- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 04, Louis A Johnson VA Medical Center, Justification for Other Than Full and Open Competition 2.Nature and/or Description of the Action Being Processed: This is a request for other than full and open competition for the procurement of Radiopharmacy Products and Related Services. This will be a new straight five year contract, and the type of contract planned is a Firm Fixed Price IDIQ Contract with Economic Price Adjustment. The current contract ends on 09/30/2014. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Radiopharmaceuticals will be used for human administration during diagnostic nuclear medicine studies. The estimated value of this contract is $1,106,497.62 over five years. Year one Is estimated at $206,823.38, year two is estimated at $214,033.13, year three is estimated at $220,956.11, year four is estimated at $228,282.52, and year five is estimated at $236,402.49. The period of performance of this contract will be from 10/01/2014 to 09/30/2019. Orders are to be placed mid to late work day with the delivery required by 6:00 am the following work day. Due to the demands of the VA Medical Center (VAMC) requirements, there is to be no restrictions to the number of orders which may be placed or the number of deliveries which may be required per day. The contractor is required to make deliveries within two hours when orders are placed during normal business hours from 8:00 am to 4:30 pm Monday through Friday. Emergent studies require delivery within one hour from placement of the order. The contractor shall provide 24-hour on call services for emergent procedures. 4.Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Due to the unique radioactive components of this requirement, the radiopharmaceutical products begin to decay immediately. There are storage requirements for these products. For those reasons, a stock cannot be maintained. Products must be delivered on an as needed basis, completely dependent on workload. As workload changes throughout the day, products are delivered to support the changing workload. Deliveries may be made several times a day. For emergency requirements, products need to be on site within one hour as not to delay diagnosis/treatment of emergent situations. There are no other radiopharmacies capable of fulfilling the one hour requirement for emergent studies in the location of the Louis A Johnson VAMC. Accordingly, Pharmologic is the only firm capable of providing the supplies and services described In Section Ill above without the Veteran's Health Administration experiencing unacceptable delays in fulfilling its requirements. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A Sources Sought Notice was posted on 01/10/2014 (VA244-14-R-0304) by the contract specialist to Federal Business Opportunities (FBO) for 30 days. The content stated that we were looking for vendors capable of being a consistent and reliable source of radiopharmaceuticals from an accredited radiopharmacy capable of providing a 60 minutes or less delivery time for radiopharmaceuticals for emergency studies. NAICS Code used 325412 and size standard Is 750 employees. Three vendors where interested in the requirement: Caring Hands Health Care LLC. - This vendor could not meet our emergent studies requirement of one hour, Cardinal Health-Nuclear Pharmacy Services -This vendor could not meet our emergent studies requirement of one hour, and Pharmologic - which Is our current vendor that we intend to sole source this requirement. The Contracting Officers Representative (COR) also conducted Market Research. The COR reached out to a hot lab in Morgantown, WV, and after discussion was discovered that they were not capable of fulfilling the requirement due to lack of Items we require. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated price to the Government Is $1,106,497.62. This price is considered fair and reasonable based on past contract pricing and public pricing lists. The steps that will be taken to determine if the final contract pricing is fair and reasonable will be a comparison to the IGCE, past contract pricing, and verification of price lists. The vendor will submit official invoices providing pricing to other facilities so that we can determine fair and reasonable pricing. In the event of a price Increase or decrease to the schedule, the Economic Price Adjustment clause will be utilized in this contract to compensate for the volatility of the market and insure that the Government and vendor are receiving fair pricing. The vendor is to notify the government of any changes to the pricing schedule at the earliest possible time. Invoices will be certified and checked against the price schedule for accuracy. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: As described In Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties. The results of that Market Research show that the products and services required by the Louis A Johnson VAMC can be met and exist in the commercial items market. Due to the restrictive nature of the requirement that products shall be delivered within one hour of emergent studies. It has been determined that only one source is capable of fulfilling the requirement. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: The Louis A. Johnson VAMC located In Clarksburg, WV Is In a rural area. Clarksburg does not have the same market situations as larger cities. There is only one radiopharmacy in the area capable of fulfilling this requirement. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section VI above. Three vendors were Interested In the requirement: "Caring Hands Health Care LLC. - This vendor could not meet our emergent studies requirement of one hour "Cardinal Health-Nuclear Pharmacy Services - This vendor could not meet our emergent studies requirement of one hour "Pharmologic - which is our current vendor that we intend to sole source this requirement 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The contract specialist posted a Sources Sought Notice to FBO and will also post a Justification and Approval notifying the Industry that there is opportunity in the area. Actions were taken to remove the barrier of the restrictive one hour delivery time in emergent studies. Clinical staff deemed this necessary and Market Research was conducted and results showed that this was within Industry standard. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
