Attachment 2: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 4, VA Pittsburgh Medical Center. Biomedical Engineering has a requirement for a service contract for the Beckman Coulter DM96 Cellavision Analyzer described in requisition number 646-14-4-066-0687. This contract would be effective from September 1, 2014 through August 31, 2018. 2.Nature and/or Description of the Action Being Processed: This is a request for Other Than Full and Open Competition for service contract for the Beckman Coulter DM96 Cellavision Analyzer. The is for base year plus four (4) years. This is a new firm fixed price contract. 3.Description of Supplies/Services Required to Meet the Agency's Needs: A service contract for the Beckman Coulter DM96 Cellavision Analyzer is critical to patient care. Repair of this equipment is vital to hospital operations and if the repair is not completed timely the department will be unable to handle their current load of patients and impair healthcare delivery capabilities. 4.Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1. ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): A service contract is required for the Beckman Coulter DM96 Cellavision Blood Analyzer which is vital to hospital operations. This equipment is used by the Core Lab to automatically analyze slides for various aspects of fluid samples including platelet, red and white blood cell counts etc. The service must interface with existing equipment and be compatible in all aspects (form, fit and function), with systems presently installed/performing. This unit must operate in sync with similar Beckman Coulter units to operate at peak efficiency. The DM96 Cellavision has networking capabilities and this equipment is highly specialized and can share database with other CellaVision DM analyzers. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Intent to sole source will be publicized on FedBizOps. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: N/A 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The University Drive Biomedical Department has used several companies for similar maintenance requirements. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: A service contract for the Beckman Coulter DM96 Cellavision Analyzer is required to maintain the quality and quantity of healthcare delivery capabilities and patient care. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required.
