This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 19, Grand Junction Medical Center, Justification for Other than Full and Open Competition, Brand Name Justification. 575-14-3-5055-0028 2.Nature and/or Description of the Action Being Processed: Purchase of 20 Brand-name Motorola APX 4000, 800 Mhz radios for Grand Junction VAMC, Disaster Preparedness Program.. 3.Description of Supplies/Services Required to Meet the Agency's Needs: These radios are needed to meet the need of communications interoperability. These radios will go with the 20 Motorola radios and infrastructure purchased in FY11. 4.Statutory Authority Permitting Other than Full and Open Competition: ( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1(c)(1) Brand Name; 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Accordingly, Motorola 800, 400 Mhz radios are the only radios that are capable of providing the services described in Section III above without the Veteran's Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Motorola has many distributors. Contracting went through GSA and were not able to find a source. This requirement needs to be posted open market. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Determination will be made at time of award. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market Research was conducted IAW FAR 10, and it was determined that multiple vendors are able to supply the required item on the open market. This item is not available on GSA schedules or any required sources per FAR 8. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: Competition through small businesses will be sought to the maximum extent practicable by posting allowing competition with a brand name justification. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Will post to FBO 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Using another manufacturers system would increase costs for updates and maintenance, and the items would not be compatible with the current communications system. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
