Description
AE Services - HQ0034-07-D-1002 - 0044 Modification 04 1. Identification of the Contracting Activity: Washington Headquarters Services (WHS) Acquisition Directorate (AD), 1225 South Clark Street, Suite 1200 Arlington, VA 22202. 2. Nature and/or description of the action being approved: The proposed action is for additional scope and a 10-month extension of services; for the AE Services - HQ0034-07-D-1002- 0044, from 03 March 2014 to 31 December 2014. This is a justification for a modification since this action exceeds the period of performance for all options under the contract. The estimated value of this action is approximately $181,838. 3. Description of Services Provided: The requirement is to acquire Architectural and Engineering (AE) Services for Washington Headquarters Services (WHS) facilities in the National Capital Region (NCR), which will enable the Secretary of Defense, Senior DoD Leaders, and their staff(s) to fulfill the DoD mission. The action will be in support of the WHS Facilities Services Directorate, Engineering and Construction Division, for Master Planning Services. 4. Authority: 10 U.S.C. 2304, as implemented by FAR 6.302-1(a)(2)(iii). For DoD, NSA, and the Coast Guard, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in- (A)Substantial duplication of cost to the Government that is not expected to be recovered through competition, or (B)Unacceptable delays in filling the agency's requirements. (See 10 U.S.C. 3304(b)(2)) or 41 U.S.C.253 (d) (1)(B).) 5. Reason for Authority Cited: Several factors have contributed to the need to proceed with this action on a sole source basis at this time. After almost two years of planning work was completed by the contractor, beginning in April 2010 and continuing thru November 2011. The completion of the master plan update was placed on hold, as the Federal Services Division within WHS was being reorganized. The Pentagon Reservation Master Plan is to be updated every 5 years, but other organizational procedures needed to be completed before Master Planning Services could resume under the reorganized Federal Services Division. Master Planning Services restarted in January 2013 concurrent with the availability of the contractor's planner availability and have continued without interruption until the present. The contractor has completed 83% of the update to the Pentagon Reservation Master Plan. The current negotiated scope and price does not include the level of effort required by SBA/HSMM JV (AE) to revise the Pentagon Reservation Transportation Management Plan (TMP) in response to the many comments WHS received on the Draft TMP written by another contractor, Gannett Fleming. Additionally, the WHS leadership approved the master plan level concept for the commuter plaza, but later in April 2013 rescinded approval. This required additional effort by the contractor, is to resolve Pentagon Reservation transportation issues, including developing two concepts for the commuter plaza. A third concept developed by Black and Veach Gensler was adopted, but was not available until January 2014. The Master Plan, Environmental Assessment, and TMP are interrelated documents and need to be coordinated with one another. The extension of the Period of Performance to December 31, 2014 is required so the Master Plan Environmental Assessment, Master Plan, Section 106 Consultation (Historic Preservation Compliance), and TMP can be submitted to NCPC by October 05, 2014, with their review comments received in December and incorporated by the end of December 2014. 6. Efforts to Obtain Competition: The Government did not attempt to obtain other competitive master planning services under another contract, since this would have been a substantial duplication of effort and costs. It was determined that to award the remaining planning work to another AE contractor would be counterproductive and against the best interests of the Government. If another contractor was awarded the work remaining on the Master Plan, the new contractor would need to review and verify the initial 83% master planning work, which would take at the minimum seven (7) months and cost approximately $660,000. WHS has paid $ 989,104 to date for the Pentagon Reservation Master Planning Services. These factors combined together cause the current contractor to be the only company able to provide the completion of the master planning services without substantial duplication of coast and unacceptable delays to the government. 7. Actions to Increase Competition: In order to minimize the need for such non-competitive extensions, for future AE services, WHS has awarded another contract for AE Services. 8. Contracting Officer's Determination: The Contractor proposed price of $181,838.00 has been reviewed is appropriate and within competitive range of the price for the same hours of work under offers received from recent AE Services procurements, contract HQ0034-12-D-0011, Task Order 0003, Utilities Master Plan. Also, the labor rates proposed for this effort are in line with this current AE contract rates. The Independent Government Estimate (IGE) for the modification is approximately 67% of the AE's proposed hours and the $87,783 estimated is 48% lower than the Contractor proposed price. A review of the level of effort by the COR in comparison to the effort proposed, the Government acknowledges that is under-estimated this additional requirement. Much of the Government's estimated effort did not take into account the level of detail required for the revised TMP, which includes 95 specific review comments received from Arlington county, the National Capital Planning Commission (NCPC) and the VA Department of Transportation, and estimated a total 180 hours to include both in the TMP and the South Parking concepts. Whereby the AE is required to redo their previous effort along with inserting the revised TMP and address all regulatory comments and update the Master Plan concepts to include the South Parking area. Taking this additional effort into account, the IGE used the revised rates, increased the labor effort for the update with a revised estimate of $179,000.00. Based upon this additional effort, the proposed price of 181,838.00 is determined fair and reasonable. If another contractor was awarded the work remaining on the Master Plan, they would need to review and verify the initial 83% master planning work, which would take at the minimum seven (7) months and cost an additional $660,000.00 to the Government. 9. Market Research: The hourly rates for the master planning services are similar and within completive range of the recently awarded AE Services Contract in the NCR (National Capitol Region-Northern Va., Maryland, and DC). While the new contractor is in place, it would not be practical to award a new Task Order for the remaining 17% of remaining AE Services. If another contractor was awarded the work remaining on the Master Plan, the new contractor would need to review and verify the initial 83% master planning work, which would take at the minimum seven months and cost an additional $660,000.00 to the Government. WHS has paid $989,104.00 to date for the Pentagon Reservation Master Planning Services for the three reports: Pentagon Reservation Master Plan; Pentagon Reservation Master Plan Environmental Assessment; and Pentagon Reservation Transportation Management Plan. Many hours of meeting discussions would need to be repeated with Pentagon stakeholders to orientate a new AE to the Pentagon Reservation master plan issues and regulations, which are specific to the National Capital Area. In accordance with 10 U.S.C. 2304, as implemented by FAR 6.302-19a)(2)(iii)(iii), these factors combined, and for the reasons outlined above, cause the current contractor SBA/HSMM to be the only AE able to provide the completion of the master planning services.
