- Provisions set forth by the Federal Acquisition Regulation (FAR) § 6.302-1(a) (2) (ii) (A) authorizes the use of brand name only supplies in solicitations/contracts when supplies may be deemed to be available only from the original source in the case of a contract requiring the use of highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in substantial duplication of cost to the government that is not expected to be recovered through competition. As such, for the purposes described hereunder and in accordance with the Federal Acquisition Regulation (FAR) Subpart 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements, coupled with the Authority 10 U.S.C. 2304(c)(1), the Army Corps of Engineers, Chicago District intends to issue a competitive solicitation that will include brand name only items. Specifically, the winning contractor will be required to purchase the following brand name Critical Systems in support of new wells that will be installed as part of the INDIANA HARBOR & CANAL, CONFINED DISPOSAL FACILITY (IHC CDF) Additional Extraction Wells project: • Groundwater Pump and Motor o Manufacturer: Grundfos Pumps Corporation o Model: Redi-Flo 3 o Product Number: 22SQE05-40NE o Quantity: 8 - 16 • Pressure Transducers o Manufacturer: KPSI Level Transducers o Model: Series 320 o Product Number: 320S34B0A027.404014.402A10036B o Quantity: 8 - 16 Note: Critical Systems are defined as components that are in either intermittent or continuous operation and that would cause additional failures within the IHC CDF should they no longer become operational. The use of the original manufacturer of materials and components is required to prevent issues of system functionality and extensive additional costs. The use of any other manufacturer would cause a need to replace in essence complete parts and accessories thus creating complete new systems. Therefore, the future contract will need to use brand name descriptions peculiar to one manufacturer for a specific system with whom a turn-key solution can be provided meeting all government requirements. The government has already developed plans and specifications to add the additional extraction wells and intends to utilize competitive procedures for the future solicitation/contract of the construction project requiring the brand name only components. The future Task Order CX01 requiring these items will be under contract number W912QR-12-D-0006 and competed among the MATOC contractors. The North American Industry Classification System (NAICS) for the project is333911 with a small business size standard of 500 employees. Interested parties may identify their interest and submit clearly articulated product information. Product information lacking the particular features that do not meet, or cannot be modified to meet, this agency's needs cannot be considered.
