- LIMITED-SOURCES JUSTIFICATION FOR FEDERAL SUPPLY SCHEDULE PROGRAM FAR 8.405-6(c) Requisition Number: Deleted Date: 07/28/2014 Estimated Contract Dollar Value: Deleted The following justification and approval for the use of sources limited to fewer than those required in FAR 8.405-1, prepared in accordance with Federal Acquisition Regulation (FAR) 8.405-6(c) FAR 8.405-2, and FAR 8.405-3 pursuant to the authority of 41 U.S.C. 251, and Limited Sources FAR 8.405-6(a)(1)(i)(C). The proposed work is a logical follow-on to an original Federal Supply Schedule order in that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures and the original order or Blanket Purchase Agreement (BPA) was not previously issued under sole-source or limited-sources procedures. This acquisition is conducted under the authority of the Multiple-Award Schedule Program (41 U.S.C. 251, et seq,and 40 U.S.C. 501). 1. Identification of the agency and the contracting activity. The U.S. Department of Justice, Federal Bureau of Investigation (FBI), Technology Support Contracts Unit (TSCU), proposes to enter into a contract on a basis of other than full and open competition for the FBI Criminal Justice Information Services (CJIS) Information Security Officer (ISO) Program on behalf of the CJIS Information Assurance Unit (CIAU)/Major Information Technology Programs Support (MITPS) Section. 2. Nature and/or description of the action being approved. The CJIS Division Information Security Officer (ISO) serves as the CJIS Division representative to Federal, State, Local and Tribal Law Enforcement agency customers on all matters pertaining to information security and manages the Division's ISO Program. In addition to security liaison activities, the CJIS ISO is the primary steward of the CJIS Security Policy and presents emerging security related topics to CJIS advisory boards, committees and working groups. This request is a logical follow-on to an original contract number J-FBI-08-230 awarded June 4, 2008 that was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The FBI intends on combining tasks associated with the CIAU ITSP services through a source selection process on the Enterprise Information Assurance and Cyber Security Services BPA. The Enterprise Information Assurance and Cyber Security Services (EIACSS) BPA is up for re-bid and is planned for award in the August/September, 2014 timeframe. The FBI intends to continue support services to the ISO Program until the combined task can be solicited through this BPA. A complete description of the supplies and/or services required to meet the agency's needs. The FBI CJIS Division is dedicated to providing high quality criminal justice information and investigative services to federal, state and local law enforcement and to criminal justice agencies worldwide. The CJIS Division's goal is to provide timely, accurate, and relevant criminal justice information to law enforcement, criminal justice, academic, and civilian agencies who are engaged in researching, planning, managing, administering, and enforcing criminal justice activities. The CJIS Division ISO program also provides daily support to the criminal justice and non-criminal justice community of criminal justice information users. This support is provided in various forms including, but not limited to, collaboration, training, technical analysis and assessments of proposed technical solutions, customer site visits, and briefings during user conferences. Performance for this task primarily takes place onsite at the FBI CJIS facility in Clarksburg, West Virginia. Specified travel and place of performance shall be Contiguous United States (CONUS). All personnel, assigned to support this task order are currently capable of obtaining a Top Secret Clearance, as required and current personnel provide expert advice and assistance in support of the FBI CJIS Division ISO Program's mission oriented business functions, per requirements [R#] as follows: (R1) Support the ISO Program through the continued maintenance of the CJIS Security policy (CSP). This effort includes collaboration with Federal, State, Local and Tribal law enforcement agencies including periodic meeting sessions with APB and Compact Council Committees; and present information security briefings at state and vendor conferences. (R2) Support the ISO Program with the concepts, development and delivery of Security Policy related topic papers and briefings to the various subcommittees and working groups of the CJIS Advisory Process Board (APB) along with committees of the Compact Council of States. (R3) Provide the ISO Program with research and analysis on industry best practices related to information technology security. (R4) Provide the ISO Program with comparative analysis of law enforcement technical security solutions and information security practices against the most current CJIS Security Policy. (R5) Support the ISO Program with the enhancement of the collaborative space on FBI.gov. (R6) Support the ISO Program through the development and implementation of creative training delivery. (R7) Provide ongoing daily support to the ISO Program as needed. Examples of daily support include but are not limited to: participation in routine teleconferences and meetings within and outside of CJIS; research and respond to various forms of communication received from internal and external customers; represent the ISO Program when the Government is unavailable. 4. The authority and supporting rationale (see 8.405-6(a)(1)(i) and (b)(1)) and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service. The statutory authority for using other than full and open competition is FAR 8.405-6(a)(1)(i)(C), Limited Sources. The proposed work is a logical follow-on to an original BPA, and the BPA was placed in accordance with Federal Supply Schedule procedures. The ISO Program Support Services was originally awarded to Battelle Memorial Institute in June, 2008. Battelle's staff has provided the FBI with exceptional work during the life of the contract. Upon contract end date, the ISO PSS task was submitted for re-bid in accordance with FSS procedures. Two proposals were submitted. The Government received two un-awardable quotes. The CIAU ITSP declined to go through another source selection for the individual task and has instead agreed to combine all tasks associated under the ITSP and solicit a new source selection under the EIACSS BPA in accordance with FSS procedures. As the CJIS Division ISO Program provides daily support to the criminal justice and non-criminal justice community this logical follow-on is instrumental in continuation of operations until a new contract can be awarded. Battelle Memorial Institute has been an integral part of the ISO Program successes and possesses extremely valuable knowledge in regards to the internal working of the Program, as well as, a unique understanding of our customers' needs. Contract resources under this task provide the following support to the ISO Program as referenced in the requirements of number 3: Responding to several hundred CSP related questions received each year; Continued maintenance of the CSP; Collaboration with Federal, State, Local and Tribal law enforcement agencies including periodic meeting sessions with the CSP Working Group; Development and delivery of security related topic papers and briefings to the various subcommittees and working groups of the CJIS APB along with committees of the Compact Council of States; Research and analysis on industry best practices related to information technology security; Comparative analysis of law enforcement technical security solutions and information security practices against the most current CSP; Enhancement of the collaborative space on FBI.gov; Development and implementation of relative training delivery. Due to the current federal staffing level restrictions, if this request is not granted, impact to the ISO Program operations would be substantial. The expertise of current contractor employees is invaluable to the success of customer service our external law enforcement partners have come to expect. 5. A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d). The Contracting Officer will evaluate the cost/price proposal for fair and reasonableness pursuant to FAR 8.405-2(d), Ordering Procedures for services requiring a statement of work. 6. A description of the market research conducted among schedule holders, and the results of the research. A statement must be made that the supplies and services are available from the FSS. As this effort was originally competed and two vendors submitted proposals market research shows that there are vendors who can perform this task, however as mentioned in Section 4 there were neither of those vendors were awardable and this task will be fully competed as stated in Section 8. 7. Any other facts supporting the limited source justification. There are no other factors 8. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made. At the end of the period-of-performance for the logical follow-on contract with Battelle Inc. the CJIS ISO Program anticipates combining all tasks associated with the CIAU ITSP and follow procedures for full and open competition for continuation of Services. The CIAU ITSP will be utilizing the EIACSS BPA as the contract vehicle. Deleted
