- Data Requirements Notice of Intent to award a Sole Source Procurement in accordance with FAR 15 and FAR 6.302-1(a) (2) (ii), only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. AUTHORITY: 10 U.S.C. 2304(c)(1), JUSTIFICATION: SUPPLIES REQUIRED ARE FROM ONLY ONE OR A LIMITED NUMBER OF RESPONSIBLE SOURCE(S) AND NO OTHER TYPE OF SUPPLIES WILL SATISFY AGENCY REQUIREMENTS. THE PROPOSED CONTRACT ACTION IS FOR SUPPLIES AND SERVICES FOR WHICH THE GOVERNMENT INTENDS TO SOLICIT AND NEGOTIATE WITH ONLY ONE, OR A LIMITED NUMBER OF SOURCES UNDER THE AUTHORITY OF FAR 6.302-1. INTERESTED PERSONS MAY IDENTIFY THEIR INTEREST AND CAPABILITY TO RESPOND TO THE REQUIREMENT OR SUBMIT PROPOSALS. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. HOWEVER, ALL PROPOSALS RECEIVED PRIOR TO THE CLOSING DATE ON THE SOLICITATION WILL BE CONSIDERED BY THE GOVERNMENT. A DETEMINATION BY THE GOVERNMENT NOT TO COMPETE THIS PROPOSED CONTRACT BASED UPON RESPONSES TO THIS NOTICE IS SOLEY WITHIN THE DISCRETION OF THE GOVERNMENT. INFORMATION RECEIVED WILL NORMALLY BE CONSIDERED SOLEY FOR THE PURPOSE OF DETERMINING WHETHER TO CONDUCT A COMPETITIVE PROCUREMENT. SPECIFICATIONS, PLANS, OR DRAWING RELATING TO THE PROCUREMENT DESCRIBED ARE INCOMPLETE OR NOT AVAILABLE AND CANNOT BE FURNISHED BY THE GOVERNMENT. THE GOVERNMENT DOES NOT OWN THE DATA OR RIGHTS TO THE DATA NEEDED TO PURCHASE THIS ITEM FROM ADDITIONAL SOURCES. The 309th CMXG at Hill AFB, Utah intends to award sole source procurement for 251ea forgings to manufacture NSN 1620-01-187-2986 the upper link assembly for the B-52 landing gear to: W. Pat Crow Forgings, Inc. 200 Luxton St, Fort Worth, TX 94790 The forgings, which are owned by W. Pat Crow is the only known certified manufacturer of the forging dies that are required to manufacture the Upper Link Assembly for the B-52 landing gear. The pricing arrangement and CLIN structure will be as follows: CLIN Part # QTY Price Ext. Price CLIN 0001 WPC DIE 1502 251 This notice of intent is not a request for competitive proposals. However the procuring office will consider any capability statements received by the closing date listed. Responses to this notice must show clear and convincing evidence that competition would be advantageous to the government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. The contractor must provide a capability statement showing they have access to the drawings and are able to manufacture the forgings according to the requirements listed in the attached Engineering Data Requirements. The government does not own and cannot provide any specifications, plans or drawings related to this procurement. Capability statements will be considered solely for the purpose of determining whether to conduct a competitive procurement, however, a determination by the Government not to compete the requirement based upon responses to this notice is solely within the discretion of the Government. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 05-73 29 May 20143 Be advised that all interested parties must be registered in the System for Award Management (SAM) Database in order to receive payment for products/services rendered to the Government as the result of an award. Payment terms are Net 30 days after government acceptance in Wide Area Workflow (WAWF). All payments are to be paid via the Internet through the Wide Area Workflow (WAWF) system. WAWF may be accessed at https://wawf.eb.mil. WAWF training may be accessed online at http://wawftraining.com. Payment information may be accessed using the DFAS website at https://www.dfas.mil. Your purchase order/contract number or invoice will be required to inquire status of your payment.
