Description
THIS IS A TASK ORDER AGAINST AN ALREADY AWARDED MULTIPLE AWARD IDIQ CONTRACT THAT WAS AWARDED IN FY 2009. Pursuant to the criteria outlined in FAR 16.505(b)(2)(i)(C), the order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original award. This requirement is a logical follow-on to IBM09D0008-IBM12T0008. Based on the preliminary design completed by URS Group, Inc. (URS) under IBM12T0008, it was recommended to the International Boundary and Water Commission (IBWC) that in order to eliminate permit violations at the plant (rated at a capacity of 50 Mgd peak flow), construction of an equalization basin and three SSTs are required. Using the recommendation, a final Plans, Specifications, and Estimate (PS&E) package is required for bidding purposes. URS's report is part of the preliminary design process that needs to be completed prior to moving forward with a final PS&E design. If the PS&E design is awarded to a separate contractor, the secondary contractor will want to conduct his own preliminary design to make sure that the proposed design and construction is correct. This would be considered waste of government resources. Second, the Government is limited in time to complete this design project due to budget constraints. Third, the Contractor has gained extensive knowledge from their study, analysis, and the preliminary design work conducted under IBM12T0008. Both Contract holders were provided with a fair opportunity to be considered for the original award of IBM12T0008. Based on the findings set forth above, the Contracting Officer has determined the requirement meets the conditions established in 16.505(b)(2)(i)(C) and the issuance of a Task Order to URS as an Exception to Fair Opportunity is in the best interest of the Government.
