- PRE-SOLICITATION SYNOPSIS: THIS IS NOT A SOLICITATION. The purpose of this synopsis is to notify potential offerors of the intent by the U.S. Environmental Protection Agency?s (EPA) Region 1 office on behalf of Region 2 to issue a competitive small business set-aside solicitation to provide Emergency and Rapid Response Services (ERRS) for time-critical removals and rapid remedial actions with respect to the release or threat of release of oil, hazardous and toxic wastes, petroleum products, hazardous substances, or pollutants, contaminants or fire or explosion hazards, that pose an actual or potential threat to human health or welfare, or the environment. This procurement will also include the cleanup for incidents involving weapons of mass destruction; acts of terrorism; nuclear, biological and chemical incidents; and natural or man-made disasters. These services are to be provided within the EPA Region 2 geographic area, which includes the states of New York and New Jersey, and the territories of Puerto Rico and the U.S. Virgi n Islands. These services will be conducted under the authority of Section 104 of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) of 1980, as amended by the Superfund Amendments and Reauthorization Act (SARA); Section 311 of the Clean Water Act (CWA), as amended by the Oil Pollution Act (OPA) of 1990; Subtitle I of the Resource Conservation and Recovery Act (RCRA) as amended, the National Oil and Hazardous Substance Pollution Contingency Plan (NCP); and under the Robert T. Stafford Disaster Relief and Emergency Assistance Act, Public Law 93-288 as amended in response to a presidential disaster declaration. It is the Government?s intent to award performance-based indefinite delivery/indefinite quantity (ID/IQ) type contracts, consisting of a twenty-four (24) month base period, with a twenty-four (24) month award term period, and a twelve (12) month award term period, for a maximum potential period of performance of sixty (60) months. The Government reserves the right to award any number of contracts resulting from the small business set-aside solicitation, however, it is anticipated two small business contract awards will result from the solicitation that will follow this synopsis. The solicitation and resulting contracts will include the Environmental Protection Agency Acquisition Regulation (EPAAR) clause: 1552.209-74 LIMITATION OF FUTURE CONTRACTING Alternate I (ERRS) (APR 2004). During the life of the ERRS contract the contractor agrees that unless otherwise authorized by the Contracting Officer the firm will not provide any Superfund Technical Assistance and Removal Team (START) type activities (e.g., START contracts) to EPA within the contractor's ERRS assigned geographical area(s), either as a prime contractor, subcontractor, or consultant. The NAICS code for this acquisition is 562910, Environmental Remediation Services, with a size standard of 500 employees. This is not a request for submission of proposals. Solicitation number SOL-R2-14-00003 will be issued at a later date. The closing response date will be 30 calendar days after issuance of the solicitation. This procurement will be conducted under Federal Acquisition Regulation (FAR) Part 15 - Contracting by Negotiation. The contract award will be made using a best value approach, with technical capability being of equal importance to cost or price. All responsible sources may submit a proposal to the subsequent solicitation which shall be considered by the agency. The synopsis, amendments, and other information related to this procurement, as well as any subsequent procurement notifications, will be posted on the Federal Business Opportunities website, at: www.fbo.gov and www.fedconnect.net.
