- A. GENERAL: This is a combined synopsis/solicitation for commercial items in accordance with FAR Part 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will NOT be issued. This solicitation WILL result in a multiple award Indefinite Delivery Indefinite Quantity (IDIQ) contract on a Firm-Fixed price basis. Reference quote number VA248-14-Q-1644. This solicitation incorporates provisions and clauses are those in effect through Federal Acquisition Circular 2005-76, effective July 25, 2014. This is a FAR Part 13.5 purchase and is totally set aside for small business in accordance with FAR 52.219-6. Applicable NAICS Code is 623220 and the size standard is 15.0M. The government anticipates on award of a firm fixed price award as a result of this action using FAR 15.101-2 Lowest Price Technically Acceptable Source Selection Process. The contractor shall possess all licenses, accreditations and certificates as required by local, state and federal law. The contract period will consist of a base period of one (1) year with 4 option years. Offers will be considered from all responsive, responsible Small Business offerors as determined by the Contracting Officer in accordance with FAR 9.104. The offeror is responsible for downloading all amendments and other documents from the FBO website without further notices from the Department of Veterans Affairs, Orlando VA Medical Center. Interested firms must be registered in the System for Award Management (SAM) at www.sam.gov. All questions must be submitted in writing to the Contracting Officer via e-mail to marie.smith4@va.gov. No telephone inquiries will be accepted. Proposals shall be submitted by 22 August 2014 at 4:00 pm (EST) either by mail or hand carried to Orlando VA Medical Center Contracting Office, Room 101, 2500 S. Lakemont Avenue Orlando Fl 32814. Offeror's must bid on all Contract Line Item Numbers (CLIN). Evaluation for award purposes will be based on the sum. Failure to submit a price for each CLIN may cause the bid to be found non-responsive and rejected. Evaluation - Commercial Items Evaluation for award shall be Lowest-Price "Technically" Acceptable. The Government reserves the right to award the contract based on initial offers received, without discussions or negotiations of such offers. Therefore, it is important that each offer fully address the requirements stated in this combined solicitation. Evaluation factors are as follows: Lowest Price Technically Acceptable Options - The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. The offeror's initial proposal should contain the offeror's best terms from a price standpoint. Offerors are cautioned to submit sufficient information and in the format specified in the proposal instructions. Offerors may be contacted to resolve minor or clerical errors and the Contracting Officer reserves the right to award without further conversations. Period of Performance: The period of performance is expected to be September 1, 2014 through August 31, 2014 with 4 options (Options will be exercised at the discretion of the government). The government intends to award several contracts as a result of this RFQ that will include the terms and conditions set forth herein. C. STATEMENT OF WORK: 1. Title of Project: Community-based Residential Treatment for Veterans 2. Scope of Work: The Contractor shall be responsible for providing residential treatment to Veterans with various addiction and psychological issues. The services will be furnished to beneficiaries for whom such care is specifically authorized by the Department of Veterans Affairs, Orlando VA Healthcare System located at 5201 Raymond Street, Orlando Florida 32803, 13800 Veterans Way, Orlando, Florida 32827 and its clinics. 3. Type of Contract: This will be a firm-fixed price contract. Period of performance will be from the date of award through twelve (12) months, with four (4)-option year periods. Option year period of performance will be from date of award through twelve (12) months. Options are exercised at the discretion of the Government. 4. General Requirements: The Contractor shall be responsible for providing residential treatment to Veterans with the following presenting problems: substance abuse, psychotic disorders, bipolar disorders, obsessive-compulsive disorders, major depression, other mood disorders, anxiety disorders, post-traumatic stress disorder, homelessness, justice involvement, and other various psychosocial issues. The services will be furnished to beneficiaries for whom such care is specifically authorized by the Department of Veterans Affairs, Orlando VA Healthcare System. A Liaison will be appointed by the Orlando VA Healthcare System to authorize services. The type of Veterans to be cared for under this contract will normally require care and services above the level of meals, room and board. When relevant care will include, but not be limited to: (a) Supervised alcohol and drug free environment (b) Active affiliation with community support groups (c) Structured and group activities (d) Healthy physical activities (e) Individual counseling (f) Group counseling (g) Family involvement (h) Assistance with housing resources (i) Coordination with legal systems (j) Case management, as required It is further agreed that beneficiaries