DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, NCO 16 Overton Brooks VA Medical Center 510 East Stoner Avenue Shreveport, LA 71111 Purchase Request #: 667-14-1-073-0003 2.Nature and/or Description of the Action Being Processed: This acquisition is to be obtained, by the use of other than full and open competition with a task order to extend contract #: VA256-P-0953 awarded as a firm-fixed-price contract for Magnetic Resonance Imaging (MRI) services. The modification is to extend the contract from August 16, 2014 through September 30, 2014. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Currently OBVAMC has and MRI contract #: VA256-P-0953 for Radiology Service at Overton Brooks VA Medical Center, Shreveport LA that will expire Aug 15, 2014. MRI services with trailer, equipment and labor are required for the period Aug 16, 2014 through Sep 30, 2014 to allow for completion of new contract award, phase in period, and any required Background Investigations for new employees. The MRI services are required to meet our veteran's needs in the local area. The estimated cost for the additional extension period will be $84,300. Required Delivery Date is: Aug 16, 2014. 4.Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 (X) (5) Authorized or Required by Statute FAR 6.302-5; Public Law 109-461 ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Currently there is an MRI services contract that will expire Aug 16, 2014 which provides MRI services for our veterans at OBVAMC, Shreveport, LA. While continuing to work on the new MRI requirement the Government is extending the current contract to allow for the time to complete the award process for a new MRI services contract with a base and four (4) option years. In accordance with Public Law 109-461 the incumbent contractor is a Service Disable Veteran Owned Small Business (SDVOSB) and has an experienced team that has met the Shreveport VA's need for the required MRI services and will be able to seamlessly work for the 45 day extension period without interruption of services. No other vendor would be able to set up the MRI trailer with equipment and personnel for a 45 day period for the same or near same cost of the current contractor. Therefore, the Government could not expect to find a fair and reasonable price from a different contractor for the 45 day period required to complete the contract. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Market Research was not conducted for the 45 day extension due to the cost that would be incurred from using a different contractor for only 45 days. However, continued services are needed to provide MRI services to our veteran patients. The most cost effective way for continued services due to start-up cost for a new contractor is to extend the current contract with a task order. Request for Information (RFI) #: VA256-13-I-1029 was posted to GSA Advantage Jun 5, 2013 for the new MRI services contract which will be for a one year Base period with four (4) option years. One response was received which would not allow for competition. Additional Market Research revealed more than adequate SDVOSB could provide MRI services. The Government plans to post the new MRI requirement as full and open competition for SDVOSB. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Continued services are needed to provide MRI services to our veteran patients. The current contractor has an experienced team that can met the Shreveport VA's need for the required MRI services and will be able to seamlessly work for the 45 day extension period without interruption of services. The most cost effective way for continued services due to start-up cost for a new contractor is to extend the current contract for the same price which has been determined to be a fair and reasonable price. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market Research was not conducted for the 45 day extension due to the start-up cost that would be incurred from using a different contractor for a 45 day period. Market Research and common knowledge of Government employees show that MRI services are a commercial item. Request for Information (RFI) #: VA256-13-I-1029 was posted to GSA Advantage on Jun 5, 2013 to advise industry of the pending acquisition for the new MRI services contract that will be for a one year Base period with four (4) option years. One response was received, this would not allow for competition. Additional Market Research revealed there are more than adequate SDVOSB that can provide MRI services. The Government posted the new MRI requirement as full and open competition for SDVOSB to allow for competition. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: Continued services are needed to provide MRI services to our veteran patients. The most cost effective way for continued services due to start-up cost for a new contractor is to extend the current contract. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Market Research was not conducted for the 45 day extension due to the cost that would be incurred form using a different contractor for only three months. When the Request For Information (RFI) #: VA256-13-I-1029 was posted to GSA Advantage Jun 5, 2013 for the new MRI services contract for a one year Base period with four (4) option years, one response was received showing interest in the requirement. However, this would not allow for competition. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: A new requirement, Solicitation #: VA256-13-R-1258 for MRI Services for a base period with 4 option years was posted as a full and open competitive 100% set aside for SDVOSB.
