Description
Amendment 0003 SF-30 Amendment 0003: The purpose of this amendment is to 1) revise Paragraph (ix) of the Combined Synopsis solicitation to provide clarifications; and 2) change the RFP response due time/date to 1:00 PM Eastern on June 24, 2014. Amendment 0002: The purpose of this amendment is to 1) correct CLINs 81 - 83 on Attachment 2 - CLIN Table; and 2) change the RFP response due time/date to 1:00 PM Eastern on June 23, 2014. (i) This is a combined synopsis/solicitation for commercial items prepared for the purchase of administrative services in support of the SEC Headquarters and Regional Offices, in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice and the attached Statement of Work (Attachment 1). This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) Solicitation Number SECHQ114R0015 is issued as a Request for Proposal. (iii) The solicitation and incorporated provisions and clauses are those in effect through FAC 2005-73 effective April 29, 2014. (iv) Solicitation Number SECHQ114R0015 is a 100% 8(a) set-aside. The NAICS code for this procurement is 561110, Size Standard $7.0 Million. (v) Offerors shall follow the contract line item number (CLIN) structure detailed in the attached pricing schedule (Attachment 2, CLIN Table), specifically providing onsite labor categories, occupation codes (if applicable), and rates for each labor duty category at the SEC Headquarters and Regional Offices to provide services in accordance with Attachment 1, Statement of Work. (vi) Description of requirements for items to be acquired. The Securities and Exchange Commission (SEC) intends to award a non-personal services Indefinite Delivery Indefinite Quantity (IDIQ) contract to provide Administrative Support Services in support of the SEC Headquarters and Regional Offices. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government. The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to complete and deliver the services as defined in accordance with Attachment 1, Statement of Work. (vii) The anticipated period of performance shall be one (1) year from date of award with four (4) 1-year options. Anticipated Contract Type: The Government anticipates awarding an Indefinite Quantify Indefinite Delivery (IDIQ) type contract with labor hour and firm fixed-price task order(s). The Government reserves the right to make multiple awards or no award. It is anticipated that if Multiple Awards are made, orders will be competed on a task order basis among the awardees. The places of performance are listed in the attached Places of Performance (Attachment 3). The anticipated date of contract award(s) is August 4, 2014. (viii) FAR 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. Offerors may obtain full text versions of these clauses electronically at http://farsite.hill.af.mil/. Parties responding to this solicitation who believe they can provide Administrative Support Services may submit their offer in accordance with their standard commercial practices (e.g., on company letterhead, formal proposal form, etc.) but must include the following information: 1. The Solicitation Number SECHQ114R0015; 2. The time and date specified in the solicitation for receipt of proposals; 3. Dun & Bradstreet Number (DUNS); 4. Contact Name, Email address, and telephone number; 5. Complete business mailing address; 6. Price and any discount terms in accordance with Attachment 2, CLIN Table (Note: pricing shall be separate from Vendor's, management approach and capabilities, and past performance.); 7. "Remit to" address, if different than mailing address; 8. Completed and signed Attachment 4, SF-1449; 9. A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the Offeror shall complete electronically) or indicate that the representations and certifications are available on-line; 10. A copy of System for Award Management (SAM) registration (see https://www.sam.gov/), or indicate that the SAM record representations and certifications is are available on-line in the Reps & Certs section of their System for Award Management (SAM) record available at https://www.sam.gov, or a copy of System for Award Management application; 11. Acknowledgment of Solicitation Amendments, if applicable; 12. A management approach and capabilities technical description of the servicesitems being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may also include product literature, or other documents, if necessary; 13. Narrative addressing the capability to provide Administrative Support Services in support of the SEC Headquarters and Regional Offices (see Attachment 3, Places of Performance); 14. A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration; and 15. Period for acceptance of offers. The Offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation. (ix) The provision at FAR 52.212-2, Evaluation - Commercial Items (Jan 1999), applies to this acquisition as follows: 52.212-2 Evaluation-Commercial Items (Jan 1999) a) The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. This is a Best Value Procurement. The following factors, in descending order, shall be used to evaluate offers: 1. Management Approach and Capabilities 2. Past Performance 3. Price Management Approach and Capabilities will be accorded more weight than Past Performance. Management Approach and Capabilities and Past Performance, when combined, are significantly more important than price. As the technical proposals become more equal, price becomes more important in making the award determination. In the event that two or more proposals are determined not to have any substantial technical differences, i.e., are technically equivalent, award