Addendum #1 to HDEC05-14-T-0026 Combined Synopsis/Solicitation Notice Direct Thermal Print Labels for Defense Commissary Agency (DeCA) Commissaries. Addendum 1 Solicitation Number: HDEC05-14-T-0026 Response Date: Thursday, July 31, 2014, 4:00 p.m. EDST POC: Jason M. Quotes are due no later than Thursday, July 31, 2014, 4:00 p.m. EDST. The following includes answers to questions submitted for solicitation HDEC05-14-T-0026 for Direct Thermal Print Labels. Note: Some questions submitted seek interpretations of clauses. This office has no authority to interpret or change legal statutes. If there is a dispute, the contractor cannot use the verbiage of DeCA's answers to argue against what is required by law. Q1. The contract type is a firm fix price. Does this mean that there is no Economic Price Adjustment allowed after award? A1: No Economic Price Adjustment will be allowed after award. Q2: When prices are submitted in Attachment A, although I don't see it, but do you want a cost breakdown of the proposed price, such as showing shipping cost plus product price? A2: As the Quote Sheet states, "The cost of shipping must be included in the quoted label price." No cost breakdown is required. Q3: The solicitation states it is FOB Destination CONUS including Alaska, Hawaii, Puerto Rico, and Pacific Theater. If I understood correct, when it comes to shipping to the Pacific Theater, the contractor is responsible to shipping to Stockton, CA, and for shipping to Puerto Rico, the contractor is responsible to ship items to Norfolk, VA. Correct? A3: That is correct. Shipments to Pacific Theater locations will go to Stockton, CA (Coastal Pacific Food Distributors, Inc.), and shipments to Puerto Rico, will ship to Norfolk, VA (MDV SpartanNash Company). These are considered "Points of Embarkation." Q4: Other than Puerto Rico and the Pacific Theater, the contractor must ship directly to final address within the task order correct? A4: Yes, shipments will go directly to the store. Shipping addresses may change, and so the address will be provided at time of order by the ordering individual. The addresses provided on Attachment C were correct at the time the solicitation was prepared, however, the contractor should not rely on those addresses for shipping as orders are placed. Q5: To clarify, the award is for complete award, not partial correct? Such as, the contractor must deliver on all products from Attachment A. A5: Yes, all labels must be quoted for delivery to all locations in order to be considered for award. No partials will be accepted. As the solicitation states, "Please note that quotes for all labels must be provided to be considered for award." Q6: In regards to subcontracting, aside from the clauses incorporated under part "xii" (p. 11-12), there are no other subcontractor clauses correct? A6: All Provisions and Clauses are provided in the solicitation whether incorporated by reference or in full text. Please see 52.252-1 and 52.252-2 for reference links for those incorporated by reference. Q7: Per clause 252.244-7000, the contractor is not required to flow-down DFAR clauses, but is the contractor responsible to flow-down FAR clauses? If so, is it the clauses where only subcontractors are referenced? A7: FAR Clauses listed in paragraph (b)(1) of 52.212-5 (Dev) must be flowed down to all subcontractors for commercial items if they are otherwise required by the solicitation or resultant contract. Q8: Per clause 52.204-4500 (p.13), the contractor is responsible for installation procedures. For this contract, is the contractor required to go onsite? If so, how often? A8: Contractors are required to manage delivery the products to the address listed on the order. Contractors may to deliver shipments directly or use another form of delivery (common carrier, shipping company, USPS, etc). Q9: Can you please clarify clause 52.216-19. (p.14-15) Paragraph B states contractor is not obligated to honor single item over $5,000 or combination of items in excess of $25,000, but paragraph d states the contractor shall honor any order exceeding the maximum order limitations in paragraph b.... I am confused by the statements and find them contradicting each other. Can you please clarify. A9: If the order is greater than the amounts in paragraph b, and the contractor chooses not to fulfill the order, then the contractor must inform the ordering office in writing of its intention not to ship the order within 3 days. Otherwise the contractor must fill the order according to the contract.
