Description
This contract action was accomplished using other than competitive procedures because it is necessary to acquire the services of an expert or neutral person for a current or anticipated litigation (FAR6.302-3). See posted J&A for further information. JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION To be completed by the Requiring Office, Office Symbol: CESWF-CT 1. Contracting Agency -U.S. Department of Army US ARMY Corps of Engineers Fort Worth District Contracting Division Fort Worth, Texas 76102 2.Describe the supplies or services required (including the estimated value). This request for services is based upon the need to hire Mr. William A. Manginelli of the firm Trauner Consulting as a scheduling and claims expert witness for the Government to prepare report and testify on the behalf of the Government before the Armed Service Board of Contract Appeals or Federal Circuit Court to the validity of claim entitled quote mark Masonry quote mark submitted by Balfour Beatty/S&P, under Contract W9126G-09-C-0054, Lackland Air Force Base, San Antonio, Texas. Mr. William Manginelli shall submit a written report of his findings per the major milestone listed under Deliverables, paragraph 2 of Scope of Work dated 28 January 28, 2014. In addition Mr. Manginelli shall also be available to testify on behalf of the Government as an expert witness in the field of scheduling and claims. Mr. Manginelli has appeared numerous times before the Armed Service Board of Contract Appeals. It is in the Government's best interest to employ Mr. Manginelli of the firm of Trauner Consulting as a scheduling and claims expert. Mr. William A. Manginelli address is as follows: Mr. William A. Manginelli, President % Trauner Consulting Services, Inc. 1617 JFK Blvd Philadelphia, Pittsburg 19103 The estimated value of services for the base bid is $282,350.00. The estimated cost of base bid plus options total $377,030. 3.State the qualifications of the proposed contractor to meet the requirements. Bill has extensive experience in project management, scheduling, construction change analysis, and surety completion on many types of projects including institutional, industrial, commercial, hi-rise, power and water, transportation, and marine construction. His expertise lies in the areas of construction management and the analysis of construction impacts, including delays, inefficiency, acceleration, and damages. Bill has provided expert witness testimony before United States District Courts, The United States Court of Federal Claims, The Armed Services Board of Contract Appeals, various State Courts and Boards, the American Arbitration Association, and in other forms of dispute resolution. He has extensive experience in the preparation of expert reports and written testimony, and in preparing and responding to interrogatories, discovery requests, questions for depositions and cross-examination, and in the design and preparation of demonstrative exhibits for trial. Bill has written several training manuals and has lectured nationally on the topics of construction project management, critical path method (CPM) scheduling, construction contracts, delays and delay damages, and productivity and inefficiency. He has been a featured speaker for numerous national associations and state Departments of Transportation. 4.Describe the market research conducted and the results or a statement of the reason market research was not conducted. The firm Trauner Consulting was chosen by the Government due to the fact that full and open competition need not be provided when acquiring the services of an expert for any current or anticipated litigation or dispute, (FAR 6.302-3(a)(2)(iii). Mr. William A. Manginelli is deemed an expert witness involving claims of scheduling and as an expert witness has testified before the Armed Service Board of Contract Appeal (ASBCA) in this capacity. 5.List facts supporting the use of other than full and open competition. Mr. William A. Manginelli of Trauner Consulting is listed as having trial experiences on Government contracts along as being recognized an expert on construction scheduling claims assisted in his selection for other than full and open competition. This description of experience is what the Government will need to be successful in defending against the contractor's claim. Furthermore, The firm Trauner Consulting was chosen by the Government due to the fact that full and open competition need not be provided when acquiring the services of an expert for any current or anticipated litigation or dispute, (FAR 6.302-3(a)(2)(iii). 6. A listing of other sources, if any, which expressed, in writing, an interest in the acquisition. -- None -- 7. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required, if necessary. Mr. Manginelli of Trauner Consulting is highly qualified and a recognized expert witness to testify on the behalf of the Government on scheduling claim. This recognition and valuable experience will shorten the time necessary to prepare report for trial. To be completed by the Contracting Officer, Contracting Office Symbol: CESWF-CT. 8. APPROVAL STATEMENT: The anticipated cost to the Government is fair and reasonable. The justification is accurate and complete to the best of my knowledge and belief. Based on the foregoing justification, I hereby approve this acquisition to proceed under Other than Full and Open Competition procedures subject to the availability of funds, and provided that the services and property herein described have otherwise been authorized for acquisition.
