- The Office of Acquisition Management, Acquisition Section, of the Environmental Protection Office (EPA) intends to negotiate on a sole source basis with Mr. Gary Cygan, a contract for support involving hydrogeology, geochemistry, contaminant fate and transport expertise for work on a high-profile polychlorinated biphenyls (PCB) disposal Toxic Substances Control Act (TSCA) application evaluation and draft TSCA approval process in Region 5 of the EPA. The EPA requires a contractor to assist the EPA in reviewing information from the US Geological Survey report, public comments from the draft TSCA approval, and other comments from interested parties in determining a final course of action at the Clinton Landfill site. Sole source determination is based on the following: Mr. Cygan?s qualifications are unique in that he has been instrumental in bringing the hydrogeology aspect of the Clinton Landfill Inc. project forward to where it is today, especially with respect to the part of the Clinton Landfill Inc. project that involves interaction with USGS and the Illinois State Water Survey. He regularly updated senior management in project briefings about the hydrogeology aspect of the Clinton Landfill Inc. project. LCD has determined that a significant gap has been left by his departure and that a successful Clinton Landfill Inc. project completion is jeopardized without retaining Mr. Cygan?s expertise and unique insight. EPA?s requirement requires a combination of technical skills, historical background, project management, communication/collaboration skills with both senior management and technical staff and a balance of experience and relationships. Mr. Cygan possesses all the required technical skills, and just as importantly, he has uniqu e insights based upon his experiences at both USGS and EPA. The Clinton Landfill Inc. project will face unacceptable delays without collaborative and networking skills within the technical ranks. Given Mr. Cygan?s unique qualification (as specified earlier in this document) and his intimate knowledge of the Clinton Landfill Inc. project, the Region believes that it is in EPA?s best interests to hire him as a contractor. The North American Industry Classification System (NAICS) code for this acquisition is 541690 with a size standard of $14.0 M. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by June 27, 2014 will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered for the purpose of determining whether to conduct a competitive procurement. If the Government decides to compete this requirement, the acquisition will be evaluated on objective factors such as understanding of the requirements (see attached SOW); experience working with TSCA regulations; past experience with similar work; past performance on similar type requirements; and price.