receiving care under this contract will receive basic health and personal hygiene maintenance, monitoring of medications, and any other service or supplies normally provided in a residential treatment setting. The rate established will be an all-inclusive rate. Length of stay at the facility will be initially authorized for up to 60 days. The contractor may not be provided compensation for a period in excess on that stated in the length of treatment contracted unless such extension of the authorization is provided in writing by the Contracting Officer Representative or authorized social worker/representative from the Orlando VA Healthcare System. Upon award of the contract, the VA will provide a list of authorized personnel who has the authority to authorize the extension of the veterans at the facilities. 5. Contractor Experience Requirements: Contractors under this program must meet the following VA standards, based on regulations promulgated by Title 38 Code of Federal Regulations (CFR) Section 17.53b: (a) Facility must meet the following: 1. The standards of the Life Safety Code (National Fire Protection Association (NFPA) #101) 2. The fire and safety code imposed by the State law 3. City, State, and Federal requirements concerning licensing and health codes. (b) Licenses and Accreditation: 1. All residential treatment settings must be licensed as required for the particular setting under State and Federal authority. 2. Accreditation and Licensing. Accreditation by The Joint Commission (TJC) and/or the Commission on Accreditation of Rehabilitation Facilities (CARF) is evidence of internal quality assurance mechanisms and is desirable, but is not required. Where applicable, the residential treatment setting must have a current occupancy permit issued by the authority having jurisdiction. 3. Privacy Act. The notification and contract clauses entitled "Privacy Act Notification," as specified in Federal Acquisition Regulations (FAR) 52.224-1 and 52.224-2, is incorporated into this contract. (c) Staff: Sufficient staff must be provided (i.e., in numbers and position qualifications) to carry out the policies, responsibilities, and therapeutic activities of the residential treatment program. The contractor shall identify, by name, the key management and technical personnel who will work under this contract with the Orlando VA Medical Center representatives at the time the work is being negotiated. The contractor will submit a listing of names, position and telephone numbers of all personnel. In the event a key person on the list becomes unavailable, it is the contractor's responsibility to inform the Contracting Officer Representative (COR) immediately so that there will be no lapse of communication. 6. Specific Mandatory Tasks and Associated Deliverables: a.Services: 1. All Veterans shall be provided clean, safe, and sanitary housing. Each occupant shall be provided one single bed, storage space, and one dresser with at least two drawers. All Veterans will have access to indoor and outdoor recreational and lounging areas. 2. Veteran dietary needs shall be met in accordance with sound medical care and shall include the following: (a) At least three (3) nutritious meals served daily at regular times with no more than a fourteen (14) hour span between evening and breakfast of the following day. Between-meal or bedtime snacks of nourishing quality shall be offered. (b) Food must be prepared, served, and stored under sanitary conditions. (c) Sanitary procedures established and maintained for washing dishes, cleaning equipment and work areas, and proper waste disposal. 3. The contractor shall provide laundry facilities and laundry detergent, at no cost to the Veteran. 4. The contractor shall maintain a participant handbook that includes program guidelines and a grievance policy. At the time of admission, each Veteran shall be provided a copy of the program handbook. The grievance procedure shall be posted and remain available to Veterans. 5. The contractor shall provide therapeutic and rehabilitative services that include the following: (a) The contractor shall provide structured activities that include Veteran participation in group sessions, individual sessions, and other clinical interventions. Individualized treatment goals and interventions will be based on a combination of Veteran input and recommendations of clinical staff. VA staff may also participate in treatment planning. (b) The contractor shall provide a variety of group activities, including healthy recreational and leisure activities, healthy physical activities, and participation in community events. (c) The contractor shall address health and personal hygiene maintenance. (d) Medications including controlled substances shall be properly stored and controlled. All medications will be self-administered by the Veteran resident as prescribed. (e) Case management services shall be integrated along with clinical treatment provided. The contractor will collaborate with community and VA programs as needed. Issues such as housing, economic stability, justice involvement, support networks, community resources, and other relevant areas will be addressed throughout the course of treatment. (f) The contractor shall provide professional counseling as