- The U.S Army Medical Research Acquisition Activity (USAMRAA) inteds to issue a limited source award for Anatomic Pathology Laboratory Information System (APLIS) Technology Refresh, Implementation and Training Support for Comprehensive Pathology (COPATH) Plus for the Defense Health Agency (DHA) to CERNER Corporation. Services include: Purchase of new hardware, software, and licensing for specified sites supporting CoPath M Deployment of the CoPath Plus product across the designated sites On-site engineering support to perform the application and system migrations and installations Training support for the AP user community Continued upgrades and/or updates to the licensed software products The period of performance for this effort will be one eighteen (18) month base period and one (1) three-month transition out period. CERNER Corporation is the only contractor that can provide proprietary services and equipment for the CoPath Plus system, due to the fact that CERNER has not licensed the resale right to maintain the CoPath Plus software to any other contractors. Any firm that believes it can provide the stated capability as outlined below Justification and Approval are invited to submit written notification to the Contract Specialist NLT 21 August 2014 at 12PM ET. Supporting evidence must be furnished in sufficient detail to demonstrate the firm's ability to provide the stated capability. Information should be sent electronically to Courtney Greene, Contract Specialist, at courtney.l.greene3.civ@mail.mil. No telephone requests will be accepted. Responses received will be evaluated; however; a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. If no responses are received, USAMRAA will proceed with the limited sources contract. Justification and Approval for Other Than Full and Open Competition: Approval is being requested for a new contract for Anatomic Pathology Laboratory Information System (APLIS) Technology Refresh, Implementation and Training Support for Comprehensive Pathology (COPATH) Plus. This will be a sole source contract to CERNER Corporation. Reason for Authority Cited: From FAR 6.303-1(a). Market research was conducted which revealed that CERNER Corporation is the only contractor that can provide proprietary services and equipment for the Comprehensive Pathology (CoPath) Plus system, due to the fact that CERNER has not licensed the right to maintain the CoPath M or CoPath Plus software to any other contractors. The proposed contractor for this action, CERNER, has certified that: (a) CERNER has not granted any third party maintenance and support contractor any license or right to use or access the proprietary CoPath source code for any purpose or use, including, without limitation, for engineering development of software updates, changes necessary to correct software problems, produce software enhancements or implement critical IA security software changes; (b) CERNER does not permit any third party access to the dedicated DOD maintenance and support enclave at CERNER's headquarters nor has it granted others the right to use any of the equipment located in the enclave, which is required to be maintained to comply with requirements for the CoPath Approval to Operate certificate pursuant to DIACAP; (c) does not make available to any third party CERNER's proprietary maintenance and software needed for the continuous monitoring and maintenance of the CoPath Systems; and (d) CERNER has not licensed or granted to any third party any other right to provide maintenance and support services for the proprietary CoPath software or data acquisition systems.
