- The United States Department of Homeland Security (DHS) intends to award a sole source fixed-price Contract for the acquisition of Planned Maintenance (PM) and unscheduled Corrective Maintenance on existing portable X-Ray Inspection systems. A proposal is being requested from American Science & engineering (AS&E) to maintain the operational capacity of existing portable X-Ray Inspection Systems. A written solicitation will not be issued for this requirement. Interested parties may identify their interest and capability to respond to the requirement or submit proposals. Responses may only be sent via email to the contracting officer identified in this notice. Please note that this is only a notice of intent and is not a request for competitive proposals. Any information received within five (5) days after date of publication of this synopsis will be considered by the government solely for the purpose of determining whether to conduct a competitive procurement. A determination not to compete the proposed Task Order based upon responses to this notice is solely within the discretion of the government. This requirement is not set-aside for small business concerns. The North American Industry Classification System (NAICS) is 811219. The Product Service Code (PSC) is J059. Authority Cited: The statutory authority permitting other than full and open competition is 41 U.S.C. 253 (c)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart FAR 6.302-1(a)(2)(ii) - Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. Reason for Authority Cited: In accordance with AS&E service agreement terms and conditions, only engineers trained and certified by AS&E are authorized to repair and/or service AS&E systems. Service attempted or performed by any person or company not authorized to perform such service will void existing warranties on the AS&E systems currently in operation. Additionally, the supplies required to maintain the existing systems are specifically designated by AS&E and use of any alternate brands dissolves the implied and imputed warranties of individual components as well as the overall systems; therefore, it is in the best interest of the government to procure maintenance services from AS&E to minimize cost impacts associated with any potential warranty rework that may be required.
