Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This synopsis is to notify contractors that the government intends to issue a Purchase Order in accordance with FAR Part 13 for the following, under simplified acquisition procedures. The Request for Proposal (RFP) number is FDA-14-1130551. Provisions and clauses in effect through Federal Acquisition Circular 05-45 are incorporated into this request. It is the contractor's responsibility to be familiar with the applicable clauses and provisions. The provisions and clauses may be accessed in full text at www.acquisition.gov/far. The NAICS code is 511210, Periodical Publishers. There is no set-aside for this acquisition. All qualified vendors are encouraged to respond. The purpose of this procurement is to establish a contract for a CQ-Roll Call (BRAND NAME OR EQUAL) Legislative and Regulatory Tracking System web services. Performance for this requirement consists of one 12-month base period and four option years. Background The FDA Center for Tobacco Products (CTP) was established by the Family Smoking Prevention and Tobacco Control Act (the Act), which was signed into law on June 22, 2009. The Center has responsibility for the implementation of the Act. The Office of Policy (OP) serves as the primary organization responsible for capturing and analyzing data in order to provide analysis and policy options while working with public health and industry partners to reduce the health impact of tobacco use. There are five strategic goals of the OP: •Facilitate Center-wide efforts to identify, prioritize, and develop new policies and initiatives to reduce tobacco use and its harms •Evaluate the effectiveness of CTP policies and initiatives in reducing tobacco use and its harms and guide the development of improvements and more effective alternatives •Establish and maintain meaningful and appropriate relationships with the government and non­ government agencies and organizations, the tobacco industry, and others to strengthen support for CTP and improve the development and implementation of CTP policies and initiatives •Serve as a resource to CTP for information about the tobacco industry, tobacco use and its harms, and costs, and tobacco control and its benefits, and for related legal, economic and policy analysis One of the most challenging goals of OP is to: "Establish and maintain meaningful and appropriate relationships with the government and non-government agencies and organizations, the tobacco industry, and others to strengthen support for CTP and improve the development and implementation of CTP policies and initiatives". In order to meet this goal to meet the dynamic needs of CTP, OP requires efficient access to track federal and state legislative and regulatory developments as it relates to tobacco. This type of activity requires careful attention to detail, reliable sources of information (high accuracy and frequency), and a format that is easily manipulated for use by various audiences. Since 2012, OP has used the subscription services of Congressional Quarterly (StateTrack and Premiere Subscription Services) as a way to collect data on legislative and regulatory developments in federal and state tobacco control. Additionally, use of this service has allowed OP to support the regulatory science behind CTP's regulatory authorities. OP would like to maintain access to timely and efficient information in order to continue to successfully meet its strategic goal. 2. Objective OP requires web based subscription system access to track federal and state legislative and regulatory developments as it relates to tobacco. This web based subscription system access shall be able to provide bill tracking, breaking congressional news, and access to legislative and regulatory summaries, reports, and archives. 3. Technical Requirements The contractor shall provide FDA users with a resource and or product as delineated below: Access Requirements: a. Real-time, up to the minute legislative and regulatory updates. b. Allow for users to search all 50 states and federal government legislation, executive orders, and regulations. c. Allow for access to reports and legislative and/or regulatory analysis on special topics. d. Customized and instant congressional news and news relevant to the Department of Health and Human Services. e. Ability to access and provide archived information instantly without the use of second and third party platforms. f. Customized alerts and query results for specific queries. g. Ability to provide customized reports on legislative and regulatory activities without sacrificing data integrity. h. Platform for sharing information amongst end user team members, others within the end users organization, end user partners, stakeholders, and the general public. i. Media updates and alerts about legislative and regulatory activities of all 50 states and the federal government. j. Ability to provide both public and private access with specialized permissions. k. Linking of information to seminal resources. l. Web-based subscription system that does not require integration into the FDA IT architecture. m. Option to allow users to create specialized legislative tracking documents, tables, and reports that may be made available to the public. Technical Support Requirements: Technical support to troubleshoot connectivity issues, user accounts and access. Support is required during normal business hours (8:30a- 5:00pmEastern Time, Monday- Friday, excluding Government holidays). Training Requirements: Provision of remote and in-person training, as needed, on the subscription and the services provided under the access requirements 4. Period of Performance Twelve (12) months from the date of award with four (4) option years. 5. Evaluation Factors for Award The Government will award a task order from this solicitation to the responsible offeror whose offer represents the best value to the Government. FDA is conducting this source selection using a trade-off/best value methodology. Technical merit is significantly more important than price in determining the successful offeror. However, among equally rated technical proposals, price will be the determining factor. The Government reserves the right to award a task order without discussions if the Contracting Officer determines that the initial offer(s) is/are providing the best value and discussions are not necessary. Proposal Instructions To Offerors Offerors are required to submit their proposals in two separate volumes as follows: Volume I - Technical Proposal Volume II - Pricing Proposal The completion and submission of the above items will constitute an offer (proposal) and will indicate the offeror's unconditional assent to the terms and conditions of this RFP and any attachments hereto. Alternate proposals are not authorized. Objections to any terms and conditions of the RFP will constitute deficiency, which may render the offer unacceptable. Volume I - Technical: This portion of the proposal to include all data and information required for technical evaluation of brand name or equal product, and exclude any reference to the pricing aspects of each offer. If an equal product is proposed, offeror shall demonstrate how that product is equal to the brand name product. Offerors shall demonstrate in sufficient detail that the proposed solution will successfully meet the requirements of the salient characteristics. For purposes of clarification, offerors are encouraged to provide trial access to their products to demonstrate how the requirements of the salient characteristics will be met. Volume II - Pricing: This volume shall include the complete pricing. Offerors shall propose pricing for one twelve (12)-month base period and four (4) option years. Offerors shall price each CLIN and clearly state an overall cost to the Government (inclusive of options). 7. (d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. As prescribed in 12.301(b)(4)(ii), substitute the following paragraphs (d)(1) and (e)(1) for paragraphs (d)(1) and (e)(1) of the basic clause as follows: (d)(1) The Comptroller General of the United States, an appropriate Inspector General appointed under section 3 or 8G of the Inspector General Act of 1978 (5 U.S.C. Flow down required in accordance with paragraph (d) of FAR clause 52.247-64. 52.213-2 Invoices (APR 1984) 52.217-9 Option to Extend the Term of the Contract (Mar 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within 1 day; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 1 day before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 60 months.
