Description
DEPARTMENT OF THE NAVY NAVAL MEDICAL LOGISTICS COMMAND LIMITED SOURCE JUSTIFICATION 1. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY: This is a Limited Source Justification. The Naval Medical Logistics Command, acting on behalf of Naval Hospital Camp Lejeune, intends to award a delivery order against Federal Supply Schedule contract V797P-3073M pursuant to the authority of the Multiple Award Schedule Program. 2. NATURE/DESCRIPTION OF CONTRACT ACTION: This is a limited source action for dental cabinetry, casework, and accessories provided by A-Dec, 2601 Crestview Drive, Newberg, OR 97132. The Government intends on awarding a Firm Fixed Price delivery order. 3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES: The Naval Hospital Camp Lejeune requires cabinetry, dental casework, and accessories to outfit ten (10) newly constructed dental operatories. The items shall all be compatible with the existing A-Dec dental chairs and instrumentation. The casework shall include fourteen (14) countertops with sinks and shelving. The casework shall also include nine (9) cabinets each with wall mounts and three shelves. Eighteen (18) dispensing units that are capable of dispensing at a minimum cups, towels, masks, gloves, and tissues shall be included. The accessories shall include three (3) dental delivery systems that allow for integration of cameras and at least two (2) electric handpieces. Five (5) dental delivery systems for assistant's instrumentation shall be included with quick-disconnects for air and water, 4-position holders, and tray holders. The casework shall include five (5) consoles with cabinetry and shelving, outfitted with central processing unit vents and monitor mount tracks to hold workstations. The cabinetry, casework, and accessories shall be compatible with the dental delivery systems to be installed in the new dental clinic. Vendor shall be an Original Equipment Manufacturer (OEM) authorized dealer, authorized distributor or authorized reseller for the proposed equipment/system such that OEM warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions. Upon delivery, the vendor shall be responsible for uncrating the unit/system and transporting it through the facility to the location of intended use for installation, and removing of all trash created in this process. If interim storage is required, the vendor shall make arrangements for the storage. 4. IDENTIFICATION OF THE JUSTIFICATION RATIONALE AND/OR DEMONSTRATION OF CONTRACTOR'S UNIQUE QUALIFICATIONS: The statutory authority which permits restricting consideration of schedule contractors to fewer than that required in 8.405-2 is 41 U.S.C. 251, as implemented by FAR 8.405-(6)(b)(1) Only one source is capable of responding. A-Dec is the only vendor capable of providing casework/equipment that is compatible with the dental delivery systems and instrumentation workstations being procured for the newly constructed dental operatories at NH Camp Lejeune. The Navy recently awarded a five year indefinite delivery/indefinite quantity (IDIQ) with A-Dec for dental delivery systems after a competitive source selection process. NH Camp Lejeune is outfitting their new dental operatories with equipment and casework. The dental delivery systems and dental chairs are being procured from A-Dec via the IDIQ contract. Consistent configuration of delivery systems and interchangeable handpieces are needed to ensure uniform workflow throughout the operatories. The new equipment will be uniform with the installed base of 142 A-Dec dental delivery units that are located at Camp Lejeune. A-Dec is the only vendor capable of outfitting the dental clinic with compatible casework. A-Dec is the only vendor that meets the minimum requirements of the government. 5. DETERMINATION OF BEST VALUE: In accordance with FAR 8.404(d), the VA has already determined the prices of equipment and fixed price services of the schedule contracts to be fair and reasonable. Therefore, ordering activities are not required to make a separate determination of fair and reasonable pricing. The Naval Medical Logistics Command, Fort Detrick Contracting Officer will determine, using the procedures in FAR 8.405, that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government's needs. The contracting officer may also seek additional discounts before placing the order. 6. DESCRIPTION OF MARKET RESEARCH: Market research was performed in the January 2014 timeframe. Search of Federal Supply Schedules identified that no vendor other than A-Dec can provide dental casework that meets the minimum requirements of the government. Several vendors can provide dental casework on the FSS but they are not compatible with the dental delivery systems for the newly constructed dental operatories. These vendors available on the FSS include Pelton and Crane, Belmont, Dentalez, and Kavo but they do not meet the minimum requirements of the government. A-Dec is the only vendor capable of providing dental casework and accessories that meet the minimum requirements of the government. 7. ANY OTHER SUPPORTING FACTS: This procurement uses a FSS Schedule and will be solicited and awarded in accordance with FAR Subpart 8.4. After a competitive source selection process, the Navy awarded a five year IDIQ contract (N62645-12-D-5043) with A-Dec for dental equipment including dental delivery systems, dental chairs, and assistant instrumentation workstations. 8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: All future requirements will be handled on a case-by-case basis. As the barriers that preclude the agency from the requirements of section 8.405-2 (SERVICES) are due to limited vendors on schedule, no actions can be taken by this agency to remove those barriers. If additional vendors are added to the FSS for this equipment, they will be considered as applicable. 9.
