- Introduction: THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institutes of Health (NIH), National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA), on behalf of the National Institute of Biomedical Imaging and Bioengineering (NIBIB) intends to negotiate and award a purchase order on a sole source noncompetitive basis to Gatan Inc., 5794 West Las Positas Boulevard, Pleasanton, CA, 94588-4083 to provide maintenance services for the Gatan Inc. 3View System and replacement BSED sensor. Procurement: 1. Preventive Maintenance Plan for 12 months that will include the following: a. Unlimited telephone support b. No charge for replacement parts c. Discounts on spares and certain consumable parts d. An annual preventative maintenance session that includes: i. Repair ii. Maintenance iii. Calibration 2. Replacement BSED sensor Background: The National Institute of Biomedical Imaging and Bioengineering (NIBIB) aims to improve health by leading the development and accelerating the application of biomedical technologies. NIBIB supports research and development of new biomedical imaging and bioengineering techniques and devices to fundamentally improve the detection, treatment, and prevention of disease; enhancing existing imaging and bioengineering modalities; supporting related research in the physical and mathematical sciences; encouraging research and development in multidisciplinary areas; supporting studies to assess the effectiveness and outcomes of new biologics, materials, processes, devices, and procedures; developing technologies for early disease detection and assessment of health status; and developing advanced imaging and engineering techniques for conducting biomedical research at multiple scales. The Biomedical Engineering and Physical Science (BEPS) shared resource supports NIH's intramural basic and clinical scientists on applications of engineering, physics, imaging, measurement and analysis. BEPS is centrally located on the main NIH campus, and provides expertise that spans technologies ranging in scale from near-atomic resolution to intact organisms. Researchers across the NIH are using the Gatan 3View serial block face (SBF) imaging system in NIBIB's BEPS Shared Resource to study the three-dimensional structure of cells and tissues. The (SBF) imaging system includes an ultramicrotome built into the specimen chamber of a scanning electron microscope. Purpose and Objective: The purpose of this procurement is to provide maintenance services for the Gatan 3View system. It is essential for the sophisticated Gatan 3View system to be maintained at a high level of performance for optimal research results for many of the NIH institutes and centers using this equipment. A replacement BSED sensor will also be procured. Anticipated Period of Performance: 12 months after award. Replacement BSED sensor will be delivered 30 days after receipt of order. Justification: The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10-Market Research. 1. The service engineers from the Gatan Inc., are the only personnel, who are sufficiently knowledgeable about the 3View Serial Block Face Imaging System, to be capable of diagnosing and repairing problems. The 3View system, which is a digitally controlled instrument, requires that the engineers be familiar with its software as well as its hardware, including the built-in high-efficiency backscattered electron detector. 2. To obtain the high performance that is needed to obtain high quality data for research, it is essential that a number of complex sub-systems operate together including: a. The diamond knife assembly for the 3View ultramicrotome, b. The high-efficiency backscattered electron detector, c. Digital image acquisition controls, and d. Software programs for analyzing the resulting large-scale 3D data sets. Only the service engineers from Gatan Inc., have access to this highly specialized knowledge, as well as access to factory parts that are needed for repair of problems. 3. Only Gatan Inc., service engineers are capable of performing the difficult task of installing delicate components of the built-in ultramicrotome and the high-efficiency backscattered electron detector. Regulatory Authority: This acquisition is conducted under the authority of 41 U.S.C. 253(c) as set forth in FAR Part 13.106-1 (b) (1), Soliciting from a single source not exceeding the simplified acquisition threshold, and is exempt from the requirements of FAR Part 6, Competition Requirements. Additional Information: Industry Classification (NAICS) Code is 811219, Other Electronic and Precision Equipment Repair and Maintenance and the Small Business Size Standard is $19.0M. This acquisition is conducted under the procedures as prescribed in FAR subpart 12-Acquisition of Commercial Items and FAR subpart 13-Simplified Acquisition Procedures. The solicitation document, the incorporated provisions and clauses are those in the Federal Acquisition Circular 2005-74, effective July 1, 2014. The determination by the Government to award a purchase order on a sole source noncompetitive basis for maintenance services for the Gatan Inc. 3View System and replacement BSED sensor to Gatan Inc., 5794 West Las Positas Boulevard, Pleasanton, CA, 94588-4083., is based upon the market research conducted in accordance with one or more of the techniques specified in FAR Part 10-Market Research, Subpart 10.002(b)(2). This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by July 23, 2014 at 12:00 p.m. EST.
