Description
Justification for Other Than Full and Open Competition (1) Identification of the agency and the contracting activity, and specific identification of the document as a "Justification for other than full and open competition." The following is a justification for other than full and open competition provided by the Department of Housing and Urban Development, Office of Inspector General (HUD OIG), pursuant to FAR 8.405-6(c). (2) Nature and/or description of the action being approved. The HUD OIG has selected FI Consulting for the consulting support services in connection with the audits of FHA and Ginnie Mae's financial statements for fiscal year 2014. The contractor will serve as subject matter expert to assist OIG audit teams in assessing and evaluating the reasonableness of HUD management's significant accounting estimates for financial reporting purposes. This contract will be a 6 month only bridge contract, and a full competition for these services will be conducted within the next 6 months for a formal replacement contractor. (3) A description of the supplies or services required to meet the agency's needs (including the estimated value). The Contractor shall provide consulting support services to OIG audit teams to assist in evaluating the reasonableness of significant accounting estimates made by HUD management in connection with the audits of FHA and Ginnie Mae financial statements by OIG. The services to be provided by the contractor will be divided into three phases (planning, performance, and reporting) and will cover the following areas: • Assessment of FHA significant accounting estimates (allowance for subsidy associated with loans receivable and related foreclosed property and liability for loan guarantee. • Assessment of Ginnie Mae's MBS program guarantee loss liability accounting estimate. • Assessment of Ginnie Mae's mortgage servicing rights fair value estimates. (4) An identification of the statutory authority permitting other than full and open competition. The statutory authority permitting other than full and open competition is FAR 6.302-1(a)(2) which states: (2) When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for. In this case, FI consulting was the incumbent contractor performing these services under an expired contract. The Office of Audits identified a critical need to continue these services for 6 months while the formal competition is conducted for the replacement contractor. In order to minimize the duration of this sole source contract, it was determined best to have the period of performance for this contract to be 6 months only. (5) A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. FI Consulting is uniquely qualified to complete the task because of its vast Federal Credit Reform experience and its familiarity with HUD programs gained from OIG's previous contract. Credit Reform is highly specialized area of accounting in the Federal government and HUD credit programs are unique from other Federal Agencies. Additionally, there are no qualified consultants, except for Fi Consulting, that can satisfy OIG's requirements at the present time and within the timeframe permitted for this task order. (6) A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. OIG reviewed the Financial and Business Solutions (FABS 520) category in the GSA Advantage website to identify prospective contractors that can provide the needed services and can meet OIG's specific requirements. We came up with a short list but eliminated most of them except for Fi Consulting because of the independence issue. Some of the contractors in our short list had previously worked with either FHA or Ginnie Mae in some capacity and therefore, would impair their independence if selected to work for OIG on this order. FI Consulting is a small business concern. (7) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. To ensure that the cost to the Government for this task is fair and reasonable, OIG prepared an Independent Government Cost Estimate and also compared the IGCE to other contractors with GSA's published labor rates. FI Consulting's rates were considerably lower in all labor categories as compared to other GSA published rates. The Government also did a comparison of the submitted proposal to the IGCE. After extensive negotiation with the vendor, we agreed upon a final cost of $253,534.97. In summary, we have done our due diligence in determining that 1) FI Consulting's level of effort is fair and reasonable; and 2) that the labor category rates being used were also fair and reasonable. (8) A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted. See response to question item number 6 above. (9) Any other facts supporting the use of other than full and open competition, such as: (i) Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available. (ii) When 6.302-1 is cited for follow-on acquisitions as described in 6.302-1(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived. See response to item number 6 above. (10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. See response to item number 6 above. (11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. For fiscal year 2015, we plan to conduct more research with the end of goal of expanding the list of other prospective contractors that are qualified and can meet OIG's requirements. Once we come up with an expanded list, we will procure the needed services that would allow full and open competition. (12) The Contracting officer certifies that the justification is accurate and complete to the best of the contracting officer's knowledge and belief. The supporting documentation was the responsibility of technical or requirements personnel (e.g., verifying the Government's minimum needs or schedule requirements or other rationale for other than full and open competition) and form the basis for the justification. These supporting documentation have been certified as complete and accurate by the technical or requirements personnel.