required, including emphasis on self-care skills, adaptive coping skills and, as appropriate, vocational counseling. Counseling services shall be in collaboration with VA programs and/or community resources. Evidence based practices shall be utilized. (g) The contractor shall provide opportunities for learning and/or development of healthy living with a goal of achieving a more adaptive level of psychosocial functioning. (h) The contractor shall provide transportation to VA appointments and other community agencies when appropriate. This includes VA clinic locations in Orange, Osceola, Seminole, and Lake, Brevard, and Volusia counties. The contractor will work with the Orlando VAMC Liaison or designee to coordinate VA services. (i) The contractor is the primary agency responsible for discharge planning. Discharge planning shall begin upon admission. Discharge planning shall address and coordinate appropriate follow up services, housing needs, economic stability, support networks, and other relevant needs of the Veteran. The contractor will attempt, and document, follow up with Veterans that unexpectedly leave the program. b.Medical Records and Reports: (1) An individual clinical record will be developed with the assistance of the VA staff and maintained by the residential treatment staff on each Veteran placed under this contract. (2) The contractor must comply with the requirements of the "Confidentiality of Certain Medical Records" (38 U.S.C. 7332), and the "Confidentiality of Alcohol and Drug Abuse Patients Records" (42 CFR, Part II) when appropriate, and shall be part of the contract. (3) All case records will be maintained with such security and confidentiality as required, and will be made available on a need-to-know basis to appropriate VA staff members involved with the treatment program of the Veterans concerned. (4) The clinical record maintained by the contractor treatment program will include: (1) Reasons for referral; (2) Essential identifying data relevant to the Veteran and Veteran's family; (3) Data relating to the Veteran's admission to include the targeted individual goals for constructive changes which are to be attained during the Veteran's stay at the residential treatment setting; (4) Record or log of medical prescriptions issued by physicians; (5) Reports of periodic re-evaluation by program staff, to include any measures of movement toward rehabilitation goals. (6) Discharge summaries on each Veteran who leaves the program to include a description of beneficial changes realized during the residential period, reasons for leaving, the Veteran's future plans, housing status and if possible, follow-up locator information. (7) Treatment plan and treatment plan reviews. When requested, the contractor will provide copies of each Veteran's treatment plan/review to the VA medical center. (8) It is agreed that the VA may readily have access to all medical records concerning the Veteran's care with the contractor. Upon discharge or death of the Veteran, medical records on all VA beneficiaries will be retained by the contractor for a period of at least five years following termination of care. c. Staffing: (1) Sufficient staff must be provided (i.e., in numbers and position qualifications) to carry out the policies, responsibilities, and therapeutic activities of the residential treatment program. (2) In residential treatment settings there must be, at a minimum, a full-time staff member or designee available for emergencies 24-hours-a-day, 7-days-a-week. (3) In those instances where a supervised residential setting is linked to a geographically distinct rehabilitation and/or socialization day program, sufficient staff must be provided to staff the necessary therapeutic activities to ensure a meaningful integration of these efforts with those provided in the residential setting. d. General: (1) In the event a beneficiary receiving residential treatment under this contract dies, the contractor will promptly notify Orlando VA Healthcare System office authorizing admission and immediately assemble, inventory and safeguard the Veteran's personal effects. The funds, deposits, and effects left on the premises by Orlando VA Medical Center Veteran shall be delivered by the contractor to the person or persons entitled thereto under the laws currently governing the Veterans, unless the beneficiary died without leaving a will, heirs, or next of kin capable of inheriting. When disposition has been made, the itemized inventory with a notation as to the disposition of the funds and effects will be immediately forwarded to the Orlando VA Medical Center Liaison or designated point of contact. Should a deceased leave no will, heirs, or next of kin his personal property and funds wherever located vests in and becomes the property of the United States in trust. In these cases the contractor will forward an inventory of any such property and funds in its possession to the appropriate Department of Veterans Affairs office and will hold them (except articles of clothing necessary for proper burial) under safeguard until instructions are received from the Department of Veterans Affairs concerning disposition. (2) It is agreed that the contractor will notify the Orlando VA Medical Center immediately when a medical emergency