may be made to the lower priced proposal. It should be noted that award may be made to other than the lowest priced proposal if the Government determines that a price premium is warranted due to technical merit. The Government may also award to other than the highest technically rated quotation, if the Government determines that a price premium is not warranted. The Offeror's technical proposal (Volume 1) must demonstrate the firm's capability to perform the requirements outlined in the Statement of Work (SOW). Offerors shall provide a technical offer that includes the following two (2) general areas/factors: Factor 1, Management Approach and Capabilities and Factor 2, Past Performance. Management Approach and Capabilities: The Offeror's management approach shall describe project personnel and responsibilities, any proposed subcontracting arrangements, communication and coordination plans, schedules of all tasks and subtasks, meetings, and deliverables. The Offeror's management approach shall include all key personnel as well as labor duty categories offered under the SEC's labor duty categories indicated within the SOW and a description of the firm's current personnel resources. The personnel portion of your offer shall include: A. Key Personnel Resumes with a description of the experience and capability for the personnel proposed and representational resumes for all administrative positions at the SEC's Headquarters in Washington, D.C. and two (2) regional offices (the Offeror is expected to choose the two (2) regional offices). Descriptions shall address such items as the individual's background, education, work experience and accomplishments. Each resume should be limited to two (2) pages. Note that letters of commitment are required for proposed new hires (see paragraph B below). B.Signed Letter of Commitment for proposed new hire(s) (including the Project Manager, Alternate Project Manager, and all administrative positions) must be included in your proposal. C. A staffing plan with a description of the Offeror's current personnel resources for this activity, which addresses capabilities and experience relating to the SOW, including a recruitment and retention policy. D. A description of the Offeror's experience and approach for staffing and managing a contract with personnel located in up to 12 different locations throughout the US. E. A discussion of any anticipated major difficulties and problem areas, along with potential recommended approaches for their resolution. F. A transition plan for any existing personnel and for Contractor staff when/if they leave. Past Performance: Offerors shall provide a list of no more than three current or past contracts (both Government and Commercial) performed within the past five years for whom the Offeror has provided the same or similar services (similar value/number of personnel). Offerors may use a Subcontractor's past performance for one of the three past performance submissions. The contractor shall submit the following information for each contract: 1. Name of agency 2. Contract number 3. Contract type 4. Total contract value 5. Description of the contract work 6. Contracting Officer's or similar representative's telephone number and e-mail address 7. List of all disputes associated with the contract 8. List of options that were not exercised and reason(s) why they were not exercised 9. Problems encountered and how they were resolved The Government will consider information obtained from references provided by the Quoter, as well as other relevant past performance within the most recent two (2) years and/or information obtained from other sources known to the Government, such as PPIRS. In accordance with FAR 15.305, in the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available, the Offeror will not be evaluated either favorably or unfavorably in this area, but instead will receive a neutral rating in the area of past performance. Offers must demonstrate that both your firm and personnel can successfully complete this project. Page Limitation: The technical proposal (management approach and capabilities) shall be limited to twelve (12) one-sided pages, minimum font size of point 12, excluding cover page(s), table of contents, resumes (2 pages each, and letters of commitment for proposed new hire(s). There is no page limitation for past performance. Offerors shall not include any price information in the technical proposal. PRICE PROPOSAL: The Task Order(s) will consist of labor categories which will be billed as fixed hourly rates (regular and overtime, if applicable). For the purposes of the evaluation, the Government will compare labor categories and rates as indicated in the Pricing Schedule. Each Offeror shall submit a price proposal separate from the technical proposal. The price proposal shall include the following: a) Completed CLIN Table (see Attachment 2) in an Excel Spreadsheet. b) Fixed hourly rates shall be fully burdened and include all costs (direct and indirect), overhead, and profit. c) If applicable, Prime Contractor/Subcontractor Arrangement or Contractor Team Arrangement Supporting Documentation. Furthermore, the prime contractor shall disclose to the Government's Contracting Officer a copy of the subcontract pricing, terms and conditions, or subcontracting agreement.: If subcontracting or teaming is proposed, the Government will evaluate the acceptability of any subcontracting or teaming as part of its evaluation of price. d) Offerors must also submit price proposals in the format of the attached pricing schedule. The SEC requires that all proposals include all contract line items, as stated. Technical