- THIS IS NOT A SOLICITATION. THIS NOTICE IS FOR INFORMATION PURPOSES ONLY. This is a notice of intent to award a sole source award by the National Institute of Standards and Technology (NIST) under the authority of Federal Acquisition Regulation (FAR) 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements to: Zayo Group, LLC 400 Centennial Pkwy Ste 200, CO 80027-1210 for the lease and maintenance of Fiber optic cable path. The North American Industry Classification System (NAICS) code for this acquisition is 517110 Wireless Telecommunications Carriers (Except Satellite), and the size standard is 1500 employees. ZAYO operates an optic fiber cable infrastructure in the Washington metropolitan area. NIST previously acquired a physical connection from the NIST Administration Building into the ZAYO (previously FiberGate) cable infrastructure and activated a 1-pair fiber connection to University of Maryland, College Park (UMCP). The procurement is being issued to pay for the monthly usage charges of that optic fiber connection to UMCP. Since the optic fiber connection is delivered through the ZAYO cable infrastructure, ZAYO must be paid directly for usage charges and is thus the sole source for this procurement. Utilizing any other telecommunications service provider to provide the maintenance service of existing optic fiber connection is not possible as part of the physical fiber is owned by ZAYO and no one but ZAYO can access the fiber infrastructure Utilizing fiber cable infrastructure owned by other telecommunication service providers is not cost effective as this would require NIST procuring and installing a new optic fiber link from the NIST Administration Building to the closest fiber infrastructure of the new provider, and discarding the current optic fiber link owned by NIST. This is not only costly but time consuming as a permit needs to be granted by the county. A determination to compete this procurement based on a response to this notice is solely within the discretion of the Government. Interested parties who believe they possess the capability to satisfy this requirement should submit documentation that clearly demonstrates their ability to provide services needed by the NIST. Responses to this notice shall be received no later than noon Eastern Time July 23, 2014. All responses must be in writing and are to be sent via email to abdul-kudus.yahaya@nist.gov. NOTHING HEREIN SHOULD BE MISCONSTRUED AS A REQUEST FOR COMPETITIVE PROPOSALS, QUOTES OR BIDS. NO SOLICITATION DOCUMENT IS AVAILABLE NOR IS INTENDED TO BE ISSUED.
