Attachment 2: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: : Department of Veterans Affairs, VISN 08,VACHS Medical Center, Facility Management Service At San Juan P.R. Justification for Other Than Full and Open Competition 672-. 14-3-510-0433 2.Nature and/or Description of the Action Being Processed: This is a request for other than full and open competition for the procurement parts and equipment. (Mixing Valve for B-9 Mechanical Room). The action will be awarded as a new firm-fixed price purchase order. 3.Description of Supplies/Services Required to M eet the Agency's Needs: The contractor will provide one (1) mixing valve Lawler Type S Regulator, Model 006261508-S 2 ½ 06 100-140 1 1/8x36CU 8ft. This mixing valve is for the distribution system at 8-9 Mechanical Room in order to decrease temperature to130 F degrees, as required by regulation, to then deliver hot water to patient's rooms' outlets at temperatures of 118F degrees to 125F degrees at VA San Juan. 4.Statutory Authority Permitting Other than Full and Open Competition:FAR 6.302-2 (b)(2) Unusual and compelling urgency. ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (x) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization,Engineering,Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Uni que Qualifications or Nature of the Acaulsltion Requires the Use of the Authority Cited Above (applicability of authority): The objective of this acquisition is to acquire new mixing valve for hot water control at the 8-9 Mechanical Room. The LTCI Survey performed on April 8-10,2014 found many rooms with temperatures out of adequate range which can cause injury to CLC patients. The only way to get these outlets temperatures within the range is installing mixing valve in the main distribution system located at the 8-9 Mechanical Room.If we do not perform this correction the CLC certification to operate is at risk. Due to the emergency situation we contacted Universal Equipment Sales and Services Corp. which can supply required mixing valves. They have provided, under other contracts, heating equipment parts such as the required for other services. They were contacted and provided an estimate cost of $6,170.00. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Limited market research was done and was found that Universal Equipment Sales and Services Corp. is the company who can support the equipment required to control Hot Water temperatures at the distribution system at the B-9 Mechanical Room. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Estimate cost $6,170.00. Price is considered fair and reasonable due to the due to the circumstances and dire need for this equipment. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: limited market research was done and was found that Universal Equipment Sales and Services Corp. is the company who can support the parts required to control Hot Water temperatures at the B-9 Mechanical Room distribution system. 9.Any other Facts Supportin g the Use of Other than Full and Open Competition: Verbal communication with other local distributors were performed (Solares, Mocorola y Castellanos) but they do not distribute the valve we require for our existing water distribution system. 10.li sting of Sources that Expressed, I n Writing,an I nterest i n the Acquisition see Section VI above 11.A Statement of the Actions,i f any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acqui sitions for the supptles or services requi red: Facility working in a preventive maintenance contract to increase efficiency and equipment durability. 12.Requirements Certification: I Certify that the requirement outlined in this justification on is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
