- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 16, Division II Supply Team purchasing for Station 520, Biloxi VA Medical Center. This is a Justification for Other than Full and Open Competition. The purchase request number is 520-14-3-9363-0014. 2. Nature and/or Description of the Action Being Processed: Type of action being issued is a new contract. This will be a firm fixed price Simplified Purchase Order IAW FAR 13.106-1(b). The source contemplated is Biodex Medical Systems, Inc., 20 Ramsey Road, Shirley,NY 11967-0702 Phone: 800-224-6339. 3. Description of Supplies/Services Required to Meet the Agency's Needs: Biodex System 4 Pro Orthopedic Testing & Rehabiliation System, 1ea Biodex Upper Body Cycle Clinical Pro, 2ea The requirement is to provide two Biodex System 4 Pro's at a cost of $55,326.00. This will allow the rehab staff at Gulf Coast Veterans Health Care System to reach its mission of providing state of the art therapy options to its Veterans. Estimated Delivery Date: 1 June 2014 Required Delivery Date: 1 July 2014 The Independent Government Cost Estimate is $55,326.00. 4. Statutory Authority Permitting Other than Full and Open Competition: (X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): a. Only One Responsible Source (FAR 6.302-1) - (This pertains to Bio-Dex 4 capabilities) There is no isokinetic system available on the market today that includes the following features: 1.Motorized patient positioning chair. 2.Ability for exercise sessions to end by a percentage of fatigue. 3.T-Base design allowing the chair to move front and back and the dynamometer side to side. 4.Dynamometer that allows for at least 16" of vertical travel and 340 degrees dynamometer head rotation. 5.Mechanical safety stops built into each attachment. 6.Sliding positioning handle on shoulder attachment. 7.Audio visual images (AVI's) of positioning set-up's. 8.Built in protocols for fall risk assessment and industrial medicine screening. 9.Rehabilitation and testing of open and closed kinetic chain exercise in all modes of operation for the ankle, knee, hip, shoulder, elbow and wrist with infinitely adjustable angles. 10.Isomap reporting to identify strength deficiencies related to range of motion. 11.Ability to save protocols into a favorites menu for easy access and implementation. 12.Rehab Session Summary Reports demonstrating changes in strength, range of motion and pain over time as well as user definable parameters. 13.Ability to download, transfer, and read Biodex System 2 or Biodex System 3 data files. 14.Provides progress reports graphing and comparing multiple tests in a single report. 15.Optional pediatric attachments to accommodate children. These features set the standard of care in Rehabilitation Thereapy for the Veterans Health Administration. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Rehab staff explored other options but no other piece of equipment met the Rehabilitation Thereapy needs of the Veterans. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: This is a commercial item which is purchased by numerous government and private organizations. A commercial price determination can be made by comparing prices charged to other organizations on similar purchased from this vendor. A check of FPDS shows the VA has bought 5 similar systems from this manufacturer since 2010. These prices are comparable to the amount being charged for the basic system and accessories under the purchase contemplated under this procurement. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Rehab therapist explore several others vendors equipment but none meet the capabilities to the equipment selected. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: Capabilities stated above are the reason for selection. This product is manufactuered and distributed by Bio-Dex alone. Biodex is an SBA Certified Small Business. 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Continue to explore the rehab market for comparable options that may meet the need to provide therapy similar to this equipment. 12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
