Description
IAW FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements, a justification for other than full and open competition has been submitted and approved by the VISN 18 Director of Contracting. COPY OF SIGNED JUSTIFICATION AVAILABLE UPON REQUEST. Quotes submitted against this notice will not be considered. Thank you. ? DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 18, Northern Arizona VA Health Care System requested the purchase of Verathon GlideScope Ranger Video laryngoscopy devices to be used by the Primary Care department on Emergency Code carts throughout the facility. Purchase request number 649-14-3-042-0076 applies to this acquisition. This is a justification for other than full and open competition to acquire said equipment. 2.Nature and/or Description of the Action Being Processed: This request is for other than full and open competition for the acquisition of Glide Scope GVL Ranger Single use systems (including Cobalt 3-4 Video Batons). Upon review and approval, this requirement will be awarded via a new firm-fixed price contract for the required equipment from Verathon Medical Inc, a Large Business. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Northern Arizona VA Health Care System submitted a requirement for 7 GlideScope GVL Ranger Single use Systems (including Cobalt 3-4 Video Batons). Estimated value is $58,458.75 (8,351.25 each). Delivery is estimated 30 days from receipt of order by Verathon Medical. The required delivery date is on or before August 17, 2014. 4.Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1: The video laryngoscope is a device that combines a tongue retractor (blade) with an imaging mechanism to achieve endotracheal intubation. Designs vary significantly in terms of blade design, imaging mechanisms, and the method of tube delivery. The Glidescope Video Laryngoscope (GVL) is a video laryngoscope incorporating a high-resolution miniature video camera positioned on a curved hyper-angulated laryngoscope blade (approximately 60 degrees up from horizontal). The GVL devices and their related consumable supplies are currently in use at NAVAHCS and surrounding Community Based Outreach Clinics. Additionally, hospital and CBOC staff is properly trained for the use, care, and maintenance of the GVL currently used. Obtaining video laryngoscopes other than the GVL currently in use would cost valuable storage space and inventory management resources that would be required for new supplies as well as Staff training, negatively impacting patient care. In a phone call to July 15th, 2014 480-789-1899, Lindsay Russo, Arizona Territory Representative, Verathon, Inc confirmed that the details of this requirement are not on any federal supply schedule nor are they available via any authorized resellers or distributors. Accordingly, Verathon, Inc. is the only firm capable of providing the supplies and services described in Section III above without the Veteran's Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Only one potential source is deemed practicable because the equipment is unique intellectual property as evidenced by conversation with Lindsay Russo. Market Research from sources such as GSA Advantage, VA NAC Contract Catalog Search Tool, FPDS, Contract Directory, Google and VISTA found support that there have not been, nor are there currently, sources other than Verathon Inc, that can provide the required GVL for NAVAHCS. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Anticipated Cost to the Government will be Fair and Reasonable IAW FAR 13.106-3(a)(2)(ii), comparison of the proposed price with prices found reasonable on previous purchases. The GlideScope ® Ranger Single Use System - Includes Cobalt 3-4 Video Baton (item number 0270-0415) was awarded August 29, 2013 by Department of the Army W7N3 USPFO Activity UT ARNG under delivery order V797P4669A W911YP13F0051 at $8,351.25 for quantity 3 (total award 25,053.75) which the received quote (per unit) is equivalent. The GlideScope ® Ranger Single Use System - Includes Cobalt 3-4 Video Baton (item number 0270-0415) was awarded by VISN 19 June 24, 2013 under delivery order V797P4669A VA259-13-F-2367 at $8,351.25 for quantity 2 (total award 16,702.50) which the received quote (per unit) is equivalent. Please note that in a phone conversation July 15, 2014 with Jessica McNerney, Government Contract Point of Contact, 425-867-1348 ext. 5554, it was confirmed that VA NAC FSS V797P-4669A has expired June 10, 2014 with Verathon and NAC working through the renewal process. During this process both she and Lindsay Russo have confirmed they are extending their contract pricing via open market quotes until such time as the renewal contract is fully executed. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Querying the Government wide database of contracts and other procurement instruments intended for use by multiple agencies available at www.contractdirectory.gov found that there are other VHA's or other governmental agency purchases of items or services for the Verathon GlideScope Ranger Equipment. Searches for "GlideScope," and "GlideScope Ranger," found zero NAC Federal Supply Schedule (FSS) holders, Government-Wide Acquisition Contracts (GWAC), Multi-Agency Contracts, Other Indefinite Delivery Contracts (IDC), Basic Ordering Agreements (BOA), or Blanket Purchase Agreements (BPA) awarded by many Federal Agencies leading to procurement of this product. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See paragraph 6 above. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: None ? 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
