- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 23 VA Black Hills HCS Fort Meade Campus 113 Comanche Rd. Fort Meade, SD 57741 This is a Justification for Other Than Full and Open Competition. 2237# 618-14-3-4008-1504 2.Nature and/or Description of the Action Being Processed: The Department of Veterans Affairs proposes to issue a new firm-fixed price contract to Philips Medical Systems, Inc., 22100 Bothell Everett Hwy, Bothell, WA 98021-8431 (DUNS: 153882816) to provide emergency repair service for the 1.5T MRI in the Imaging Department at the Minneapolis VAMC. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The contractor will provide emergency repair services (parts and labor) to repair the 1.5T MRI in the Imaging Department. The gradient amp failed. The gradient is a magnetic field that changes in strength in a given direction. The gradient is used to select a region for imaging and to encode the location of MRI signals received from the object being imaged. The Philips Field Service Engineer will assess the problem and do the repair. The required start date is May 13, 2014. 4.Statutory Authority Permitting Other than Full and Open Competition: () (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (X ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This is an emergency order. The 1.5T MRI in the Imaging Department is currently shut down. Patient care is currently being impacted due to the inability to use this equipment. Phillips is also the OEM and is the only vendor who can repair the 1.5 MRI. 5.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: This has been declared an emergency repair. Time requirements did not permit soliciting several contractors for capability and/or price. Please see justification in item #5 above. Phillips is the only company that has the ability to begin work right away to quickly address the issue. 6.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Prices will be compared with previous procurements of similar type in order to determine the price fair and reasonable. 7.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: There are no other sources available at this time. If other responsible sources are found in the future, competitive offers will be solicited. 8.Any Other Facts Supporting the Use of Other than Full and Open Competition: None. 9.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Phillips 10.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: If other qualified and OEM trained companies become available to repair this equipment in the future, new sources will be sought.
