Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, Network Contracting Office NCO 20, 8115 NE 82nd. Ave. Vancouver, WA. Purchasing for the VA Puget Sound Health Care System, Seattle, WA. 2.Nature of the Action Being Processed: The Department of Veteran Affairs proposes to enter into a contract on the basis of other than full and open competition for a base plus four year software maintenance and support service agreement for the Elekta MosaiQ Server and Elekta MosaiQ radiation oncology software. The contract contemplated will be firm fixed price to Elekta, Inc. This agreement is for the Seattle VA. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The procurement under PR# 663-14-1-213-0028, is for a base plus four option year software maintenance and support service agreement for the MosaiQ server IMPAC MosaiQ radiation oncology software system. This system is a data planning and analysis system for the treatment of radiation cancer and bone marrow transplant patients. This support is critical to the function of the radiation oncology department in providing treatment for our Veterans. The contractor has qualified service engineers for technical support and is the only vendor authorized to maintain the server and provide software support, updates, and licenses, being that they are the manufacturer. 4.Statutory Authority Permitting Other than Full and Open Competition: Statutory Authority: 41 U.S.C. 253(c), or 38 U.S.C. 8153 as implemented by FAR 6.302. ( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The contractor, Elekta, Inc., is the manufacturer of the IMPAC MosaiQ system, and the licenses for the system are owned solely by the Elekta, Inc. Elekta has the proper resources to service, maintain, and provide software updates for all aspects of the MosaiQ System. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Past procurements have shown this to be a sole source. Furthermore, extensive market research has been performed which has revealed no additional sources capable of providing this service. This is a proprietary service to the manufacturer, Elekta. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The Contract Specialist determines that the anticipated price is fair and reasonable based on comparison with past purchase 663-C11673 in which the same service was purchased for one year for XXXXXX from 10/1/2010-9/30/2011. 663-C11673 has already been determined fair and reasonable noting a 15% discount off of list price at the time of XXXXXX. The base year for this new procurement costs XXXXXX showing a 21.9% increase from 2010 which is roughly a 5.47% increase a year. The 5.47% increase a year is in line with standard inflation rates and market changes, making this new purchase fair and reasonable and in the best interest of the Government. Furthermore, it is in the best interest of the Government to purchase a maintenance agreement for the software and hardware that the VA already owns instead of procuring a whole new radiation oncology server and software. By signing the justification the Contracting Officer makes a determination that the costs/prices to the government are expected to be fair and reasonable. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: FAR Part 10 directs that market research be conducted on each acquisition appropriate to the circumstances. Market research was conducted for this procurement and mandatory sources were queried in order of priority (see briefcase). Market research revealed that Elekta, Inc. is proprietary to their own software licenses, and that no other vendor can meet this requirement because of exclusive licensing agreements. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: In addition to the information stated above, past performance of this requirement has shown this to be a sole source. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: No additional sources expressed interest in this acquisition. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: None.
