- Sole Source Justification & Approval This is a "Notice of Intent" to "Sole Source" a contract, reference Defense Media Activity (DMA) solicitation/posting number "HQ003040900001", for commercial items (Performing Rights/Royalties) posted in accordance with the Office of Federal Procurement Policy Memorandum dated 17 APR 2006, and as supplemented with additional information included in this notice. This government requirement, if solicited, would be advertised as an "Unrestricted" procurement with provisions and clauses in effect through Federal Acquisition Circular 2005-72 dated 30 Jan 2014. Contractors must be registered with the System for Award Management (SAM) database (https://www.sam.gov) at time award is issued and throughout performance unless an exemption exists (i.e. foreign contractor/entity). The Government intends to award a "Sole Source" contract to Gesellschaft fur musikalische Affuhrungs und merchanische Vervielfaltigungsrechte (GEMA) for the acquisition by the United States of America, American Forces Network - Broadcast Center (AFN-BC) of a license and royalty rights for the Copyrighted musical works of the composers and musical publishers represented by GEMA, hereinafter referred to as the "Contractor" and for which the Government is not otherwise licensed. License Period: Base Year + four (4) Option Years: July 1, 2014 through June 30, 2019. This "Notice of Intent" is not a request for competitive offers/quotes/proposals. A determination by the Government to compete this solicitation will be based upon responses to this notice at the sole discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Responses must be submitted within the closing date of this notice for consideration: TO BE RECEIVED NO LATER THAN 2:00 PM PACIFIC TIME MAY 14, 2014 IN ORDER TO BE CONSIDERED.