requiring hospitalization occurs. It is agreed that the Veterans will be admitted to an appropriate VA facility. When such admission is not feasible because of the nature of the emergency, it is agreed that hospitalization in a non-Federal hospital may be accomplished provided VA authorization is obtained. If hospitalization of a non-emergency nature is required, it is agreed that admission to the VA hospital will be accomplished promptly. (3) The contractor agrees and warrants that it does not maintain nor provide dual or segregated patient facilities, which are segregated on the basis of race, creed, color or National origin. The contractor may neither require such segregated use by written or oral policies nor tolerate such use by local custom. The term facilities shall include but not be limited to rooms, wards, sections, eating areas, drinking fountains, entrances, etc. It is agreed that the Department of Veterans Affairs will have the right of access to the center and all appurtenances by an authorized representative(s) designated by the Department of Veterans Affairs, to determine whether acceptable standards are maintained and adequate care is being rendered. (4) The contractor agrees to accept referral of and to provide all services specified in this contract for any person determined eligible by the Orlando VA Medical Center Liaison or designee, regardless of the race, color, religion, sex or national origin of the person for whom such services are ordered. e. Payments: (1) Per Diem will generally be paid for the day of admission or the day of discharge from the program, but not for both. (2) Payment for residential treatment settings is made on a monthly basis, for services rendered. (3) Payments made by the Department of Veterans Affairs under this contract will constitute the total cost of residential care. The contractor agrees that no additional charges will be billed to the beneficiary or his family, either by the residential treatment center or any third party furnishing services or supplies required for such care. (4) If a beneficiary is admitted to and discharged in the same calendar day, payment will be made for one day. (5) Should a Veteran referred to a residential care setting be absent in an unauthorized manner, payment for services for that Veteran to the contractor may be continued for a period of 2 days, provided there is an active outreach attempt on the part of the residential treatment setting staff to return the Veteran to the contracted residential treatment program and strong likelihood that the Veteran will return. (6) Absences of the Veteran from the contractor in excess of 48 hours will not be reimbursable except with the prior approval of the Orlando VA Medical Center Liaison or designated point of contact. 7. Changes to Statement of Work: Any changes to this Statement of Work (SOW) shall be authorized and approved only through written correspondence from the Contracting Officer (CO). A copy of each change will be kept in a project folder along with all other products of the project. Costs incurred by the contractor through the actions of parties other than the CO shall be borne by the contractor. 8. Confidentiality and Nondisclosure: It is agreed that: (a) The preliminary and final deliverables, and all associated working papers, application source code, and other material deemed relevant by VA which have been generated by the contractor in the performance of this task order, are the exclusive property of the U.S. Government and shall be submitted to the CO at the conclusion of the task order. (b) The CO will be the sole authorized official to release, verbally or in writing, any data, draft deliverables, final deliverables, or any other written or printed materials pertaining to this task order. No information shall be released by the contractor. Any request for information relating to this task order, presented to the contractor, shall be submitted to the CO for response. (c) Press releases, marketing material, or any other printed or electronic documentation related to this project, shall not be publicized without the written approval of the CO. 9. Contractor Personnel Security Requirements: The Certification and Accreditation Authorization (C&A) requirements does not apply to this contract therefore the Security Accreditation Package is not required. 10. Contract award and Administration Date: (a) The Contracting Officer is the only person authorized to approve changes or modify any of the requirements under this contract. In the event the Contractor effects any such changes at the direction of any person other than the Contracting Officer, the change shall be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in costs incurred as a result thereof. (b) No contract will be awarded nor payment made to any individual or entity that appears on the Health and Human Services Office of Inspector General's (HSS/OIG) List of Excluded Individuals/Entities, or any other Government sponsored list that identifies Contractors as being ineligible for contract award(s). 