- Questionnaire Wage Determination Quality Assurance Surveillance Plan Solicitation Document Performance Work Statement Price Schedule DESCRIPTION: This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This solicitation is a Request for Quote (RFQ). The solicitation number for this requirement is HA603814RCPB003. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 05-40. The associated North American Industrial Classification System (NAICS) code for this procurement is 561730 - - Landscaping Services with a Standard Size of $7.50M. THIS IS A TOTAL SMALL BUSINESS SET-ASIDE. This is a RFP for the grounds maintenance services with options. The Government intends to award a Firm Fixed-Price contract with a 12 month base period and four (4) 12 month option periods as a result of this solicitation that will include the terms and conditions that are set forth herein. SUPPLIES OR SERVICES AND PRICES/COSTS: 1. Description of Supplies & Services 1.1.1. The Department of Defense Education Activity (DODEA) has a requirement for grounds maintenance services for DODEA schools located on Fort Jackson Army Garrison. 1.1.2. Pricing Terms - "CLIN defined by 0001 etc." means contract line item that corresponds to each year. "UNIT PRICE" represents the amount to be paid to the contractor monthly. 1.1.3. The Price Schedule below is provided as an attachment to this solicitation and must be submitted along with your response to this RFQ. (See Exhibit 1 - PriceSchedule to this RFQ.) (End of Clause) 52.222-99 ESTABLISHING A MINIMUM WAGE FOR CONTRACTORS (DEVIATION 2014-O0017) (JUNE 2014) This clause implements Executive Order 13658, Establishing a Minimum Wage for Contractors, dated February 12, 2014, and OMB Policy Memorandum M-14-09, dated June 12, 2014. (a) Each service employee, laborer, or mechanic employed in the United States (the 50 States and the District of Columbia) in the performance of this contract by the prime Contractor or any subcontractor, regardless of any contractual relationship which may be alleged to exist between the Contractor and service employee, laborer, or mechanic, shall be paid not less than the applicable minimum wage under Executive Order 13658. The minimum wage required to be paid to each service employee, laborer, or mechanic performing work on this contract between January 1, 2015, and December 31, 2015, shall be $10.10 per hour. (b) The Contractor shall adjust the minimum wage paid under this contract each time the Secretary of Labor's annual determination of the applicable minimum wage under section 2(a)(ii) of Executive Order 13658 results in a higher minimum wage. Adjustments to the Executive Order minimum wage under section 2(a)(ii) of Executive Order 13658 will be effective for all service employees, laborers, or mechanics subject to the Executive Order beginning January 1 of the following year. The Secretary of Labor will publish annual determinations in the Federal Register no later than 90 days before such new wage is to take effect. The Secretary will also publish the applicable minimum wage on www.wdol.gov (or any successor website). The applicable published minimum wage is incorporated by reference into this contract. (c) The Contracting Officer will adjust the contract price or contract unit price under this clause only for the increase in labor costs resulting from the annual inflation increases in the Executive Order 13658 minimum wage beginning on January 1, 2016. The Contracting Officer shall consider documentation as to the specific costs and workers impacted in determining the amount of the adjustment. (d) The Contractor Officer will not adjust the contract price under this clause for any costs other than those identified in paragraph (c) of this clause, and will not provide price adjustments under this clause that result in duplicate price adjustments with the respective clause of this contract implementing the Service Contract Labor Standards statute (formerly known as the Service Contract Act) or the Wage Rate Requirements (Construction) statute (formerly known as the Davis Bacon Act). (e) The Contractor shall include the substance of this clause, including this paragraph (e) in all subcontracts. (End of clause) 252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (MAY 2013) (a) Definitions. As used in this clause- "Department of Defense Activity Address Code (DoDAAC)" is a six position code that uniquely identifies a unit, activity, or organization. "Document type" means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF). "Local processing office (LPO)" is the office responsible for payment certification when payment certification is done external to the entitlement system. (b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports. (c) WAWF access. To access WAWF, the Contractor shall- (1) Have a designated electronic business point of contact in the System for Award Management at https://www.acquisition.gov; and (2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site. The section shall be prepared in an orderly format and in sufficient detail to enable the Government to make a thorough evaluation of the contractor's technical competence and ability to comply with the contract requirements specified in the PWS. The offeror shall address as specifically as possible the actual methodology it will use for accomplishing the PWS tasks. Additionally, identify any assumptions used in preparing the quote. -Evaluation Criteria The Offeror shall construct and present its quote/responses in the format listed below. TECHNICAL Technical Expertise - Offerors shall demonstrate mission capability with services similar type, size, and complexity to those contained in this requirement, to include subcontractor and/or teaming arrangement participants that are depicted to be key to the offeror satisfying all areas of its proposed PWS. Staffing Approach - The Offeror shall provide a staffing plan for acquiring qualified personnel throughout the life of the contract, including recruiting, retaining, and replacing when necessary with the required skill sets. The Offeror shall demonstrate its understanding of the requirement and provide its organizational structure and/or teaming arrangement. The Offeror shall describe its plan for and ability to engage quality personnel. The Offeror shall also be trained and certified to handle hazardous and petroleum contaminated materials in compliance with local, state and federal regulations. PAST PERFORMANCE The Government will provide a Past Performance Questionnaire (Attachment 4 of the solicitation) for Offerors to forward to their clients. The questionnaire shall be sent directly to the Contract Specialist at alicia.prince@am.dodea.edu. The return address for the questionnaire is annotated on the form. Any questionnaire not returned directly to the Contract Specialist will not be reviewed or evaluated. However, the Government will use data sources such as the Past Performance Information Retrieval System (PPIRS), Contractor Performance Assessment Reporting System (CPARS), and Federal Awardee Performance and Integrity Information System (FAPIIS) or similar systems and State Department Watch Lists to assess the quality of the Offeror's performance. The purpose of the assessment is to identify and review recent performance within the past three (3) years of similar scope, magnitude, and complexity to the service required to be performed. Offerors with no relevant present or past performance history shall receive the rating of "neutral", meaning the rating is treated neither favorably nor unfavorably. Offerors are reminded that both independent data, data provided in quotes, and returned questionnaires will be used by the Government to evaluate past performance. The Past Performance factor will be assigned one of the ratings defined below. Ratings Description ACCEPTABLE Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror performance is unknown UNACCEPTABLE Based on the offeror's performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability" unknown" shall be considered "acceptable." PRICE The offeror shall complete Exhibit 1- Price Schedule of the solicitation. Exhibit 1 shall be submitted fully completed and error free. It shall contain the offeror's prices for the established Contract Line Items Numbers (CLINs). The offeror shall provide all data required to make assessments of fairness and reasonableness. The price quote shall consist of the offeror's costs to successfully complete the proposed work identified in the PWS. The Government reserves the right to require the submission of Other Than Certified Cost or Pricing Data it is deemed necessary to arrive at a determination of a fair and reasonable price. The offeror shall ensure that no pricing information is displayed in the Technical informatin (b)(5) Solicitation Questions: Questions concerning the solicitation document should be submitted in writing to the Contract Specialist. (End of provision) 52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999) (a) The Government will award a single, firm-fixed price contract from this solicitation using FAR Part 13 and FAR Subpart 12 procedures. The Government will not pay a price it considers to be disproportionate to the benefits associated with the proposed service.
