Description
The Office of Acquisition and Agreements Management (OAAM), of the National Institute of Standards and Technology (NIST), on behalf of the National Institute of Standards and Technology (NIST)/Biosystems and Biomaterials Division (BBD), intends to negotiate on a sole source basis with Bruker Biospin Corporation of Billerica, MA, for an auto-sampler that is compatible with NIST's existing Bruker AVii 600 MHz NMR spectrometer. The BBD provides measurement methods, verified measurement standards, data and technologies to support the characterization and understanding of complex biological systems and biomaterials. Nuclear magnetic resonance (NMR) spectroscopy is an important analytical tool within the division that allows for quantitative measurement of complex biological materials. These measurements help American drug and medical device manufacturers and regulators have confidence in their measures in this ever-more-complex scientific field, so that new products for health care, food safety, environmental health, and national security can be introduced to the market quickly and safely, improving the quality of life of all Americans. The Bioassay Methods Group within the BBD has a requirement for an autosampler that is 100% compatible with NIST's existing Bruker AVII 600 MHz NMR spectrometer. The autosampler must be capable of a larger volume of samples and be fully compatible with the existing Bruker TopSpin 3.2 and Icon NMR 4.7 software. Sole source determination is based on the following: The existing spectrometer and software are commercial items that were both manufactured by Bruker Biospin Corporation. Bruker has proprietary rights to the existing equipment and is the sole manufacturer and distributor of the equipment. Bruker has no authorized resellers or service providers, therefore, only they can supply the required autosampler and guarantee that it will be fully compatible with the existing equipment and software. The North American Industry Classification System (NAICS) code for this acquisition is 334516 and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by August 28, 2014, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
