLBI) Office of Acquisitions (OA), and behalf of the National Institute of Dental and Craniofacial Research (NIDCR), intends to negotiate and award a purchase order on a noncompetitive, sole source basis to BD Biosciences, 2350 Qume Drive, San Jose, CA 95131 to provide instillation of upgraded laser parts, at theNIDCR. The National Institutes of Health (NIH) is the nation's leading medical research agency and the primary Federal agency conducting and supporting medical discoveries that improve people's health and save lives. The National Institute of Dental and Craniofacial Research, Combined Technical Research Core's (CTRC) Flow Cytometry section provides state-of-the-art multi-disciplinary biotechnology instrumentation and methodologies crucial for modern biomedical research to all scientists at NIDCR. The required products and services are: Product Number: 646903, Description: Kit 3 and 4 LSR 561nm FC Upgrade Aria II, Quantity: 1 Product Number: 650746, Description: Kit 561nm LSR PMT Upgrade FACS Aria III, Quantity: 1 Product Number: 65674400382906567444, Description: Filter Combo Pack Brilliant Violet BP, Quantity: 2 Product Number: 65675000382906567505, Description: Mirror Dichroic Pack Bril Violet, Quantity: 2 Product Number: 650278, Description: LSR Fortessa Special Order Laser Option, Quantity: 1 Services provided include shipping and instillation of the products. Sole Source Justification: The sole source justification is based on the fact that NIDCR currently owns and operates the FACS Aria II & III and Fortessa Laser, BD Biosciences is the manufacturer of the formentioned Lasers and therefore the only vendor capable of performing maintenance and upgrades for the equipment. NIDCR has previously Sole Sourced to BD Biosciences to provide maintenance and upgrades. The upgrades are integrated into each instrument and will become part of the Cytometers and as such are not available through any other company or manufacturer. BD Biosciences currently provides the preventive maintenance on these instruments which are not available through any other source and they do not use a distributer and instead work directly with the end user. If NIDCR were to go with another vendor they would have to replace the current lasers as any 3rd party work performed would void the warranties and disrupt the experiments currently performed, which is not in the best interest of the Government. The delivery date will be 100 days after the vendor receipt of the Purchase Order. The delivery point is The National Institutes of Health (NIH), National Institute of Dental and Craniofacial Research (NIDCR), Bethesda, MD. The North American Industry Classification system (NAICS) Code is 334516, size standard $500 Employees, Analytical Laboratory Instrument Manufacturing. The acquisition is being conducted under FAR part 13, Simplified Acquisition Procedures, therefore the requirements of FAR part 6, Competitive Requirements, are not applicable and the resultant purchase order will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-72 (January 2014). Interested parties may identify their interest and capabilities in response to this synopsis by May 12th, 2014 at 9:00am Eastern Standard Time. The determination by the Government not to compete the proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered only for the purpose of determining whether to conduct future competitive procurements.
