Attachment for Amendment 0003, did not go through system, so please see below: 52.212-2 EvaluationCommercial Items. As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows: EVALUATIONCOMMERCIAL ITEMS (JAN 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Factor 1, Factor 2, Factor 3 [Contracting Officer shall insert the significant evaluation factors, such as (i) technical capability of the item offered to meet the Government requirement; (ii) price; (iii) past performance (see FAR 15.304); (iv) small disadvantaged business participation; and include them in the relative order of importance of the evaluation factors, such as in descending order of importance.] Technical and past performance, when combined, are Equal (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offers specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of provision) Section 15.101-2: Lowest Price Technically Acceptable Source Selection Process. (a) The lowest price technically acceptable source selection process is appropriate when best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. (b) When using the lowest price technically acceptable process, the following apply: (1) The evaluation factors and significant subfactors that establish the requirements of acceptability shall be set forth in the solicitation. Solicitations shall specify that award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. If the contracting officer documents the file pursuant to 15.304(c)(3)(iii), past performance need not be an evaluation factor in lowest price technically acceptable source selections. If the contracting officer elects to consider past performance as an evaluation factor, it shall be evaluated in accordance with 15.305. However, the comparative assessment in 15.305(a)(2)(i) does not apply. If the contracting officer determines that a small business past performance is not acceptable, the matter shall be referred to the Small Business Administration for a Certificate of Competency determination, in accordance with the procedures contained in subpart 19.6 and 15 U.S.C. 637(b)(7)). (2) Tradeoffs are not permitted. (3) Proposals are evaluated for acceptability but not ranked using the non-cost/price factors. (4) Exchanges may occur (see 15.306). HAZARD COMMUNICATION PLAN PREPARATION, IMPLEMENTATION AND INSTRUCTION MATERIALS (29 CFR 1910.1200) Evaluation Factors: Factor 1: The Technical Capability shall be in as much detail as the offeror considers necessary to fully explain the proposed technical approach. The technical proposal should reflect a clear understanding of the nature of the work to be performed. The proposal shall assess the offeror's understanding of the Bureau of Indian Affairs and Bureau of Indian Education goals for the project and an understanding of the Statement of Work (SOW). The proposal should include, but not limited to the following: a) Knowledge and understanding of the requirements outlined in the SOW. b) Understanding of general and local condition which can affect the SOW. c) Logical sequence of steps and or specific techniques to accomplish all required work specified in the SOW. d) Capability to produce deliverables in response to the SOW Factor 2 - Qualification: The contractor shall have demonstrated expertise in preparation a HazCom Plans (29 CFR 1910.1200) for Bureau of Indian Affairs, for Bureau of Indian Education and with working in Native American communities. Knowledge of Navajo Indian Reservation and organizational structure of the Navajo Region BIA/BIE. Knowledge of Applicable and Regulatory Requirements for conducting work on the reservation of Navajo Employment Preference Laws and Navajo OSHA. Factor 2 Past Performance, Demonstrated technical capability for services of a professional environmental contractor to prepare, design and instruct users of how to use and implement the HazCom Plan for each 117 locations for the 2013 29 CFR 1910.1200 regulatory changes. Score each LPTA factor as to whether it is Acceptable or Unacceptable as defined below. Each proposal will be evaluated against the SOW and the stated evaluation criteria. Each proposal is evaluated using the same standards. Make a determination as to acceptability or unacceptability on each category for each proposal received. Non-price factors may be added or deleted as necessary. NOTE: Even if one of the evaluators views the offerors approach on one evaluation factor as unacceptable, the OVERALL determination for that factor may still be acceptable. However, if any evaluation factor receives an unacceptable in the overall rating, the entire proposal then becomes unacceptable. Lowest Price, Technically Acceptable Evaluation Standards Determination Acceptable = ALL of the minimum acceptable criteria are clearly met by the proposal. The offerors proposal meets the performance and technical capability requirements defined in the SOW. NOTE: Once the proposals have been determined to be technically acceptable, award will based on cost only. Unacceptable = Not all of the minimum acceptable criteria are met by the proposal. An unacceptable proposal contains one or more deficiencies. Proposal fails to meet specified minimum performance and technical capability requirements defined in the SOW.
