Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Combined Synopsis/Solicitation High Performance Computing (HPC) User Forum Services In accordance with FAR 12.603(c)(2), the following is included in this Combined Synopsis/Solicitation: The proposed contract action for HPC User Forum Services will be procured as a direct award to International Data Corporation as they are the only known source for this requirement; however, all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) The solicitation number is W912DY-14-G-1013 and is issued as a Request for Proposal (RFP). (iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-66. (iv) The associated North American Industrial Classification System (NAICS) code for this procurement is 611420 Computer Training Services with a small business size standard of $10,000,000.00. (v) The proposed contract will include only Firm Fixed Price type Contract Line Item Numbers (CLINs) as identified below: Base Year: Firm Fixed Price CLIN 0001 for HPC User Forum Services. Firm Fixed Price CLIN 0002 for Contractor Manpower Reporting Cost Reimbursable CLIN 0003 for Contractor Travel (If Applicable) (vi) The USACE Engineering and Support Center, Huntsville (CEHNC) requires HPC User Forum Services in accordance with the attached performance work statement titled quote mark PWS_HPC User Forum.docx. quote mark (viii - xii) The selected Offeror must comply with the following commercial item terms and conditions, which are incorporated herein by reference: FAR 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items - the selected offeror must submit a completed copy of the listed representations and certifications; FAR 52.212-4, Contract Terms and Conditions - Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, paragraph (a) and the following clauses in paragraph (b): 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.225-13, 52.232-34. Also the full text of a clause may be accessed electronically at this address http://farsite.hill.af.mil/vffara.htm You are requested to submit a proposal to perform the required services of the attached PWS. The entire proposal should not exceed 10 pages. Pricing shall be submitted on the attached line item spreadsheet. All proposal documents when printed shall fit on 8 x 11 inch paper to include spreadsheets (with appropriate page breaks). Double sided submittals count as two pages. All documents and spreadsheets shall include the Contractor Name, PWS/SOW Title, and Date. Ensure your proposal is submitted in PDF format. Spreadsheets shall be submitted in Excel format. Evaluation Factors: Formal source selection procedures will not be used since this procurement is being conducted non-competitively as a direct award under the procedures detailed in FAR 13.106-(2)(b). The proposal will be evaluated to ensure that the technical solution meets the minimum requirements of the PWS. The price proposal will be evaluated to make a fair and reasonable determination based upon the Independent Government Cost Estimate and historical data from similar procurements. Please identify the primary and alternate points of contact (POCs) for this effort. Information shall include the POC name, office telephone numbers, mobile telephone numbers, and e-mail address. (xiii) 52.252-2 -- Clauses Incorporated by Reference: This contract incorporates one or more clauses by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. Also, the full text of a clause may be accessed electronically at this address, http://farsite.hill.af.mil/vffara.htm. FAR 52.213-1 Fast Pay; FAR 52.213-2 Invoices; FAR 52.213-3 Notice to Supplier. COMBATING TRAFFICKING IN PERSONS (FEB 2009) (a) Definitions. As used in this clause-- Coercion means-- (1) Threats of serious harm to or physical restraint against any person; (2) Any scheme, plan, or pattern intended to cause a person to believe that failure to perform an act would result in serious harm to or physical restraint against any person; or (3) The abuse or threatened abuse of the legal process. Commercial sex act means any sex act on account of which anything of value is given to or received by any person. Debt bondage means the status or condition of a debtor arising from a pledge by the debtor of his or her personal services or of those of a person under his or her control as a security for debt, if the value of those services as reasonably assessed is not applied toward the liquidation of the debt or the length and nature of those services are not respectively limited and defined. Employee means an employee of the Contractor directly engaged in the performance of work under the contract who has other than a minimal impact or involvement in contract performance. Forced Labor means knowingly providing or obtaining the labor or services of a person-- (1) By threats of serious harm to, or physical restraint against, that person or another person; (2) By means of any scheme, plan, or pattern intended to cause the person to believe that, if the person did not perform such labor or services, that person or another person would suffer serious harm or physical restraint; or (3) By means of the abuse or threatened abuse of law or the legal process. Involuntary servitude includes a condition of servitude induced by means of-- (1) Any scheme, plan, or pattern intended to cause a person to believe that, if the person did not enter into or continue in such conditions, that person or another person would suffer serious harm or physical restraint; or (2) The abuse or threatened abuse of the legal process. Severe forms of trafficking in persons means-- (1) Sex trafficking in which a commercial sex act is induced by force, fraud, or coercion, or in which the person induced to perform