proposals submitted in response to this RFP will be evaluated as follows: 1) Management Approach and Capabilities - the demonstrated effectiveness of the Offeror's proposed management approach and the capability to provide qualified personnel to successfully perform the requirements of the SOW. 2) Past Performance - the Offeror's ability to conform to contract requirements, adhere to contract schedules, and commitment to customer satisfaction on work similar in size and scope, according to past performance references provided in the Offeror's submission, as well as other relevant past performance information obtained from other sources known to the Government, such as PPIRS. Price Proposal: The Government expects to receive price competition through the submission of several price proposals. The Offeror's proposed pricing will be evaluated against the Government's estimated level of effort of 1,880 hours per year for each position. Offerors shall propose fixed labor rate prices that are both realistic and reasonable. Options will also be evaluated. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror(s) within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (x) Offerors shall include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items, with its offer, or indicate that representations and certifications are available on-line in the Reps & Certs section of their System for Award Management (SAM) record available at https://www.sam.gov. (xi) FAR 52.212-4, Contract Terms and Conditions-Commercial Items (May 2014), applies to this acquisition and a statement regarding any addenda to the clause. Attachment 5, Contract Administration/Specialist Contract Requirements provides information regarding contract administration and special contract requirements that apply to this procurement. Attachment 6, Wage Determinations provides U.S. Department of Labor, Wage Determinations under the Service Contract Act for the locations of the SEC's twelve offices across the country. The following FAR Clauses apply to this procurement: 52.216-1 Type of Contract (Apr 1984). The Government contemplates award of an indefinite delivery indefinite quantity (IDIQ) contract resulting from this solicitation with labor hour and firm fixed-price task order(s). 52.216-18 Ordering (Oct 1995). (a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued through the period of performance of the contract. (b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control. (c) If mailed, a delivery order or task order is considered "issued" when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule. 52.216-19 Order Limitations (Oct 1995) (a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $1,000.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract. (b) Maximum order. The Contractor is not obligated to honor- (1) Any order for a single item in excess of $8 Million; (2) Any order for a combination of items in excess of $30,000,000.00; or (3) A series of orders from the same ordering office within 30 days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section. (c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section. (d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 10 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source. (End of clause) 52.216-22 Indefinite Quantity (Oct 1995) (a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract. (b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum." (c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations. (d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after five (5) years of award of contract. (End of clause) MINIMUM AND MAXIMUM QUANTIES As referred to in paragraph (b) of FAR Clause 52.216-22, "Indefinite Quantity" of this contract, the contract minimum quantity is establish at $1,000. The contract maximum quantity is hereby established at the total amount of $30,000,000.00. 52.217-5 Evaluation of Options (July 1990) Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s). 52.217-8 Option to Extend Services (Nov 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within the period of performance of the contract. 52.217-9 Option to Extend the Term of the Contract (Mar 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within the period of performance of the contract; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years. 52.219-18 Notification of Competition Limited to Eligible 8(a) Concerns. (JUN 2003) (xiv) Defense Priority and Allocations System (DPAS) is not applicable. (xv) The due date and time for Proposals is June 23, 2014 at 1:00 PM Eastern Time. Late offers shall not be accepted. Proposals shall be delivered via email to Nancy Foster, fostern@sec.gov, and cc'd to Regina Mumford-Rush, mumford-rushr@sec.gov, respectively. The Offeror's proposal shall consist of four (4) electronic files, Microsoft Word, Adobe PDF, or Microsoft Excel type files: 1. Management Approach and Capabilities 2. Past Performance 3. Pricing* 4. SF-1449 and SF-30 Amendment(s) *Contractor Team Arrangement or Prime Contractor/Subcontractor Arrangement Supporting Documentation shall be submitted in the Pricing file, if applicable. Representations and Certifications and System for Award Management (SAM) registration/application shall be submitted in a separate file, only if this documentation is not available on-line. (xvi) All questions concerning this RFP shall be submitted in writing to Nancy Foster at fostern@sec.gov, no later than 3:00 p.m. local time (Eastern), June 9, 2014. Questions will not be answered orally. E-mail submission of questions is required. Questions submitted after the specified time/date may not be addressed.
