- JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: The proposed action is for a firm-fixed-price (FFP) Delivery Order (DO) to renew warranty and maintenance support subscriptions for four Citrix NetScaler MPX Appliances located at the VA Financial Services Center (FSC). The proposed effort will be awarded under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) IV Government-Wide Acquisition Contract (GWAC). The period of performance for this requirement is 60 days for the base period with three 12 month option periods. 3. Description of Supplies or Services: The proposed action is to procure Citrix brand name warranty and maintenance support coverage for four Citrix NetScaler MPX Appliances. The warranty and maintenance support services include 24x7x365 remote technical support, access to software patches, and hotfix updates. 4. Authority Cited: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized". 5. Rationale Supporting Use of Authority Cited Above: Based on the market research detailed below, the Government anticipates limited competition for the aforementioned brand name requirement. This is a brand name justification in support of FAR 11.105, Items Peculiar to One Manufacturer. This acquisition specifies that Citrix brand name warranty and maintenance support be provided. VA does not posess the proprietary technical data required to maintain and upgrade the Citrix NetScaler appliances that have been in use at the FSC for several years. Failure to acquire the warranty and maintenance support for these appliances would leave VA without the necessary certified support needed if/when system problems occur. The procurement of new appliances rather than renewing the warranty and maintenance support would result in substantial duplication of costs that would not be recovered through a new competitive acquisition. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. Limited competition among Citrix authorized resellers is anticipated for the required warranty and maintenance support services. In accordance with FAR 5.301 and 16.505(b)(2), this action will be synopsized at time of award on the Federal Business Opportunities Page (FBO) and the justification will be made publicly available. In accordance with FAR 16.505(a)(4)(iii)(A), the justification will be posted with the request for quote on the NASA SEWP IV GWAC. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. 8. Market Research: Market research was conducted in July 2014 to ascertain if other products could satisfy VA's requirements. Specifically, VA subject matter experts looked at F5 Network Solutions and Array Networks brands and determined that neither product could seamlessly integrate into the existing VA network. Based upon this market research, it is in VA's best interest to continue to maintain the existing Citrix brand name appliances, which meet all of FSC's current needs. While other sources possess general capabilities needed to provide similar services, no other source was found to meet VA's needs without access proprietary information. Additional market research was conducted using the product verification tool on the NASA SEWP website to search for resellers of the required brand name warranty and maintenance support services. Currently there are five SEWP venders that offer the required services; one Service-Disabled Veteran-Owned Small Business (SDVOSB) Value Added Reseller (VAR) in Group B, three small business VARs in Group C, and one VAR in Group D. 9.