11. Reviews: The Contracting Officer or designee is authorized to review by on-site survey, review of records, or by any other reasonable manner, the quality of services rendered under this contract. All records shall be subject to review by the CO or other designated representatives of the VA. Payments will be denied when such service does not support the charges or if the service is deemed not necessary or inappropriate. Such determinations shall be made by the CO or COR, whichever is appropriate. 12. Non-Personal Services Status: Award of this contract will result in a contractual arrangement only and shall not be construed as a personnel appointment with the VA. The services shall not constitute an employer/employee relationship. Payments to the Contractor shall be based on the provision of an end product or the accomplishment of a specific task. The Contractor will not be subject to Government supervision, but its efforts will be monitored for quality assurance. 13. Wage Determination: If this contract is subject to any wage determinations as set forth by the Department of Labor, the applicable wage determination is attached. 14. Confidentiality: The Contractor's personnel shall agree to comply with the Privacy Act of 1974 (the Act) and other applicable federal laws, rules, regulations and policies issued under the Act during and after the execution of this contract. Because confidential medical record information may be accessible and/or visible to Contractor employees during performance of their daily duties, the Contractor shall obtain a signed "confidentiality certificate" from each employee prior to allowing them to start work under this contract. Any information about an individual that is maintained by the VA, including, but not limited to, education, financial transactions, medical history, and criminal or employment history or any record that contains the person's name, or the identifying number, symbol, or other identifying particular assigned to the individual, shall be kept CONFIDENTIAL. A copy of this certification shall be provided to the COR upon request. 15. Health Insurance portability and Accountability (HIPPA): To be eligible for contract award, the contractor shall be in compliance with HIPPA. A Business Associate Agreement (BAA) shall be executed if determined applicable. 16. Alcohol and Illegal Drug Use: Contractor employees shall not consume alcohol or illegal drugs during working hours or at any other time the employees are performing work under this PWS. The Contractor shall not allow any employee to perform work if the employee is under the influence of alcohol or illegal drugs. Employees found to be under the influence of alcohol or illegal drugs during working hours will be immediately removed from duty. For purposes of this provision, the threshold for being under the influence of alcohol or illegal drugs is the same as that established by current laws for vehicle operations. The Contractor is responsible for establishing the methods by which employees will be determined to be under the influence of alcohol or illegal drugs. 17. E. QUALITY ASSURANCE SURVEILLANCE PLAN (QASP): Commercial Services Contract: Community Based Residential Treatment for Veterans PURPOSE. This QASP is a Government developed document used to ensure that the Government receives quality services, and pays only for services actually provided. The QASP provides a systematic method to evaluate the services the Contractor is required to furnish. 1.SCOPE. The role of Government Quality Assurance is to ensure contract standards are achieved. The QASP provides guidelines and methods for the Government's oversight of the Contractor's quality control efforts to assure timely, effective services are provided IAW the contract order. The Contractor, and not the Government, is responsible for management and quality control actions to meet the terms of the contract. 2.ROLES AND RESPONSIBILITIES. Contracting Officer (CO) - A person duly appointed with the authority to enter into, administer and terminate contracts on behalf of the Government. The CO is the only person who can legally commit the Government and only the CO, as the Government's agent, can modify the contract/order. The CO is the final authority for determining the adequacy of the Contractor's performance. CO decisions arising under or relating to the contact are final. Contracting Officer's Representative (COR) - An individual designated in writing by the CO to perform specific technical and administrative functions within the scope and limitations of their written appointment (e.g., surveillance of Contractor's performance, accept services). The COR is not empowered to make any contractual commitments or authorize any changes to the order/contract or in any way obligate additional funds by the Government; such authority' rests solely with the CO. Quality Assurance Evaluator (QAE) - An individual designated by the requiring, activity to assist the COR and provide technical oversight of the Contractor's performance. The QAE's primary duty is to monitor the Contractor's performance by physically checking to see that tasks are completed. reports are submitted, and desired outcomes are achieved. When a surveillance observation results in an unacceptable evaluation, the QAE will report the unacceptable performance to the COR. The QAE is not authorized to direct work, offer advice on how the work should be performed, change the contract, or in any way obligate payment of funds by the Government. 