DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: The Department of Veterans Affairs,NCO 6, Durham VA Medical Center intends to execute a Justification for Other than Full and Open Competition for purchase request 558-14-4-074-8735. 2.Nature and/or Description of the Action Being Processed: This is a request for other than full and open competition for the procurement of atherectomy coronary 1.25mm diamondback 360. This is a firm fixed price purchase order to Cardiovascular System. 3.Description of SUpplles/Servlces Reauired to Meet the Acency's Needs: Request procurement of diamondback 360 coronary orbital atherectomy system. The estimated cost is $37950.00. 4.Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( x ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization,Engineering,Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (appllcablllty of authority:. The diamondback 360 is a trademark of cardiovascular systems.The Cardiovascular Systems, Inc. (CSI) DIAMONDBACK 360 Coronary OrbitalAtherectomy System (OAS) is a catheter-based system designed for facilitating stentdelivery in patients with coronary artery lesions. The OAS consists of the hand-held CSI DIAMONDBACK 360 Coronary Orbital Atherectomy Device (OAD), the CSI Saline Infusion Pump (OAS pump), the CSI VIPERWIRE Advance Coronary Guide Wire (VIPERWIRE guide wire}, and the CSI VIPERSLIDE Lubricant. The OAS reduces coronary plaque on the vessel wall by using a rotating, diamond-coated crown, within coronary arteries, in order to facilitate stent delivery. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Cardiovascular systems is the only vendor that can be provide this product. Cardiovascular systems is a small business and currently have no distributors. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government willbe Fair and Reasonable: The estimated cost to the Government is $37950.00. There has been no increase in the price offered to the government, so the contractingofficer determined it to be fair and reasonable. 8.Description of the Market Research Conducted and the Results. or a Statement of the Reasons Market Research Was Not Conducted: Market research conducted by the Contracting Officer it was determined that no other sources could be identified. Cardiovacular systems is the only source available to provide this product. 9.Any Other Facts Supportingthe Use of Other than Fulland Open Compet tion: All facts supporting this proposed action are included in this Justification and Approval for Other than Full and Open Competition. 10.li stin g of Sources that Expressed. i n Writing.anI nterest i nthe Acaulsltion: Cardiovascular systems. 11.A Statement of the Actions. If any, the Agency May Take to Remove or overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The Agency will continue to monitor the market incase other sources become available. 12.