such act has not attained 18 years of age; or (2) The recruitment, harboring, transportation, provision, or obtaining of a person for labor or services, through the use of force, fraud, or coercion for the purpose of subjection to involuntary servitude, peonage, debt bondage, or slavery. Sex trafficking means the recruitment, harboring, transportation, provision, or obtaining of a person for the purpose of a commercial sex act. (b) Policy. The United States Government has adopted a zero tolerance policy regarding trafficking in persons. Contractors and contractor employees shall not-- (1) Engage in severe forms of trafficking in persons during the period of performance of the contract; (2) Procure commercial sex acts during the period of performance of the contract; or (3) Use forced labor in the performance of the contract. (c) Contractor requirements. The Contractor shall-- (1) Notify its employees of-- (i) The United States Government's zero tolerance policy described in paragraph (b) of this clause; and (ii) The actions that will be taken against employees for violations of this policy. Such actions may include, but are not limited to, removal from the contract, reduction in benefits, or termination of employment; and (2) Take appropriate action, up to and including termination, against employees or subcontractors that violate the policy in paragraph (b) of this clause. (d) Notification. The Contractor shall inform the Contracting Officer immediately of-- (1) Any information it receives from any source (including host country law enforcement) that alleges a Contractor employee, subcontractor, or subcontractor employee has engaged in conduct that violates this policy; and (2) Any actions taken against Contractor employees, subcontractors, or subcontractor employees pursuant to this clause. (e) Remedies. In addition to other remedies available to the Government, the Contractor's failure to comply with the requirements of paragraphs (c), (d), or (f) of this clause may result in-- (1) Requiring the Contractor to remove a Contractor employee or employees from the performance of the contract; (2) Requiring the Contractor to terminate a subcontract; (3) Suspension of contract payments; (4) Loss of award fee, consistent with the award fee plan, for the performance period in which the Government determined Contractor non-compliance; (5) Termination of the contract for default or cause, in accordance with the termination clause of this contract; or (6) Suspension or debarment. (f) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (f), in all subcontracts. (g) Mitigating Factor. The Contracting Officer may consider whether the Contractor had a Trafficking in Persons awareness program at the time of the violation as a mitigating factor when determining remedies. Additional information about Trafficking in Persons and examples of awareness programs can be found at the website for the Department of State's Office to Monitor and Combat Trafficking in Persons at http://www.state.gov/g/tip. Avoidance of Personal Services: The Contracting Officer's Representative (COR) has been briefed on the avoidance of personal services and those actions that represent personal services. This organization has determined that the use of contractor support to satisfy the requirements of this contract is in the best interest of the government (economic and other factors considered). The Client Agency has determined this contract is not being used to procure services prohibited by Subpart 37.1 of the Federal Acquisition Regulations (FAR). Avoidance of Personal Services: To counter the circumstances that infer personal services and to preserve the non- personal nature of this contract, the Contractor shall adhere to the following guidelines in the performance of the task: Provide for direct supervision of all contract employees assigned to the task. Refrain from discussing issues such as skill levels and hours, salaries, cost and funding data, or administrative and personnel matters affecting contractor employees with the COR. Ensure close communication/coordination with the COR, reporting problems to the COR as they occur. Do not permit government officials to directly interview potential contractor employees, discuss individual performance, approve leave or work scheduling of contractor employees, terminate contractor employees, assist contractor employees in doing their jobs or obtain assistance from the contractor in doing Government job. Do not assign contractor personnel to work under direct government supervision. Maintain a professional distance from government employees. Provide contractor employees with badges, if appropriate, identifying them as contractors. Ensure proper communications with the government (technical discussion and government surveillance is okay, but the government cannot interfere with the contractor's legitimate exercise of discretion in meeting contractual requirements. Use work orders to document and manage the work and to define the details of the assignment and its deliverables. The government has the right to reject the finished product or result and this does not constitute personal services. When travel is required for the performance on a task, the contractor personnel are only to travel as directed by their contract management. The contractor shall provide suitable marking on all documents or reports generated, per FAR11.106 and meet all other terms of this regulation. (xiv) Defense Priorities and Allocations System (DPAS), is not applicable. (xv) Proposals are due June 16, 2014, 11:00am Central Time and shall be submitted via email to Zalerie Moore (Zalerie.moore@usace.army.mil) and Chase Bonds (steven.c.bonds@usace.army.mil).