3.METHOD OF SURVEILLANCE. Simplified methods of surveillance will be used by the Government to evaluate contractor performance. The primary methods of surveillance are periodic assessments of service and customer feedback. Periodic Assessment of Services - For services that occur over a number of months, the COR will evaluate Contractor performance on a quarterly basis and upon completion of services. Generally, the Government will rely on the Contractor's Quality Control system to ensure that services conform to contract quality requirements before they are tendered to the Government for acceptance. Customer Feedback - Customer feedback is typically obtained via telephone or email. Telephonic customer complaints must be followed up in writing/email. To be considered valid, the customer complaint must clearly articulate the nature of the complaint, time, date, etc. The COR will investigate the complaint; if determined valid, the COR will advise the CO and the Contractor of the deficiency. Copies of valid complaints and the resolution must be retained in the official contract file. 4.SURVEILLANCE PROCEDURES. a.The COR/QAE will evaluate the Contractor's performance quarterly against Performance Standards established in the contract/order. Evaluations will be to the extent practical to assure the contractor provides quality services IAW the requirements of the contract. Evaluations could be evaluation, /validation of contractor supplied performance data, as well as analysis of Customer feedback, for performance trends and to ensure valid customer concerns are resolved timely. b.If at any time the COR/QAE receives indicators (e.g.. valid customer complaints or notes Performance Standards are not being met) that the Contractor's performance is less than acceptable, the COR/QAE will investigate to determine if this is a onetime issue that has been promptly corrected, or if the discrepancy is systemic in nature. If the issue is determined to be an isolated occurrence. the COR will continue with Quarterly Evaluations. If the issue is recurring and systemic in nature, the COR/QAE will perform more frequent evaluations. c.The COR/QAE will notify the Contractor each time an unacceptable observation has been recorded and ask the Contractor to correct the problem. The COR will record the contract requirement, the specific deficiency to the requirement, the date and time it was discovered, and have the Contractor initial the entry. The Contractor will be given two working days after notification to correct the deficiency in accordance with requirements of the contract. Deficiencies that cannot be corrected within two working days w ill be reported to the Contracting Officer. d.The COR/QAE will re-examine services that are found deficient. Failure to complete corrective actions will be reported immediately to the CO for further action. e.Upon satisfactory completion of the work, the COR/QAE will accept the services provided and authorize payment, by approving the Contractor's invoice in Wide Area Workflow. 6.SURVEILLANCE STANDARD. The Performance Standard set forth in the SOW and Line items is the standard the Contractor must meet for services to be deemed acceptable. Generally, under commercial services contracts, the Government is relying on the Contractor's assurances that the services conform to contract requirements. Consistent with FAR 52.212-4, Contract Terms and Conditions, (a) Inspection and Acceptance, the Contractor shall only tender for acceptance those services that conform to the requirements of the contract/order. The Government may require re-performance of nonconforming services at no increase in contract price. The Government reserves the right to refuse acceptance of nonconforming services. In no case shall the Government's right to inspect services under the inspection provisions of the contract be prejudiced. 7.QUALITY ASSURANCE SURVEILLANCE FILE. The COR/QAE file should contain: a) Copy of the COR appointment letter from the CO, any changes to that letter, and any termination letters; b) Training Certifications for COR; c) Copy of the contract and all contract modifications; d) Copy of the applicable Quality Assurance Surveillance Plan (QASP); e) Copy of the contractor's Quality Control Plan (QCP); f) All correspondence initiated by authorized representatives (Contractor or Government) concerning performance of the contract; g) Names, position titles and contact information of all key personnel assigned to this contract both Government and Contractor; h) Surveillance schedules; i) Surveillance Checklists; j) Records of all inspections performed and the results; k) Customer Feedback; 1) Memoranda for record of minutes of any meeting, telephone conversations and discussions with the contractor or others pertaining to the contract or contract performance; m) Documentation pertaining to acceptance of services, reports or data. 8.RECORDS: All records will be retained for the life of this contract. The COR/QAE will forward these records to the CO upon completion of the contract/order. 9.CHANGES: The QASP is a living document and, as such, may be changed as needed. However, the CO must approve changes. The COR will submit recommended changes to the CO for approval. ?
