Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracti ng Activity: Department of Veterans Affairs, VISN 6, Durham VA Medical Center plans to contract by means other than full and open competition for purchase request 558-14-3-315-0124. 2.Nature and/or Description of the Action Being Processed: This is a request for other than full and open competition for procurement of diagnostic microscopes specialty service at the Durham VAMC. This is a firm fixed priced purchase order. 3.Description of Supplies/Services Required to Meet the Agency's Needs: oSTK#: 000000-1217-760OPMI Pico Diagnostic Microscope consisting of an OPMI Pico with 5-step Magnification changer, integrated red-free and orange filters with quick change illumination system The total price was $63,184.50.Requirement needed now on 7-31-14. 4.Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (X) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This is an unusual and compelling urgency to procure the Zeiss diagnostic microscopes which is a special microscope for ENT used to see inside patient ears. The microscopes are critical for patient care and needed to be ordered on 7-31-14 to prevent further delay of patient care. These microscopes have to be exact because the Greenville Health Care clinic is mirroring Durham for conformity of equipment, for provider use, and for bio engineering for repairs. Metro Medical is able to deliver the items in a timely manner to meet the requirements. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: End User upgraded the requirement to unusual and compelling urgency on 7-31-14. Efforts were made to locate the exact items with a quick search on GSA Advantage site (no results) and online (no results). Since this requirement is an unusual and compelling urgency, no other efforts were made to solicit offers from other sources. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The price matches the IGE given from the end user. Therefore, the Contracting Officer hereby determined that the total price of $63,184.50 for two microscopes to be fair and reasonable to the Government. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Due to urgency, a quick market research was done through GSA Advantage and online by contracting officer which revealed no results. Metro Medical, the suggested source, is the only one responsible source found that can provide the diagnostic microscopes in a timely manner to prevent further delay in patient care. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: All facts supporting this proposed action are included in this Justification and Approval for Other than Full and Open Competition as outlined above. 10.Listing of Sources that Expressed, in Writing,an Interest in the Acquisition: Metro Medical. 11.A Statement of the Actions, i f any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: For future requirements and subsequent acquisitions of this type, in order to overcome any barriers to competition, market research will be used as a guide to determine whether or not the market for competition exists. The appropriate procurement strategy will then be determined and followed. 12.
