Description
Procurement Office: U.S. Environmental Protection Agency, Superfund RCRA Procurement Operations Division (3805R) 1200 Pennsylvania Avenue, NW Washington, DC 20004 Response Date: July 11, 2014 In accordance with FAR Subpart 6.3, As per the Federal Acquisition Rules (FAR) Subpart 6.3, this justification represents rationale for other than full and open competition for the subject procurement. Under section 6.302-1, only one responsible source and no other source will satisfy the Agency's requirements for this item. Justification: (a) A sole source procurement is requested to purchase one Agilent flow cell for Agilent 600 MHz cold probe from Agilent Technologies. (b) The requested equipment is needed to repair the existing Agilent Inova600 NMR spectrometer. To repair the NMR spectrometer, the flow cell for Agilent 600 MHz cold probe must be compatible with the existing equipment without modification. The flow cell for Agilent 600 MHz cold probe must therefore conform to the desired equipment in exact specifications and exact physical dimensions. (c) Based on personal knowledge and a review of product specs from known competitors (e.g. Bruker, JEOL), other products do not have the same specifications and physical dimensions. Use of an alternative vendor's product would entail significant additional cost to the government (~ $1M) and would render a significant investment that has already been made of much lesser value. For this reason, only the requested equipment from Agilent Technologies will meet the current need of EPA for this acquisition. NO SOLICITATION OR REQUEST FOR QUOTE (RFQ) IS AVAILABLE. Notwithstanding, any firm that believes it is capable of meeting EPA's requirement as stated herein may submit a capability statement, which if received within two (2) calendar days July 10, 2014, of the date of this announcement will be considered. Responses to this posting must be in writing and provide clear and convincing evidence that competition would be advantageous to the Government. A determination not to compete the proposed purchase order based upon the responses to this notice is solely within the discretion of the Government.
