- This contract action was accomplished using other than competitive procedures because it is necessary to establish or maintain an essential engineering, research, or development capability to be provided by an educational or other nonprofit institution or a federally funded research and development center.(FAR 6.302-3). See posted J&A for further information. (1)The University of Massachusetts is the proposed sole source contractor because Dr. Stinson developed the theory behind the study and has the institutional knowledge to maintain this essential research work. On 9 January 2014, Harvard requested that contract W912HQ-13-C-0025 be terminated effective 1 May 2014. In the interim, Harvard proposed to subcontact the research work to the University of Massachusetts so that Dr. Stinson could assume the duties of the Principal Investigator, until contract W912HQ-13-C-0025 could be terminated and closed out. Without Dr. Stinson and original research topic, Harvard is unable to comply with the terms of the contract. (2)Dr. Stinson will be able to continue the work without interruption since Harvard is currently subcontracting the work to the University of Massachusetts. The research will provide an opportunity to improve the understanding of soil biota and their role in mediating interactions between native species and non-native invasive species in a global change context. Land used for DoD training has a long history of disturbance, making it particularly susceptible to non-native invasive species invasion and a potential source for invasion of surrounding lands. (3)The research proposal noted that a number of military installations (e.g., West Point, Fort McCoy, Fort Custer, and Arnold Air Force Base) have eradication programs for the non-native invasive species Alliaria petiolata, or garlic mustard, yet suitable strategies for soil and ecosystem restoration following these measures have not yet been found. As one of the most pervasive and problematic non-native invasive species in temperate deciduous habitats of North America, garlic mustard is an ideal study system to examine the functional diversity of key soil taxa and evaluate ecosystem management tools for soil restoration. Dr. Stinson's past work demonstrates that soil fungi are not only phytochemically suppressed by garlic mustard, but also are reduced by regional warming and nitrogen deposition, with resulting impacts on native vegetation and nutrient cycling dynamics. They predict that recovery of soil fungi and ecosystem function after non-native invasive species eradications will be dependent upon current and future abiotic conditions, and propose work that will help guide soil restoration measures on DoD lands. Dr. Stinson's unique experience and capabilities are required to complete project RC-2326. (4)The Contracting Officer believes it is in the best interest of the Government to execute a no cost termination of W912HQ-13-C-0025 under the authority of FAR 49.603-6, quote mark No-cost settlement agreement - complete termination quote mark. The expectation is for the proposal to not exceed the cost of the current contract. A notice of termination will be forwarded to the contractor upon approval of this Justification for Other than Full and Open Competition.
