Description
(1) Identification of the agency and the contracting activity, and specific identification of the document as a Justification for other than full and open competition: The National Park Service, Contracting Office, Pacific West Region Office (PWRO), 333 Bush Street, Suite 500, San Francisco, CA 94101. (2) Nature and/or description of the action being approved: The NPS intends to issue a sole source contract to Leavengood, David Architect for Title III Support Services to provide review of shop drawings, office design support, on-site inspections, and as-built drawings during the construction period of the Structural Stabilization for the Historic Crook House, PMIS 149321, San Juan Island National Historic Park (SAJH), Washington. (3) A description of the supplies or services required to meet the agency's needs (including the estimated value): PWRO San Francisco Contracting Office anticipates the need to issue a sole source contract for Title III Support Services to provide review of shop drawings, office design support, on-site inspections, and as-built drawings during the construction period of the Structural Stabilization for the Historic Crook House, PMIS 149321, San Juan Island National Historic Park (SAJH), Washington. The estimated value of the contact is under $22,000. (4) An identification of the statutory authority permitting other than full and open competition: The authority permitting other than full and open competition is 41 U.S.C. 253(c) (1). The citation FAR 6.302-1, only one responsible source will satisfy agency requirements. (5) A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited: The proposed project consists of the structural stabilization of the historic Crook House. Leavengood, David Architect was the designing professional firm for the Title I Preliminary Design and Title II Final Design for this project. Their structural engineer was the lead for the specialized structural stabilization for this project which consists of replacement of the sheathing and shear walls for the building as well as the lifting of the entire two story building in order to install a new concrete foundation under the building. They have intimate knowledge of this project and are the most efficient and professional firm in order to do provide the support during construction tasks to support the on-site Contracting Officer's Representative (COR) for this project. Due to the unique character of this historic structure and the specific details to upgrade the foundations, wall sheathing and roof structure, the designing structural engineer from Leavengood, David Architect is the sole professional qualified to review the shop drawings and to inspect the construction status on-site. The relationship between the Title I and II task orders and this follow-on Title III contract is logical because Leavengood, David Architect performed programming for both projects and submitted supporting information on the details of each project. (6) A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies: PWRO San Francisco anticipates posting the synopsis within the next three (3) days. No actions will be taken to increase competition for this particular requirement due to the fact that Leavengood, David Architect is the only source that can provide the services described herein. Leavengood, David Architect has sufficient knowledge of the planned design of the Project and the stakeholders involved. Leavengood, David Architect has gained a thorough understanding of the project while establishing important working relationships with affected local entities. Leavengood, David Architect has extensive corporate knowledge of the project, amassed during the performance of the Task Orders mentioned above makes them the only source for the AE services needed for the remainder of the project. (7) A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted: Leavengood, David Architect was the designing professional firm for this project and should be used for the Title III Support Services during the construction tasks. This will result in the most efficient and cost effective method to provide assistance to the COR. Leavengood, David Architect was an A/E IDIQ contract holder. The task orders for the Title I and II work were performed by them under the IDIQ contract, and had the IDIQ contract not expired prior to this phase of work being commenced, they would have been selected for the logical follow-on work of Title III services. (8) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition: No sources have expressed, in writing, an interest in the acquisition. (9) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: No subsequent acquisitions for A/E services for this requirement are anticipated. Normal A/E requirements are awarded utilizing competitively-awarded IDIQ contracts pursuant to the fair opportunity procedures found in FAR 16.505. (10) The Contracting Officer certifies: a. Only one source is available, or urgent and compelling circumstances exist. b.The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
