- The National Institute of Standards and Technology (NIST) Acquisition Management Division, on behalf of the Material Measurement Laboratory (MML), intends to negotiate with Proto Manufacturing, Inc; Taylor, MI, on a sole source basis under the authority of FAR Subpart 6.302-1 - only one responsible source and no other supplies or services will satisfy agency requirements, to purchase an upgrade to an iXRD controller for an x-ray stress measurement system. The NIST Center for Automotive Lightweighting requires an upgrade to the controller and detector hardware and software for the x-ray stress measurement system being used on its Marciniak mechanical testing system. The current system is more than 10 years old, and has had minor modifications and upgrades to the hardware of the scanning head and the analysis software from the time of acquisition to today. This piecemeal upgrade scheme has resulted in difficulties related to intercommunication, data acquisition and operation of safety interlocks. The current system is manufactured by Proto Manufacturing, Inc. It contains a number of proprietary software modules that prevent other x-ray stress measurement device manufacturers from being able to fabricate an equivalent system. In particular, Proto Manufacturing holds a U.S. Patent covering the motorized translating head, used for spatially mapping stresses on the sample. Due to the nature of the NIST equipment (sample cannot be moved laterally to position the measurement location beneath the device), this feature is essential for measurements being performed. Market research has shown that no other companies can meet this requirement. The NAICS Code is 334516- Analytical Laboratory Instrument Manufacturing with a size standard of 500 employees. NIST anticipates negotiating and awarding a firm-fixed-price purchase order to Proto Manufacturing, Inc. for this requirement in the 4th quarter of fiscal year 2014. Interested parties that believe they could satisfy the requirements listed above for NIST may clearly and unambiguously identify their capability to do so in writing on or before the response date for this notice. This notice of intent is not a solicitation. Information submitted in response to this notice will be used solely to determine whether competitive procedures could be used for this acquisition.
