- Justification for Other than Full and Open Competition Lease # LAZ95816 U.S. GENERAL SERVICES ADMINISTRATION GSA Region 9 Real Estate Acquisition Division 1. Identification and Description of Action Being Approved : The General Services Administration currently leases 5,742 RSF (5,364 ABOA) square feet of office space and 2 surface parking spaces at 501 N Marshall St., Casa Grande, AZ, under lease number GS-09B-95816 for Social Security Administration (SSA). The current lease expires August 24, 2014. Approval is requested to negotiate a two year extension with the incumbent landlord without full and open competition for continued occupancy at this leased location. 2. Description of Supplies or Services Required: The agency under this lease has a continuing need for 5,742 RSF (5,364 ABOA square feet). SSA will move to a different location under a new lease upon completion of the design and completion of tenant improvements. The design and construction activities are expected to be completed late 2015. The extension will have termination rights after a 1 year firm term. The estimated full service rental rate, including the 2 surface parking spaces, for the 5,742 RSF space is anticipated to be $23.00 per RSF per annum for two years. The anticipated total contract value for the two year lease extension is $264,132.00. The anticipated annual rental rate is $132,066.00 3. Identification of Statutory Authority: 41 U.S.C. 3304 (a) (1) and FAR 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements. 4. Demonstration that the Acquisition Requires use of the Authority Cited: GSAM 570.405 (c) permits contracting without providing for full and open competition when the property or services needed by the agency are available from only one responsible source and no other type of property or services will satisfy the needs of the agency. The agency is scheduled to move to a new location, but the space will not be ready for occupancy until after the current lease expires and therefore a short term extension is necessary. In addition, a cost benefit analysis shows that the Government cannot expect to recover relocation and duplication costs through competition. The incumbent Lessor’s expression of interest indicated that the rate would be $23.00 per RSF. Award to other than the current Lessor would require relocation of the entire requirement and SSA would incur move and replication costs that would not be recovered through competition. 5. Description Of Efforts To Solicit As Many Offers As Practical: GSAM 570.106(d) exempts short term lease extensions described in GSAM 570.405 from the requirement to publicize lease acquisitions. 6. Demonstration That The Anticipated Cost Will Be Fair And Reasonable. In accordance with Federal Acquisition Regulation (FAR) 6.303-2(a) (7), the Contracting Officer determines by certifying this document that the anticipated cost to the Government of $264,132.00 for the entire procurement is fair and reasonable. Based on a GSA market analysis conducted on 5/8/2014 via costar the rental rate proposed is within the fair market range when the cost of amortized tenant improvements is taken into account. Comparable full service rental rates, including surface parking and amortized tenant improvements, range from $18.00 to $27.00 per RSF. 7. Description Of Analysis Conducted. In May 2014, a GSA conducted an analysis that identified four (4) other locations that could potentially lease space to the Government for lease of the same type, class and size. The following locations reflect the asking lease rates, including the shell and operating expenses: Location of Lease Asking Full Service Rental Rate/RSF 115 E 1 st St $19.00 520, 560-580 N Camino Mercado $24.00 1653 E McMurray Blvd Bld I & K $18.00 1876 E Sabin Dr. 27.00 Average Rate of Leases $22.00 * Rates quoted were NNN, therefore a rate of $6.00 was added for operating costs **Rates are an average rate to include annual increases of $.50/rsf ***Rates do not include the cost of tenant improvements 8. Other Facts Supporting Use Of Other Than Full And Open Competition. This extension of the existing lease term coincides with the completion of tenant improvements under a new/replacing lease at a different location. This action will also avoid costly relocation expenses, duplicate tenant improvement build out costs, and disruption of mission critical activities. 9.
